SUBJECT: Consider Processing Conditional Use Permit
(CUP) for Proposed Boys and Girls Club
Facility on Casey Road
As the Council is aware, the Boys and Girls Club (Club) is
proceeding with the acquisition of the gym and approximately
1.5 acres of the Casey Road site from Moorpark Unified School
District (District).
Pursuant to the State Subdivision Map Act, the District may
convey property without the filing of a parcel map. The
Club's use of the property, however, does require approval of
a CUP by the City. It does not appear that the CUP must be
acted on by a date certain relative to the City's action to
grant and loan CDBG funds to assist with acquisition of the
site. It would be possible, however, to process and act on
the CUP prior to April 30, 1991 if the process is started at
this time. Whether or not the CDBG grant and loan are
consummated, the Club intends to complete the gym and site
acquisition, and will require a CUP to legally operate at the
Casey Road site. The Planning Commission is the decision
authority unless their decision is appealed to the Council.
As a way to further assist the Club, the City could assume
the CUP processing costs except for out -of- pocket costs of
the City Engineer, mailing and posting. The initial
application deposit is $1,256.00 and includes the Initial
Study and Negative Declaration if that is determined to be
the appropriate environmental action.

As a reminder, under recently enacted State law, the Club may
be responsible for paying a fee to the State Fish and Game.
They may be exempt because the use involves an existing
building. Staff is researching this matter.
STAFF RECOMMENDATION
Direct staff to assist the Boys and Girls Club in filing and
processing the CUP and waive City processing costs except for
out -of- pocket costs of City Engineer, mailing and posting,
and to expedite processing.
