Richards, Director of Community Development DATE: February 27, 1991 (City Council Meeting 3-6-91) SUBJECT: CONSIDER PROCESSING OF PROPOSED DEVELOPMENT AGREEMENT WITH CARLSBERG FINANCIAL FOR THE PROPERTIES CONTAINED IN THE CARLSBERG SPECIFIC PLAN BACKGROUND The City approved the Carlsberg Specific Plan on October 30, 1990 . This Specific Plan area is a 497 acre landholding situated in the southeastern portion of the city and bounded by New Los Avenue to the north, Tierra Rejada Road to the south, the 123 Freeway to the east and Spring Road to the west. The Specific Plan includes 405 residential units, 25 acres of business park use, 39 acres of sub-regional retail/commercial use, 7 acres of institutional use, 2 .5 acres of commercial restaurant use and 243 .5 acres of open space and park use. DISCUSSION The consideration and approval of any Development Agreement is regulated by Moorpark Ordinance No. 59 (see attachment) . In accordance with Section 9 . 64 . 040 Preliminary Review; no application for a Development Agreement shall be filed with the Director of Community Development unless the City Council has decided, after a preliminary review, to proceed with consideration of the proposal . This section goes on to explain that the Director must transmit a report and recommendation to the Council regarding whether or not the City should consider the proposal further. Once the Council has determined that the application has merit for further consideration, it is returned to the Director for determining that the Development Agreement is complete pursuant to Government Code Section 65940 et. seq. The Director then has the responsibility to set the matter before the Planning Commission at a public hearing. • 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 The Honorable City Council March 1, 1991 (CC meeting of 3/6/91) PROPOSED DEVELOPMENT AGREEMENT Page -2- The Commission is charged to give the Council a recommendation regarding the Agreement. On February 11, 1991 staff received a request by C.T. Financial (Carlsberg Financial) to consider entering into a Development Agreement so as to implement the recently approved Specific Plan. The request was on behalf of Simi-Moorpark Freeway Properties, Ltd. and Conejo Freeway Properties, Ltd. The request by C.T. Financial is to have the City Council refer the matter of a Development Agreement to City Staff and the Development Committee so as to discuss the outline of a proposed agreement. The purpose would be to identify potential issues for resolution prior to any drafting of a formal agreement. Inasmuch as the implementation of the Carlsberg Specific Plan may occur over a significant time period and the construction of various public works improvements need a coordinated effort; there appears to be merit in considering a Development Agreement with the current property ownership. It should be noted that the City has no established fee for processing a Development Agreement. Although C.T Financial has deposited $1,000 with the City for consideration of a development agreement; there is a need for the City to cover all it's processing costs . It is anticipated that not only will City Staff be involved with any future agreement consideration, but both the City Engineer and City Attorney's office will be involved. An additional deposit will be required of C.T. Financial prior to any further consideration by the City. It is recommended that another $4000. be deposited if the City Council proceeds with acceptance of the Development Agreement application. STAFF RECOMMENDATION 1. That the City Council determine that the proposal to consider a Development Agreement for the implementation of the Carlsberg Specific Plan has merit for further consideration, and 2 .
