SUBJECT: Accepting Engineer's Report for AD84 -2 and Setting
the Public Hearing
On February 6, 1991, the City Counci ordered the preparation of an
engineer's report (to be provided tinder separate cover) for the
City's Lighting and Landscaping Maintenance Assessment District
(AD84 -2). The district was created in 1984, and assessments have
been levied each year since that Time. The City Council must
annually act to levy the assessment
The FY 91/92 proposed assessment fo a single- family level 1 home
(a home on a street with street lights) is $31.44, including $7.60
for citywide landscaping and $23.84 'or street lights. (A summary
budget is attached.) The FY 90/91 <i�;sessment for a single- family
level 1 home is $29.57, including $r 1E for landscaping and $23.41
for street lights.
The Streets and Highways Code requires a public hearing prior to
the Council's consideration of the assessment levy. The purpose of
the public hearing is to hear protests to the proposed assessment.
The next available public hearing dal-e is June 51 1991.
In prior years the Council has corsidered the assessment levy
during its review of the proposed annual budget. The detailed
budget for AD84 -2 will be presented t that time.

REPORT, FOR "MOORPARK LIGHTING AND LANDSCAPING

WHEREAS, by Resolution No. 91

CALIFORNIA, DOES R2SOLVE AS FOLLOW:
SECTION 1. The Engineer's Report for "MOORPARK LIGHTING AND
LANDSCAPING MAINTENANCE ASSESSMENT 1.,ISTRICT NO. AD -84 -2" for the fiscal
year commencing July 1, 1991 an end.ng June 30, 1992 prepared pursuant
to Resolution No. 91 -737 filed witl the City Clerk on the 15th day of
May, 1991 is hereby approved.
SECTION 2. That said EngineEi s Report may be further modified or
changed, pursuant to the provisions, f Sect -on 22630 of the Streets and
Highways Code.

A RESOLUTION OF THE C' :TY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, DECLARING ITS INTENTION TO
MAKE CERTAIN CHANGES AND TO ORDER THE ANNUAL
ASSESSMENTS FOR THE "MOORPARK LIGHTING AND
LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO.
AD -84 -2" FOR THE FISCAL YEAR COMMENCING JULY 1,
1991 AND ENDING JUNE 30, 1992 PURSUANT TO THE
LANDSCAPING AND LIGHTING ACT OF 1972; AND FIXING A
TIME AND PLACE FOR HEALING OBJFC7TIONS THERETO.
WHEREAS, pursuant to the drovisiocls of the "Landscaping and
Lighting Act of 1972 ", being Di,:rsion 15, Part 2 of the Streets and
Highways Code of the State of California, the City Council of the City
of Moorpark, by its Resolution No. 91 -737, proposed to make certain
changes to the "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE ASSESSMENT
DISTRICT NO. AD -84 -2" and to extend the improvements specified in said
district for the fiscal year comma- = °;c

WHEREAS, by said Resolution. No. 91 -i3'7, the City Council ordered
the City Manager -to cause to be � epared an Engineer's Report, pursuant
to Article 4, Chapter 1, Part 15 of said Streets and
Highways Code; and
WHEREAS, the Engineer's Repoi was prepared and filed, and the same
was approved by the City Counci c,r the 15th day of May, 1991, by
Resolution No. 91-757f-
NOW, THEREFORE, THE CITY 'OUNC_:L OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOF :
SECTION 1. That the public - terest and convenience require and it
is the intention of the City Cou::ci1 of the City Of Moorpark to make
certain changes to the "Moorpark sighting and Landscaping Maintenance
Assessment District No. AD -84 -2 to order extension of the annual
assessments for said district fc>. the fiscal year commencing July 1,
1991 and ending June 30, 1992. Sid "MOORPARK LIGHTING AND LANDSCAPING
MAINTENANCE ASSESSMENT DISTRICT N( ADS -84 -2" consists of a single city-
wide zone to provide electric ._-rent or energy for public lighting
within the City, to provide for l-stallation or maintenance landscaping
and the construction or maintenance of curb, gutter, or sidewalk
structures and facilities, to inst.11 or construct facilities, which are
appurtenant to any of the foregoin for the maintenance or servicing or
both, of any of the foregoinc, Provide incidental expenses in
connection therewith.
SECTION 2. That sa:..d ighting and landscape maintenance
assessment district. shall specifically include the lighting and
landscape sites with all improvements Located therein, described by and
heretofore included within "P: =)ORPARK I_'1GHTING AND LANDSCAPING
MAINTENANCE ASSESSMENT DISTRICT N1`1 AD -84 "
SECTION 3. That the farec, ing described work is to be located
within said Assessment District the boundary of which is more
particularly described on a map cr: Eile in the City Clerk's office, and
entitled "Boundary Map, City cf Moorpark Lighting and Landscaping
Maintenance Assessment District N"D AI- 84 -2', filed in the office of the
City Clerk on the 15th of May, _9,)
SECTION 4. Reference is he: -( v made lo the report of the Engineer
on file with the City Clerk ai,d open to inspection, for a full and
detailed description of the Improvements, the boundaries, of the
Assessment District and any zones therein, and the proposed assessments
upon assessable lots and parcels Df Land within the District.
SECTION 5. Notice is :hereby given that on the 5th day of June,
1991, at the hour of 7:00 p.m.., ...n the Council Chambers of the City Hall
of said City, located at 799 Moorpark Avenue, Moorpark, any and all
persons having any objections t the work or extent of the assessment
district may appear and show cause why said work should not be done or
carried out or why said district should not be extended for the fiscal
year commencing July 1, 1991 and ending June 30, 1992. Protests must be
in writing, and must be filed by the property owner with the City Clerk
prior to the conclusion of the hearing and such protest shall state all
grounds of the objection and sh 1.1 �ontc-ain a description sufficient to
identify the property.
SECTION 6. All the wor-s, herein proposed shall be done in
accordance with the Landscaping and Lighting Act of 1972, being Part 2
of Division 15 of the Street and Highways Code of the State of
California.
SECTION 7. The City Clerk shall cause notice of the hearing to be
given by causing the Resolution f Intention to be published and mailed
in the manner required by Part 2 of C, ,_vision 15 of the Streets and
Highways Code.
SECTION 8. The City C1e2 s sha l l c(�rtify to the adoption of this
resolution.
