SUBJECT: CONSIDER THE PROPOSED TRANSPORTATION DEMAND
MANAGEMENT (TDM) FACILITIES ORDINANCE
BACKGROUND
Each city in Ventura County must adopt a Transportation Demand Management (TDM)
Facilities Ordinance by December, 1993 in order to comply with the requirements of the
Congestion Management Program (CMP), as outlined within Government Code Sections
65089 and 65089.3. The Ventura County Transportation Commission (VCTC) is
responsible for the preparation of the CMP in Ventura County and must determine
annually whether the County and cities within the County are conforming to the CMP,
including the requirements to adopt and implement a TDM Facilities Ordinance to improve
both congestion and air quality (consistent with Government Code Section 65089.3(a)(2)).
The purpose of this staff report is to present the draft TDM Facilities Ordinance to the
Council for review and request adoption of the Ordinance recommending City Council
adoption of the TDM Facilities Ordinance.
DISCUSSION
On November 9, 1993, the Planning Commission considered the proposed TDM Facilities
Ordinance, and adopted Resolution Number PC 93-285 recommending adoption of the
attached Ordinance. The Commission's recommendations have been included within the
attached Ordinance; additions and deletions by the Commission and City Attorney are
noted in legislative format - additions have been shaded and deletions have been struck
out.
Reference to non-residential discretionary permits has been deleted within the Ordinance.
This deletion was recommended by the City Attorney, in order to clarify development
permits (ie., commercial and industrial permits) affected by the Ordinance.

In order to clarify the requirements for carpool/vanpool parking spaces to be provided,
in an amount equal to 10% of the parking spaces required by the City of Moorpark's
Zoning Ordinance, the text has been deleted on top of page 5 and replaced with the
shaded language within this section.
Pursuant to the City Attorney, the language on page 6 does not clarify the City's intention
to encourage mixed-use projects and, therefore, has been deleted.
Within the Ordinance, reference is made to the words "shall and recommended"; the
Commission expressed concern with the use of the word "shall" and, in certain
circumstances, recommended that the word "shall" be replaced with the word "should."
Given that the City is adopting an Ordinance which is supposed to meet the minimum
requirements of the CMP, VCTC staff has indicated that using the term should will not
comply with the intent of the CMP. Further, pursuant to the VCTC, references to
"recommended" within the Ordinance must be changed to be "required"
The attached Ordinance is intended to meet the State Law and the requirements of the
CMP. Its purpose is to promote alternative transportation methods, such as carpools,
vanpools, transit, bicycles, walking and park-and-ride lots, improvement in the balance
between jobs and housing, and other strategies, including flexible work hours,
telecommuting and parking management programs. The attached ordinance is intended
to promote trip reduction and travel demand measures in the City of Moorpark and meet
the TDM Facilities Ordinance adoption requirements as set out in the Ventura County
Congestion Management Program, see attached.
The proposed Ordinance presented for Council consideration meets the minimum TDM
Facilities Ordinance requirements outlined in the CMP. The proposed ordinance will set
forth the minimum requirements for meeting the CMP. The attached ordinance proposes
changes to existing sections within the Moorpark Zoning Ordinance (Ordinance Number
137) through the addition of a new article (Article 12) entitled Transportation Demand
Management.
Consistent with Article 15, Section 8115-1.1, of the Moorpark Zoning Ordinance, entitled
"Amendments",the Planning Director has determined that in order to ensure consistency
with the CMP by December, 1993, the proposed amendments to and additions to the
Moorpark Zoning Ordinance should be reviewed by the Planning Commission. The City
Attorney has reviewed the attached ordinance and recommended changes have been
made to the Ordinance.

The Air Pollution Control District's (APCD) air quality thresholds, Rule 210, will not be pre-
empted by the attached Ordinance. A recent state law took away the authority of the
APCD to regulate vehicle trips for companies with under 100 employees (Senate Bill 883).
The law has a sunset clause of 1997, at which`date, APCD will regulate vehicle trips for
companies with under 100 employees. The employee threshold level of 50 or more
employees, as outlined on page 4 of the Ordinance have been established by VCTC in
order to meets the mandates of the CMP and with anticipation of the 1997 sunsetting of
Senate Bill 883.
RECOMMENDATIONS
1. Review and comment on the attached draft TDM Facilities Ordinance.
2. Introduce the TDM Facilities Ordinance for first reading.

AN ORDINANCE OF THE CI4 COUNCIL OF THE
CITY OF MOORPARK, CALIFORNIA, AMENDING ORDINANCE NUMBER 137,
THE MOORPARK ZONING ORDINANCE, TO ESTABLISH
A TRANSPORTATION DEMAND MANAGEMENT FACILITIES ORDINANCE
IN ACCORDANCE WITH STATE GOVERNMENT CODE
SECTIONS 65089 AND 65089.3
WHEREAS, State Government Code Sections 65089 and 65089.3, require the
preparation and implementation of a Congestion Management Plan (CMP) and
Transportation Demand Management (TDM) Facilities Ordinance in every urbanized area
within a county; and
WHEREAS, the Ventura County Transportation Commission(VCTC)is responsible
for the preparation of the CMP in Ventura County and must annually determine whether
the County and cities within the County are in compliance with the CMP, including the
requirement to adopt and implement a TDM Facilities Ordinance to improve congestion
and air quality (Government Code Section 65089.3{a}{2}); and
WHEREAS,VCTC has established basic elements which must be addressed within
the TDM Facilities Ordinance as follows:
1. Standards for the number, size, and location of preferential carpool and
vanpool parking spaces.
2. Standards for the number and location of bicycle racks and/or lockers.
3. Requirements for the provision, where feasible and appropriate, of transit
stop improvements (ie., bus pullouts, bus pads, and shelters).
4. Requirements for the provisions of a transportation information center for
non-residential developments serving 50 or more employees.
5. Safe and convenient access for pedestrians and bicyclists from the external
circulation system to on-site buildings or internal streets/sidewalks.
6. A formal role for transit operators in the local jurisdictions environmental and
development review process.
7. Requirements for large developments to address the provision of needed
services in close proximity to either jobs or housing.

WHEREAS, the State Clean Air Act requires ozone non-attainment areas such as
Ventura County to attain a 1.5 average vehicle occupancy during commute periods by
the year 1999, and no net increase in motor vehicle emissions after 1997; and
WHEREAS, in order to more efficiently use the existing and planned
transportation infrastructure, maintain or improve traffic levels of service, and lower motor
vehicle emissions, it is the policy of the City of Moorpark to minimize the number of peak
period vehicle trips generated by additional development, promote the use of alternative
forms of transportation, improve air quality and participate in regional and countywide
efforts to improve transportation demand management; and
WHEREAS, at a duly noticed public hearing on November 9, 1993, the Planning
Commission considered the additions to and amendments to the Moorpark Zoning
Ordinance and reached its decision to recommend approval to the City Council of the
proposed Zoning Ordinance addition and amendments in order to implement the
Transportation Demand Management Facilities Ordinance; and
WHEREAS, at a duly notice public hearing on November 15, 1993, the City
Council considered the recommendation of the Planning Commission regarding the
additions to and amendments to the Moorpark Zoning Ordinance and reached its
decision to approve the additions and amendments to the Zoning Ordinance in order to
implement the Transportation Demand Management Facilities Ordinance.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The proposed additions and amendments to the Zoning
Ordinance (Ordinance Number 137) are exempt from CEQA requirements, based upon
a Class 8 (Section 15308) exemption in order to assure the maintenance, restoration,
enhancement, and protection of the environment.
SECTION 2. The City Council adopts the following findings:
The City Council finds that Element Number 2, recommended relied by
VCTC, is already addressed in the City's Zoning Ordinance (Ordinance Number 137,
Section 8108 1.5.b.) by establishing standards for the number and location of bicycle
racks.
The City Council finds that Element Number 6, recommended tOpfrOttrequired by
VCTC, is already addressed by the City's development review process and given that the
City acts as the City's transit operator.

SECTION 3. Article 2, Section 8102-0 of Ordinance 137 is hereby amended
by adding the following definitions:
" Carpool - means a vehicle occupancy of two or more persons ages 16
years or older commuting to or from work and/or school.
Commuter - means any person who regularly travels by vehicle to or from
work or school.

Telecommuting - means using your home as a place of work.
Transportation Demand Management (TDM) Facilities Ordinance - means
alternative travel behavior, usually on the part of the commuters, through programs of
incentives, services, and policies. The TDM Facilities Ordinance addresses alternatives
to single occupancy motor vehicles such as carpooling and vanpooling,i and changes in
work schedules that move trips out of the peak travel period or altogetherleliminates them
(as in the case ' compressed work weeks).
Transportation Information Board -is a bulletin board, display case, or kiosk
displaying transportation information. The board must be located where it is likely to be
seen by the greatest number of employees.
Vanpooling - means a group of at least seven commuters traveling to work
in a vehicle designed to carry more than six but less than 16 persons, including the
driver, which is maintained and used primarily for work-related transportation of
commuters for the purpose of ridesharing."
SECTION 4. Elements 1, 3, 4, 5, and 7, feGemmended two by VCTC,
are hereby addressed within the Moorpark Zoning Ordinance by adding Article 12 entitled
Transportation Demand Management as follows:
"ARTICLE 12
TRANSPORTATION DEMAND MANAGEMENT
Section 8112-1. For all residential and non-residential
discretionary permits, as described in Section 8111-2.1.1 of the Moorpark
Zoning Ordinance, the applicant shall provide, where feasible and
appropriate:

8112-1.1 Transit stop improvements, including but not limited to
bus pullouts, bus pads, or shelters, as required by the decision
making body or other agency.
8112-1.2 Safe and convenient access for pedestrian and
bicyclists from the external circulation system to on-site buildings or
internal street/sidewalks.

outlined within Section 8112-1 and shall include in the project design a
transportation information board (see definition, Section 8102-0 of
Ordinance Number 137) located where it is likely to be seen by the greatest
number of employees. Information on the board shall include, but is not
limited to, the following:
• Current maps, routes and schedules for public transit routes
serving the site;
• Ridesharing promotion material supplied by commuter-
oriented organizations;
• Telephone numbers for referrals on transportation information
including numbers for the regional ridesharing agency, Dial-A-
Route, and local transit operators;
• Bicycle route and facility information, including regional/local
bicycle maps and bicycle safety information;
• A listing of facilities and services available for carpoolers,
vanpoolers, bicyclists, transit riders and pedestrians at the
site.

Section 8112-5. For all residential developments of five hundred
(500) dwelling units or more, the applicant shall comply with the
requirements as outlined within Section 8112-1, and shall comply with the
following measure to the satisfaction of the City:

incorporate services such as dry cleaners, eating establishments,
child care facilities, grocery markets, neighborhood work centers and

SECTION 5. If any section, subsection, sentence, clause, phrase or word of this
Ordinance is for any reason held to be invalid or unconstitutional by any court of
competent jurisdiction, such decision shall not affect the validity or constitutionality of the
remaining portions of this Ordinance. The City Council hereby declares that it would
have passed and adopted this Ordinance and each and all portions thereof, irrespective
of the fact that any one or more of said portions may be declared invalid or
unconstitutional.
SECTION 6. This Ordinance shall become effective thirty (30) days after its
passage and adoption.
SECTION 7. The City Clerk shall certify to the passage and adoption of this
Ordinance by the City Council; shall enter the same in the book or original ordinances
of said City; shall make a minute of the passage and adoption thereof in the records of
the proceedings of the City Council at which the same is passed and adopted; and shall,
within fifteen (15) days after the passage and adoption thereof, cause the same to be
published in the Moorpark News-Mirror, a weekly newspaper of general circulation, as
defined in Section 6008 of the Government Code, for the City of Moorpark and which is
hereby designed for that purpose.

BASIC ELEMENTS OF THE

The TDM Facilities Ordinance must include, at a minimum, the following elements:
