Gilbert, Director of Public Works DATE: March 13, 1991 (Council Meeting 3-20-91) (((��\ SUBJECT: Consideration of Bids for Award of a Contract for the Construction of Handicap Access Ramps at Various Locations OVERVIEW This presents a summary of the bids received for the subject project and recommends award of a contract for said construction. This project is to be funded by Community Development Block Grant (CDBG) Funds. pISCUSSION A. Background At the meeting of February 20, the City Council authorized staff to advertise for receipt of bids for the subject project. B. Project Scope There is a need for sidewalk handicap access ramps at street corners in several areas of the City. In order to allow for flexibility in awarding a contract for the construction of these ramps, the plans and specifications provided for three levels of effort as set forth in Schedules I, II & III of the bidding documents. Schedule I sets forth the greatest number of ramps to be constructed and Schedule III calls for the least. Bid Summary On March 13 , bids were received, opened and tabulated. A summary comparison of the bids received is attached as Exhibit B. D. Recommended Schedule The Total Bid Price quoted by the apparent low bidder for Schedule I (the most extensive scope of work) , is within the funds available for the project. Staff recommends, therefore, that an award of contract be considered for the Scope of Work defined by Schedule I . E. Oualification The apparent low bidder, Double D, Joint Venture is a joint venture partnership between Blois Construction and Double D Undergroundinq. Both of these firms are experienced in the type work called for in the specifications. Inquiries made to previous employers have been favorable. The Bidder has confirmed the prices bid to be accurate and has stated his interest in proceeding with the project. F. Fiscal Impact This project is to be funded by Community Development Block Grant (CDBG) Funds. A revised cost estimate for the project is outlined as follows: Element Total Printing 190 Construction 83 ,280 Contract Administration 5,000 Inspection 5,000 Sub-total 93,470 Contingency (10%) 9,530 TOTAL 103 ,000 Handicap Ramps March 20, 1991 Page 3 RECOMMENDATION 1. Award a contract for the construction of Handicap Access Ramps to Double D, Joint Venture, in the amount of $83, 279.75. Note: The contract price is based upon the unit prices bid applied to an estimated quantity of items of work. The final contract price will be based upon the actual amount of quantities required. 225% /L 2 . Approve a ten per cent (14%) contingency for the project and authorize the City Manager to approve additional work, if required, for an amount not to exceed ten per cent ( 10%) of the contract price. 3 . Contractor shall not be excused with respect to any failure to so comply by any act or omission of the Agency, its officers, employees or agents, unless such act or omission actually prevents the Contractor from fully complying with the requirements of the Contract Documents. Each such policy of insurance shall be maintained in full force and effect for the duration of the contract and shall bear an endorsement or shall have attached a rider whereby it is provided that, in the event of expiration or proposed cancellation or amendment of the policy for any reason whatsoever, the City Clerk shall be notified by registered mail, postage prepaid, return receipt requested, not less than thirty (30) days before the expiration, cancellation or amendment is effective. 11.2 Contractor, and every subcontractor, shall provide comprehensive liability insurance in which the Agency is the named insured or is named as an additional insured. Notwithstanding any inconsistent statement in the policy or any subsequent endorsement attached thereto, the protection offered by the policy shall: (1) Insure the Agency and its officers, employees, servants and agents from claims for damages for personal injury to any person, including death, and for damage to the property of any person which may arise or result from Contractor's or any subcontractor's execution of the work or other obligation under the execution of the work or other obligation under the Contract Documents, whether such execution be by Contractor or by any subcontractor or by anyone directly or indirectly employed by either Contractor or any subcontractor. (2) Provide the minimum limits set forth in the Specifications 11.3 Contractor, and every subcontractor, shall provide complete workers' compensation insurance in accordance with the requirements of Section 3800 of the California Labor Code. If any class of employees engaged in the work is not protected under any workers' compensation law, Contractor shall provide, and shall cause each subcontractor to provide, adequate insurance for the protection not otherwise protected. Contractor shall indemnify, defend and hold harmless the Agency and its officers, employees, servants and agents from any claim resulting from failure of either Contractor or any subcontractor to take out or maintain such insurance. • "� •� • - - 12.1 If the Contractor refuses or fails to prosecute the work or any separable part thereof with such diligence as will insure its completion within the time specified or any extension thereof, or fails to complete said work within such time, or if the Contractor should be adjudged a bankrupt, or F . 13. Notice 13.1 Whenever it shall be necessary for either party to serve notice on the other respecting the contract, such notice shall be served by registered mail, postage prepaid, return receipt requested, addressed to the City of Moorpark, 799 Moorpark Avenue, California, 93021 and to the Contractor at Double D, Joint Venture P.O. Box 5191 -211 Ventura, CA 93005 unless and until different addresses may be furnished in writing by either party to the other. 13.2 Notice shall be deemed to have been served seventy -two (72) hours after the same has been deposited in the United States postal service. 14. Assignment 14.1 The Contractor shall not assign the performance of the contract, nor any part thereof, nor any monies due or to become due hereunder, without the prior written consent of the Agency. It is understood and acknowledged by the parties that the contractor is the lowest responsible bidder qualified to perform the work. 14.2 Subject to the provision of this Article regarding assignment, the contract shall be binding upon the heirs, executors, administrators, successors, and assigns of the Contractor. 15. Attorney's Fees 15.1 If any action at law or in equity, including an action for declaratory relief, is brought to enforce or interpret the provisions of the contract, the prevailing party shall be entitled to reasonable attorney's fees, court costs and necessary disbursements, in addition to any other relief to which it may be entitled. 16. Miscellaneous Provisions 16.1 Should a change be contemplated in the name or nature of the Contractor's legal entity, the Contractor shall first notify the Agency in order that proper steps may be taken to have the change reflected in the Contract Documents. 16.2 The contract shall be effective from and after the date that this Agreement is signed by the representatives of the Agency. H 17. 16.3 This Agreement is made in three (3) duplicate originals. 16.4 The captions of the articles, sections, subsections, paragraphs and subparagraphs of the Contract Documents are for reference only and are not to be construed in any way as a part of the contract. 16.5 The remedies contained in this agreement are cumulative, and in addition to and not limitation of, any remedy at law or in equity to which the City may be entitled. 16.6 The Contractor and /or Subcontractor(s) shall allow all authorized Federal, State, and /or County officials access to the work area, fiscal, payroll, materials and other relevant contract records. All relevant records must be retained for at least five years after project close -out. The Contractor shall maintain and keep books and records on a current basis, recording all transactions pertaining to this Agreement in a form in accordance with generally acceptable accounting and financial records for each funding (revenue) source in support of the project. Said books and records shall be made available to the participating city / subrecipient, County of Ventura, HUD and other appropriate officials for purposes of review and audit during the normal business hours of the Contractor. Contractor agrees to retain all pertinent records under CDBG until advised by the County, participating city or subrecipient that further retention is unnecessary. Generally, records shall be retained for a period of at least five (5) years after the expiration of the term of this agreement. If at the end of such five year period there is ongoing litigation or an audit involving the County's, participating city's or subrecipient's records, the Contractor will retain its records until the resolution of such litigation or audit and receipt of written notice directing the disposal of such written records. Entire Agreement 17.1 The Contract Documents integrate all terms and conditions in connection with the work called for herein and supersede all negotiations and prior understandings, either oral or in writing, in respect to the subject matter hereof. 17.2 The Contract Documents are intended to be complimentary. Work required by one of the Contract Documents and Specifications and not by others shall be done as if required by all. 17.3 Each and every provision of law and clause required to be inserted into the Contract Documents shall be deemed to be inserted therein, and if through mistake or otherwise any 9 • such provisions is not inserted, or is not inserted correctly, then upon application of either party, the Contract Documents shall forthwith be amended in writing to make such insertion or correction. 17.4 The Contract Documents shall not be amended except by a writing duly executed by the parties. A new Subsection is hereby added to SECTION 504 to read as ollows: "Section 504-1.5: Asphalt Work "The construction of handicap ramps shall include the removal and reconstruction of the curb and gutter. Construction of the curb shall require the removal of sufficient asphalt concrete pavement to allow for the placement of forms for the proper construction of all curbs and gutters in accordance with these specifications and the applicable Road Standards of the County of Ventura. Subsequent to the removal of the forms, the trench shall be backfilled with commercial quality concrete containing not less than 564 pounds of cement per cubic yard. Concrete backfill shall be placed to within 0.20 feet of the pavement surface. The top 0.20 feet of the trench shall be backfilled with asphalt concrete produced from commercial quality paving asphalt and aggregates. Prior to spreading asphalt concrete, paint binder shall be applied as specified in Section 302- 5.4. Spreading and compacting of asphalt concrete shall be performed by any method which will produce an asphalt concrete surfacing of uniform smoothness, texture and density.
