Richards, Director of Community DATE: Development January 24, 1991 (CC meeting of February 6, 1990) SUBJECT: AN ORDINANCE REZONING THE CARLSBERG PROPERTY FROM ITS CURRENT RE, RE -1 AND RPD 1.6 TO: C -P -D (SP), M -1 (SP), O -S (SP), R -A (SP), RPD lu (SP), RPD 2u (SP), RPD 3u (SP), AND RPD 5u (SP) Background On October 30, 1990, the City Council reviewed the Ordinance for adopting the Community Design Plan and the Development Standards and rezoning of the Carlsberg Specific Plan text. The City Attorney advised the City Council that the Planning Commission as an Advisory Agency must review and make recommendations to the City Council on the proposed Ordinance to change the Zoning of the Carlsberg Property. The Planning Commission held a public hearing on this issue on January 22, 1991 and passed resolution No. 91 -229 recommending to the City Council rezoning of the Carlsberg property in accordance with staff's recommendation. Discussion The adoption of an Ordinance rezoning the Carlsberg property to be consistent with the land use designations as described in the Carlsberg Specific Plan is necessary to be consistent with the protection of public health, safety, and general welfare. The purpose of the rezoning is to bring the zoning designations into consistency with the approved Land Use Plan within the Carlsberg Specific Plan. The Department of Community Development is recommending to the City Council that Section No. 8104 -6 -2 of the proposed new Zoning Ordinance (to be heard on February 6, 1991) add a Section relating to Specific Plan Zone (SP) . This suffix shall be used for property that is subject to a specific plan. 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 The purpose of this suffix is to allow the base zoning classification standards to remain in place unless superseded by any regulations, design standards, or policies of the Specific Plan text it represents. The EIR for the Carlsberg Specific Plan adequately identifies the impacts that would be created by the rezoning of Carlsberg property. Thus a subsequent use of the EIR would be appropriate for the rezoning of the property. Recommendation 1. Review the attached draft Ordinance regarding the rezoning of the Carlsberg Specific Plan property. 2. That the City Council finds that the subsequent use of the Environmental Impact Report for the Carlsberg Specific Plan is adequate for the rezoning of the Carlsberg property, and that the EIR adequately identifies the impacts that would be created by the rezoning of the property to be consistent with the land use designations for the Carlsberg Specific Plan property. 3. That the City Council approve the attached Ordinance regarding the rezoning of the Carlsberg Specific Plan property and introduce the Ordinance for first reading. Attachments: 1. AN ORDINANCE OF THE CITY COUNCIL, CITY OF MOORPARK, CALIFORNIA, REZONING CERTAIN PROPERTY SO AS TO BE CONSISTENT WITH THE APPROVED CARLSBERG SPECIFIC PLAN WHEREAS, an application has been made by Carlsberg Financial Corporation to the City of Moorpark for the Carlsberg Specific Plan; and WHEREAS, public notice having been given in time, form, and manner as required by law, the City Council of the City of Moorpark has held public hearings on the Carlsberg Specific Plan from July 2, 1990 to October 24, 1990, has received testimony regarding said Specific Plan, has duly considered the Community Design Plan and Development Standards contained within the body of the Carlsberg Specific Plan text, and has reached its decision to approve the Specific Plan on October 30, 1990; and WHEREAS, the City Council has determined that the development of the land described in the Carlsberg Specific Plan document will have a significant effect on the environment, and has certified the Environmental Impact Report prepared for the Carlsberg Specific Plan as being completed in compliance with the State CEQA Guidelines issued thereunder, and the the subsequent use of the .EIR is appropriate for the rezoning of the Carlsberg property; and WHEREAS, Environmental Impact Report SCH #90010229 provided an environmental assessment of the proposed Specific Plan in accordance with the California Environmental Quality Act and State CEQA Guidelines; and WHEREAS, on October 30, 1990, the City Council approved a Specific Plan for the property addressed within the Carlsberg Specific Plan text by the adoption of Resolution No. 90 -714; and WHEREAS, the City Council has adopted the Carlsberg Specific Plan in accordance with Government Code Sections 65450- 65457; and WHEREAS, Government Code Section 65860 requires that a City's Zoning Ordinance shall be consistent with the General Plan; and WHEREAS, in order to satisfy the consistency requirement, the City has initiated a change in zone on the subject property so as to be consistent with the approved Carlsberg Specific Plan; and WHEREAS, on January 22, 1991, the Planning Commission recommended approval of the zoning changes for the Carlsberg Property in accordance to Exhibit A. WHEREAS, on February 6, 1991, the City Council reviewed the draft Ordinance for rezoning the Carlsberg property from its current RE, RE -1 and RPD 1.6 to CPD (SP), M -1 (SP), O -S (SP), RPD lu (SP), RPD 2u (SP), RPD 3u (SP), RPD 5u (SP) and R -A (SP), and has reached its decision in this matter. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the Environmental Impact report prepared for the Carlsberg Specific Plan adequately identifies the impacts for the area affected by this Ordinance and that the subsequent use of that EIR is appropriate for the rezoning of the Carlsberg property. SECTION 2. The City of Moorpark Zoning Map is hereby amended as specified by Exhibit A attached hereto by reference which delineates that certain real property which is hereby changed to: C -P -D (SP), M -1 (SP), O -S (SP), R -A (SP), RPD lu (SP), RPD 2u (SP), RPD 3u (SP), and RPD 5u (SP) from RE, RE -lac and RPD 1.6u. SECTION 3. The City Clerk is hereby directed to notify the Ventura County Assessor's Office and the owner of record of the subject property of this Zoning Ordinance change within 30 days from the date of this action as required in California Government Code 65863.5. A certified copy of the Ordinance and the attached Zoning Map ( Exhibit A) shall be transmitted with said notice to the County Assessor's Office. Section 4. The Director of Community Development of said City shall cause the proper changes to be made to the City of Moorpark Zoning Map. PASSED, APPROVED, AND ADOPTED THIS 6TH DAY OF FEBRUARY, 1991 Paul W.
