RICHARDS, DIRECTOR OF COMMUNITY DEVELOPMENT DATE: March 6, 1991 (CC MEETING OF 3/20/91) SUBJECT: LOT LINE ADJUSTMENT 91 -1 (ASADURIAN) Background On January 14, 1991 Manuel Asadurian filed .Lot Line Adjustment 91 -1. This request is to relocate a lot line between parcels in the northwest portion of the City of Moorpark, at 11905 Darlene Lane. The Assessor's Parcels are 511 -0- 010 -455 and 511 -0- 010 -465. Discussion This request is to relocate the common property line which separates the Applicants parcel (45), from the property owned by Morteza and Theresa Yassini (46). Currently the property line separating the two lots is located directly underneath the neighbors' ( Yassini's) garage and touching the corner of the neighbors' house. As a consequence, most of the Yassini's garage is on the Asadurian's property and the Yassini's house does not meet the setback requirements. This situation was created by an incorrect survey at the time the subdivision was laid out for construction. This Lot Line Adjustment will bring both parcels into compliance with the Zoning Code by moving the property line far enough north to create a ten foot setback from the garage (the code requires 3 feet) the new property 799 Moorpark Avenue Moorpark, Califomia 93021 (805) 529 -6864 line will be approximately 55 feet from the . Yassini's house instead of touching the corner. The nearest structure on the Asadurian's property (the house) is 220 feet from the proposed property line. No new lots are being created, and both parcels currently meet the one acre minimum size required by the underlying zoning. Both parcels will continue to meet this requirement after the Lot Line Adjustment is recorded. All required' legal documents have been reviewed and approved by the City Engineer. The Community Development Department has reviewed the request and determined that it meets all applicable Codes and standards. The Director of Community Development intends to approve the Lot Line Adjustment. Pursuant to Resolution 88 -523 the Director has the authority to approve Lot Line Adjustments. This matter is being presented to the Council as information only. In the event the Council wishes to appeal the Director's decision, it may do so. Should the Council desire to appeal, it should set a public hearing date. If the Council takes no action then the Director's decision stands.
