Gilbert, Director of Public Works DATE: April 10, 1991 (Council Meeting 4- 17 -91) SUBJECT: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING CERTAIN PROVISIONS OF CHAPTER 10.04 OF THE MOORPARK MUNICIPAL CODE PERTAINING TO PARKING • l :N; This presents for first reading an ordinance amending the Moorpark Municipal Code in order to... y (a) revise the existing language pertaining to the parking of vehicles on the street for periods in excess of seventy - two hours; (b) add language prohibiting overnight parking in commercial, industrial, manufacturing or industrial zones of the City; and, (c) revise the existing language pertaining to the parking of Commercial Vehicles in residential zones of the City. DISCUSSION A. Parking in Excess of Seventy -Two Hours Section 10.04.220 of the Moorpark Municipal Code states, in part, that: "No person ... shall park upon any street... for more than... seventy -two hours." This present wording does not set forth sufficient language to allow for the proper enforcement of this regulation. The proposed ordinance would add language to better define the violation and the means to enforce it. 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 Parking Ordinance April 17, 1991 Page 2 In recent months the City has enacted resolutions restricting parking in certain industrial zones and adjacent to certain - parks. The proposed ordinance would add Section 10.04.225 to the Municipal Code making it unlawful to park any vehicle overnight in any commercial, office, manufacturing or industrial zone of the City. C. Commercial Vehicle Parking Section 10.04.300 of the Moorpark Municipal Code sets forth certain language prohibiting the parking of commercial vehicles in residential zones. This language is conflict with recent revisions to the California Vehicle Code which changed the weight limit applicable to such restrictions to 10,000 pounds. Approve the Ordinance for first reading. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING CERTAIN PROVISIONS OF CHAPTER 10.04 OF THE MOORPARK MUNICIPAL CODE PERTAINING TO PARKING THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Section 10.04.220 of the Moorpark Municipal Code is hereby repealed and a new Section 10.04.220 is hereby adopted to read as follows: Nin_n4_220 Improper Storage on City Streets. No person who owns or has possession, custody, or control of any vehicle shall store said vehicle upon any City right -of -way or alley. 'Store' for the purpose of this section shall be any of the following: A. Parked or left standing for seventy -two (72) or more consecutive hours. B. Parked at or about the same location, but not moved at least one mile during a seventy -two (72) hour period. If during that seventy -two (72) hour period the odometer, if any, has not changed more than one mile, it will be presumed the vehicle has been stored in violation of this section." SECTION 2. Section 10.04.225 is hereby added to the Moorpark Municipal Code to read as follows: e manufacturing or industrial zongs. It shall be unlawful to park or leave standing a vehicle on any street or highway in a commercial, office, manufacturing or industrial zone, between the hours of 10:00 p.m. and 5:00 a.m." Ordinance No. Page 2 SECTION 3. Section 10.04.300 of the Moorpark Municipal Code is hereby repealed and a new Section 10.04.300 is hereby adopted to read as follows: °10.04.300 Commercial vehicles in residential -off nes. It shall be unlawful to park any commercial vehicle, having a specific manufacturer's gross weight rating of 10,000 pounds or more, on any street in a residential zone, when the parking is not connected with deliveries to an adjoining property or in connection with work being performed at the adjoining property. For the purposes of this section, "Commercial vehicle" shall mean any vehicle used or maintained for the transportation of persons for hire, compensation or profit, or any vehicle designed, used or maintained primarily for the transportation of property for hire, compensation or profit. A van pool vehicle maintained and used primarily for the nonprofit and work related transportation of adults for the purposes of ride sharing is not a commercial vehicle. SECTION 4. SEVERABILITY. If any section, subsection, sentence, clause, phrase or word of this ordinance is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed and adopted this ordinance and each and all provisions thereof, irrespective of the fact that any one or more of said provisions may be declared invalid. SECTION 5. The City Clerk is directed to certify the adoption of this ordinance and shall cause the same to be published in the manner prescribed by law. PASSED AND ADOPTED this day of Paul W.
