HARE City Treasurer to the City Manager Prior to the establishment of the Ventura County Transportation Commission (1989), the Ventura County Service Authority (SAFE) was formed (1986). SAFE is responsible for the establishment, operations, and maintenance of freeway callboxes. Funds for the callboxes are derived from an additional $1 charge to motor vehicle license fees. To date, callboxes are located on the 1, 23, 101, 118, and 126. Additional callboxes are planned for state route 118 from Moorpark west to Ventura, provided that the callboxes may be safely sited. In all other counties with transportation commissions, the SAFE has been part of the commissions' responsibilities. Since legislation establishing the SAFE was enacted prior to the establishment of VCTC, the SAFE has remained separate. Recently, the SAFE board adopted a resolution asking the VCTC to assume responsibility for the SAFE. The VCTC adopted a resolution indicating its willingness to assume responsibilities of the SAFE. In order to formally transfer responsibilities, the Board of Supervisors and a majority of the cities with a majority of the population must adopt resolutions designating the VCTC as the SAFE. Staff Recommendation Adopt Resolution 91- 7 341 designating the Ventura County Transportation Commission as the Ventura County Service Authority for Freeway Emergencies. attachment 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 RESOLUTION NO. 91 - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK REPEALING RESOLUTION 86 -335 AND DESIGNATING THE VENTURA COUNTY TRANSPORTATION COMMISSION AS THE SERVICE AUTHORITY FOR FREEWAY EMERGENCIES WHEREAS, pursuant to Streets and Highways Code Section 2551, Subdivision (a), a Service Authority For Freeway Emergencies (SAFE) was established in 1986 by resolutions of the Board of Supervisors of the County of Ventura and the City Councils of the cities of Camarillo, Fillmore, Ojai, Oxnard, Moorpark, Port Hueneme, San Buenaventura, Santa Paula, Simi Valley and Thousand Oaks; WHEREAS, the Ventura County Transportation Commission (VCTC) was created in January of 1989 as successor to the Ventura County Association of Governments (VCAG); and WHEREAS, Subdivision (b) of Streets and Highways Code Section 2551 provides that the Board of Supervisors and the City Councils of a majority of the cities within the County having a majority of the population of cities within the County may by resolution designate the VCTC as the SAFE; and WHEREAS, it is in the best interests of Ventura County and the cities within the County to designate the VCTC as the SAFE; and WHEREAS, the SAFE has entered into contracts and agreements with various governmental agencies and private businesses for the installation of freeway call boxes and the issuance of bonds to provide funds therefor; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES'HEREBY RESOLVE: 1. Resolution 86 -335 is hereby repealed. 2. The VCTC is hereby designated as the SAFE. 3. The members of the VCTC appointed in accordance with Public Utilities Code Section 130054.1 shall be and hereby are designated as the governing board of the SAFE. 4. The VCTC shall by resolution agree to be the governing board of SAFE, to assume all assets and liabilities of the SAFE, and to ratify and adopt all contracts and actions of the governing board of the SAFE as it was constituted from time to time as such governing board. 5. By this resolution it is intended that the VCTC shall replace and be a successor to the governing board of SAFE appointed under the provisions of Streets and Highways Code Section 2553, and that the affairs of the SAFE shall henceforth be administered by the VCTC. 6. The bylaws of the SAFE shall be revised to reflect the change in the membership constituency of the governing board. PASSED AND ADOPTED this 6th day of February, 1991. Paul W.
