A Regular Meeting of the City Council of the City of Moorpark was
held on June 5, 1991 in the Council Chambers of said City located

1. CALL TO ORDER:
Mayor Lawrason called the meeting to order at 7:32 p.m.
2. PLEDGE OF ALLEGIANCE:
The Pledge of Allegiance was led by Deputy Bill Gentry.

6. PUBLIC COMMENT:
Linda Plaks, 4957 Mira Sol, spoke representing the
Chamber of Commerce. She requested the Council's
consideration of the Chamber "s funding request for the
July 3rd Celebration.
Mike Smith, 195 West Lo, Angeles Avenue, addressed the
Council regarding his °oncerns with the residential
haulers refuse contract., fie listed his concerns as the
maximum rate charge, sajing there should be allowances
for heavy containers; Sc—tion C -2 concerning recycling;
and donated services.
Cathy Clevenger, 533 N. ,pring Rd., #24, stated that she
was concerned about tho traffic light timing on Los
Angeles Avenue and Spr:ii -q Road which creates an unsafe
condition for children crossing. She submitted a
petition to the City coy_, ic, i _ .
In response to Councilmc-mber Wozniak, Mr. Gilbert said
that Caltrans said thE, p, oblem ,3t the crosswalk needs to
be solved by enforcement
Councilmember Montgomery said that there are a large row
of bushes that perhaps cc .i.ld be taken out by the owner of
the property to alleviat the situation. He suggested
more signage in the area
CONSENSUS: By consensus t :he Council determined to refer
the matter to the Transy rta.tion Committee.

Gerald Bridgeman, 78 W cks Road, spoke regarding an
appeal made by the Co+_ncil ff a Planning Commission
decision on his parcel q.
Connie Lawrason 4291:Amh,ermeadow, said that the monument
signs in front of City X11 and the Civic Center looked
"great".
George Shakiban, 6047 Tampa Avenue, #202, Tarzana, asked
that the Council consider extending the hours of
operation for his businoss in Varsity Park Plaza until
1:00 a.m. rather tha 1 00 midnight.
COMMITTEE REPORTS:
Councilmember Wozniak said he attended the County
committee on the Santa Rosa Valley. He said he was
preparing a report for "tie Council.

Councilmember Wozniak asked for the minutes to be
amended on Page 5, Item 11.J. "Councilmember

Perez seconded a motior to approve the Minutes of the
Adjourned City Council Meeting of May 22, 1991 as

MOTION: Councilmember Jozriiak moved and Councilmember
Montgomery seconded a m -tion to approve Resolution No.
91 -765 authorizing the ;::losure of City Hall on July 5,
1991 and to continue discussion of the Council meeting
dates for July at the Ad )urned meeting of June 12, 1991.
The motion carried by inimous ✓oice vote.
H. Consider PD 897 Miner Modification No. 3 Request to
Modify the Approved for Varsity Park Center
(Shakiban). Staf` Recommendation: Receive and
file the report.
In response to Cou:i,_- ilmember Wozniak, Mr. Richards
clarified that the yours listed in the staff report
were hours of oper tiorc and that the 5:00 a.m. to
12:00 a.m. hours ere determined because of the
proximity of a res lent�a urea.
MOTION: Councilmember ozriiak moved and Councilmember
Montgomery seconded a motion to approve the staff
recommendation to rece .re and file the report. The

O. Consider Waste _.Reduction/ Purchasing Guidelines.
Staff Recommendation: Approve waste reduction and
purchasing guideli es.
Mr. Kueny clarifie i that the staff recommendation
was listed on the staff report and was to refer the
Purchasing and Waste Reduction Guidelines to the
Public Works and Fa ilit.ies Committee with a report
and recommendation to the full Council prior to
adoption of the 1.9;1/92 Budget.
MOTION: Councilmember M +,ntgomery moved and Councilmember
Talley seconded a m;.tion to approve the staff
recommendation to ref,•r the Purchasing and Waste
Reduction Guidelines to the Public Works and Facilities
Committee with a report: and recommendation to the full
Council prior to adapt; )n of the 1991/92 Budget. The
motion carried by unani,:,ls voice vote.
9• PUBLIC HEARINGS:
A. Consider Proposed _Amendments to the City's Home
Occupation Permit _Process to Include a Five -Year
Permit Duration__ and a Processing Fee. Staff
Recommendation: ',itroduce for first reading the
proposed Ordinance L41 and that the Council set a
Public Hearing ft June 19, 1991 to amend the
City's fee sched,a (continued Item 9.A. from
5/15/91).
Councilmember Mont(.,omery said that as he operated a
home based busines, ;, fte would not participate in
the discussion nor vote on the item. He left the
dais.

Perez seconded a motior to read the ordinance by title
only. The motion °arried by voice vote 4 -0,
Councilmember Montgomer absent for the vote..

E. Consider Proposed Assessments for "Moorpark Lighting and
Landscaping Maintenance ... Assessment District No. AD -84 -2"
for the Fiscal Year Commencing July 1 1991 and Ending
June 30, 1992 and Consider Resolution No. 91- a
Resolution Confirming „the Assessment for Fiscal Year
1991/92. Staff Recommendation: Open public hearing and
defer action on ass(;sment until City budget is
considered.
Mr. Kueny gave the staff report regarding a change in the
scope of maintenance fo Assessment District Zone No. 2
to include the maintenance of the entry monument signs
and a boundary adjustm( t ffor Assessment District Zone
No. 4.
CONSENSUS: By consensus t} „_, Council determined there was
general concurrence with tr, .hanges outlined by the City
Manager.

Talley seconded a motion to continue the item to the City

Mayor Lawrason said that he would be working with the City
Manager to expedite the meet i q process and shorten the length
of the meetings.

C. Consider Awardinq Fou,_ Commercial Refuse Franchises.
Staff Recommendation: Award four commercial refuse
franchises to G. I. R bbish, Moorpark Disposal, E. J.
Harrison and Sons, and Rubbish Control, Inc.
Ms. Cauldwell gave the staff report. She said that the
concerns expressed by dike Smith of G.I. Rubbish were
workable and should no' hold lip the agreement.
Ms. Cauldwell said the °-iaulers would like to go back to
the customer and recotgaE) some of the dumping costs of
overloaded or improperl loided bins, boxes or roll -offs.
Mr. Kueny said that he recommended allowing the Budget
and Finance Committee t work with the four permittees to
work out language rega.ilinq the extra dumping costs as
reported above. He sai I this would be another category
of service. He saic: another point of review and
determination by the Bu.lget, and Finance Committee could
be to address the dc�na ed ser rices item raised by Mr.
Smith.
MOTION: Councilmember Wozni,k moved and Councilmember Perez
seconded a motion to approve the staff recommendation to
award four commercial re.fus- franchises to G. I. Rubbish,
Moorpark Disposal, E. J. EGirrison and Sons, and Rubbish
Control, Inc. and to direct 'he Budget and Finance Committee
to meet with the four perm,;_tt.E.e„ to "work out" the language on
those items recommended by tic:, Cit::y Manager above; and to
delete C of Section 17 front * igreement. The motion carried
by unanimous voice vote.
B. Consider Authorization 7.o Advertise for Receipt of Bids
for the Construction of ,� Landscaped Barrier on Williams
Ranch Road. Staff Recommendation: Approve plans and
specifications and authorize staff to advertise for

D. Consider Cinco de Mayo Report. Staff Recommendation:
Direct staff as deemed api:,ropriate.
The Council discussed their des ire to have a meeting with
the Parks & Recreation Cc`mmi: ;sion as to what is in the
purview of the Commission to do and where their
responsibility ends. Tte council determined that a
similar meeting with the 1? Lanni ,iq Commission would be
desirable.
Councilmember Montgomery ;aid he would request an agenda
item to remove Lynn µockatt from the Parks and
Recreation Commission.
MOTION: Councilmember Montgomery moved and Councilmember
Perez seconded a motion to direct the Mayor to send a letter
to both the Ventura County Grind Jury and District Attorney
requesting their review of the Cinco de Mayo event and the
staff investigation of the event; to deny the request for
reimbursement for the payment of the Turtle and Clown from
Entertainment Express. The me ion ::- arried by unanimous voice
vote.
Mr. Kueny clarified that Teresa Godinez, who requested
reimbursement for the h_ring of the Clown and Turtle
characters for the Cinc.;:: de Mayo event, had stopped
payment on her personal :,heck and there was a warrant
among those approved b the Council tonight to pay
Entertainment Express d rectly. He said the Council
would have to take act on to rescind their previous
action and deny payment Dn Warrant No. 15390, in the
amount of $960.
MOTION: Councilmember Montgomery moved and Councilmember
Talley seconded a motion to reconsider Item 8.B. The motion
carried by unanimous voice o,c..e
MOTION: Councilmember Montgomery moved and Councilmember
Talley seconded a motion to approve the Warrant Register with
the exception of Warrant No. 5390, in the amount of $960, to

E. Receive Report on the Jkily 3rd Celebration and Request
for Funding Assistance. Staff Recommendation: Direct
staff as deemed appropr -ite
Mr. Hare gave the staff report.
In response to Council q..estion, Lt. Rodriguez said that
the police will not hand e the parking it will be handled
by Chamber. of Commerce 71unteers.

F. Consider Urban Forestry_ Grant Program Under the
California Wildlife Coastal and Park Land Conservation
Bond Act of 1988 and President Bush's 1990 America the
Beautiful. Staff Recorendation: Authorize staff to
apply for grant funds..
Mr. Newhouse gave the s aff report. He said the sites
requested for planting al)proval were listed in the staff
report as follows:
1. East side of Spriri�f Road between Charles and Los
Angeles Avenue at high Street (4 trees);
2. South side of Campu Park [)rive between Penn Street
and Happy Camp (16O trees);
3. North half of Princeton Avenue between Hwy. 118 and
Campus Park Drive 100 trees)
4. West side of Spr ng Road, south of Bridge to
Christian Barrett .200 trees);
5. East side of Peac~ Hill. Road north of park to
corner (36 trees);
6. North side of Posndexter Avenue from Chaparral

MOTION: Mayor Lawrason mov,:!d and Councilmember Montgomery
seconded a motion to approve t he staff recommendation to adopt
Resolution No. 91 -767 authorizing application for funds under
the Urban Forestry Grant Proq ram for City wide tree planting
and to approve the sites as fisted above. The motion carried
by unanimous voice vote.
G. Consider Change in Zon_na Code Ordinance for Parkin

At the Mayor's request, Colin Velasquez addressed
the Council. He s,,id he was not aware that a body
shop was prohibiitel for his project. He referred
to conversations �,i.th former Councilmembers Brown
and Harper while trey were on the Council. He said
they both indicate that a body shop was "OK ". He
said he felt there eras selective enforcement within
the City and said le eras referring to Pete's Auto
Body. Mr. VelasgLa,�z �,lsc said that Senior Planner

for his project

The owners' -)peration at this time, from a
land use standpoint and a health standpoint,

oil wastes be allowed at the Simi Valley Landfill.
She said she opposed dumping oil wastes at the site
because most of the material would pass through
Moorpark on its ay from the western end of the
County.

F. Authorization to Submit Contract Application to
Public Employees Retirement System
Mr. Fritz gave t.r�.e staff report, stating that
before a contr_a(.t with the Public Employees
Retirement System iPERS) can be entered into, PERS
will conduct an actuarial study to compute the
required City contributions. He said it was
staff's recommendation to authorize the City
Manager to submit the required questionnaire to the
Public Employees Retirement system so the actuarial
study could be comi,; let:.ed .
MOTION: Councilmember Harper moved and Councilmember
Straughan seconded a mot:. i.on to authorize the City Manager
to submit the "Quests nnaire for New Agency" to the
Public Employees Ret.irerient System. The motion carried

G. Assignment of Funac _ to _County
Mr. Fritz gave the staff presentation. He said the
City will receive "unds from the State, authorized
by the Transportat..on Development Act and the State
Transit Assistance, Act, for transit and road
maintenance purposes. He said the apportionments
for fiscal 1983 --f4 total $147,648 of which the
County has used ;6,04,000 for bus service between
Moorpark and the cities of Simi Valley and Thousand
Oaks, and the emaining $83,000 for street
maintenance. Ile said the Fiscal Analysis for
incorporation of Mc:)orpark did not assume that these
funds would be av,ilable to the City during the
first year of incorporation and the availability to
the County during lh.i..s first year of incorporation
had been assumed, :he C ".o�)nty requests the Council

Waterworks Dist.ri-t No. 1, and Robert Braitman,
Executive Officer of LAFCO. He said it was
concluded that tie County Public Works Agency
should prepare the background studies necessary to
have an application for the division of the
District come befi re LAFCO.

a letter to the Board c Supervisors requesting that the

Mr. Fritz said Pz,.:ifaca Corporation (Appeal 148)
and the Council Appeal 149) are appealing the
Ventura County P1,inning Director's approval of a
Minor Modification to PD -851. The modification is
being appealed by one of the project developers,
the Pacifica Corp. The subject modification was to
allow the substitution of four new models to
replace the prese:�itl� approved six dwelling unit
models of the p-rmit., On June 6, 1983, the
Planning Director - ipp:roved the Minor Modification.
However, since he approval letter did not
specifically statE that the approval related to the
elevations, color;, and materials, the Pacifica
Corporation has appealed the County Planning
Director's appro,r{]_ The Council appealed the
