Gilbert, Director of Public Works �( DATE: December 19, 1990 (Council Meeting 1-9-91) SUBJECT: Filing of Lobbying Certificate OVERVIEW This presents for approval the filing of a Certification relating to lobbying activities. DISCUSSION The Federal Highway Administration has advised all cities and counties which use U. S. Department of Transportation funds, that they are now required to provide lobbying certification. Attached for your approval is a form entitled Certification for Contracts, Grants, Loans and Cooperative Agreements. This form stipulates that no Federal funds have or will be used for lobbying expenses. It also stipulates that certain language must be included in the contract documents for federally funded project exceeding $100,000, which would require contractors and subcontractors to file like certifications. Also included in the transmittal received is a form used to report federal lobbying activities funded by sources other than Federal appropriations. In that the City does not incur such expenses at this time, the recommendation set forth below does not include the filing of this form. S. Department of Transportation (DOT) funds must provide lobbying certifications. The certifications are intended to be project specific; however, FHWA has agreed that local agencies need only make annual certifications. Accordingly, if your agency is utilizing DOT funds, please sign the enclosed "Attachment A" entitled "Certification for Contracts, Grants, Loans and Cooperative Agreements" and return it to Caltrans District 7, Local Streets and Roads Branch. If non -Federal funds are used for lobbying, your agency must also sign "Standard Form LLL" which is included as "Attachment B". This first year certification should be on file for all projects authorized for advertisement after January 1, 1991. (2) If any funds other than Federal appropriated funds have been paid or will be paid to any person for influencing or attempting to influence an officer or employee of any Federal agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with this Federal contract, grant, loan, or cooperative agreement, the undersigned shall complete and submit Standard Form-LLL, "Disclosure Form to Report Lobbying," in accordance with its instructions. (3) The undersigned shall require that the language of this certification be included in the award documents for all subawards at all tiers (including subgrants, and contracts and subcontracts under grants, subgrants„ loans, and cooperative -agreements) which exceed $100,000, and that all such subrecipients shall certify and disclose accordingly. This certification is a material representation of fact upon which reliance was placed when this transaction was made or entered into. Submission of this certification is a prerequisite for making or entering into this transaction imposed Ly section 1352, title 31, U. S. Cade. Any person who fails to file tl,e required certification shall be subject to a civil penalty of not less than $10,000 and not more ihan $100,000 for each such failure.
