Richards, Director of Community April 5, 1991 (CC meeting of 4/17/91) Developmentt SUBJECT: WESTLAND COMPANY - PROPOSED DEVELOPMENT AGREEMENT Background The Westland Company proposal is to provide 285 dwelling units of which 110 are single family detached and 175 are multi - family. All dwellings are to be offered for sale as ownership units. Of the 285 units 10 of the proposed detached units and-90 of the attached units are set aside as affordable units. This project consists of the following application request; a General Plan Amendment, two (2) Tentative Tract Maps, three (3) Residential Planned Development s and a Zone Change. In conjunction with the processing of the various entitlement requests by the Westland Company, are agreements related to Affordable Housing and a proposed Development Agreement. At the City Council's regular meeting of March 6, 1991 there were a considerations towards whether or not the project should proceed through the public hearing entitlement review process prior to having the proposed Development Agreement in final form. Moorpark Ordinance No. 59, Section 9.64.040 Preliminary Review requires the City Council to determine after a preliminary review, to proceed with consideration of the proposal. This is the reason the matter appeared on the Council's March 6th agenda. At that meeting, the Council referred the matter to the Affordable Housing Committee. The Committee was to meet with the proponent to discuss the proposed Development Agreement. The Committee was charged with making a recommendation to the Council prior to the matter being sent to the Planning Commission (as required by Ordinance No. 59). 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 TO: The Honorable City Council FROM: Patrick J. Richards, Director of Community Development DATE: April 11, 1991 (CC meeting of 4/17/91 SUBJECT: WESTLAND COMPANY - PROPOSED DEVELOPMENT AGREEMENT Page 2 Discussion On march 20, 1991 the Affordable Housing Committee met with the City Attorney and Director of Community Development to discuss the proposed Development Agreement. This meeting was held without the proponent present. A review was made of the proposal regarding responsibilities of both parties and the overall timing of the _ Agreement. Staff provided background information regarding the legal and mechanical aspects of Development Agreements. The meeting concluded with the Committee requesting from staff, some suggestions to create a more equitable Agreement. The Committee, after considering what the proponent requested in the Agreement, and staff's suggestions, reached the conclusion that there was no need for the City to enter into a Development Agreement, since the Affordable Housing Agreement should be able to address the City's concerns. If a Development Agreement is subsequently determined advisable.the process could then be initiated. The Affordable Housing Committee has set April 17th as a" meeting date with the Westland Company to continue discussions related to the Affordable Housing Agreement and possible reduction in dwelling units to provide a more desirable separation from the existing residential uses to the west. Committee Recommendation The Affordable Housing Committee is recommending to the Council that they concur with the Committee's findings that the Affordable Housing Agreement should be able to address the matters of concern to the City and a Development Agreement is not needed, and that the project be allowed to proceed with it's required entitlement processing. a: \Djr\wstlnd4.17
