SUBJECT: Consider Approval of Agreement for City
Engineering Services with Charles Abbott
Associates, Inc.
Attached is a copy of the proposed agreement. It is
generally the same as the current agreement for City
Engineering services, with certain modifications, including
the following:
1. Plan and map checking, encroachment permits and
inspection services will be provided at 70 percent
rather than 75 percent of the fee deposit.
2. Section I, Paragraph H addresses the provision of
services that were initiated before commencement
of the agreement.
3 . Section III, Paragraph A was modified to include
the City's Sphere of Influence and Area of
Interest concerning the restrictions on Engineer
providing services to others.
4 . Section III, Paragraph D, E, I and L are the same
paragraphs as contained in the Building and Safety
Agreement with Abbott.
5. Section III, Paragraph M requires provision of an
office within the City limits.
6. Section III, Paragraphs P through U were added to
the agreement and are identical to the language
used in the Building and Safety Services
Agreement.

7 . Section III, Paragraphs G and H. The insurance
provision for General Liability remains at $2
Million, but coverage is reduced from $2 Million
to $1 Million for Errors and Omissions.
8 . Exhibit "A", Section A, Paragraph 1. The last
sentence was added to clarify what happens in the
event of a termination of the agreement.
9 . Exhibit "A", Section A, Paragraph 12 is added to
clarify the Engineer' s responsibility for
assisting the investigation of claims against the
City.
10. Exhibit "A" , Section A, Paragraph 13 was modified
to distinguish between legal actions for services
performed pursuant to the agreement and those
relating to city engineering matters but not
related to services performed pursuant to the
agreement.
11. Exhibit "A", Section A, Paragraphs 17, 18, 19, 20
were added to the agreement.
12 . Exhibit "A", Section B, Paragraph 10 was added to
the agreement.
If approved, services under the Agreement will officially
begin Monday, March 4 , 1991.
STAFF RECOMMENDATION
Approve agreement and authorize the Mayor to sign on behalf
of the City.
