One June 5, 1991, a public hearing was conducted to receive protests to the proposed assessments. One person protested the proposed parks assessment. To date, no written protests have been received. The public hearing is ;,till open. The attached resolutions must be approved no later than June 30, 1991 in order for the assessments to be levied. In prior years the City Council has adopted the -F�!solut:i.ons concurrent with the adoption of the budget. Staff Recommendations 1. Close the public hearirras for AD84 -2 and AD85 -1. 2. Adopt Resolution 91 - making certain changes to AD84 - 2 and confirming the assessments for FY91/92. 3. AD- 85 -1 ": AND CONFIRMING THE ASSESSMENT FOR SAID DISTI <:ICT FOR THE FISCAL YEAR COMMENCING JULY 1, 1991.1,1D ENDING JUNE 30, 1992 WHEREAS, the City Counci: of the City of Moorpark, by Resolution No. 91 -760, adopted May 15, 1991, declared its intention to make certain changes to the "Moorpark Parks Maintenance Assessment Distri(:-t No. AD- 85 -111, and to order the extension of the annual assessments for said district for the fiscal year commencing ,;ru, L. 1991. and ending June 30, 1992; and WHEREAS, said "Moorpark narks Maintenance Assessment District No. AD -85 -1" consists Df a single city -wide zone and improvement of parks and recreation facilities within the City; and WHEREAS, on June 3, 1991, ,-..he City Council held a public hearing to determine whether :;aid changes to said district should be made, and whether thca annual assessments should be ordered and confirmed for the r iscal year commencing July 1, 1991 and ending June 30, 1992, and WHEREAS, at said hearing ra.:, written protests to proposed changes to, and to the annua assessments proposed to be levied for, said Assessment District. No. AD -85 -1 were received by the City Council..; -nd WHEREAS, the City Coun, it determined that it had authority to proceed with the changes to and extension of annual assessments for the fi :cal. year commencing July 1, 1991 and ending June 30, 1992 NOW, THEREFORE, THE CI Y COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RE!'1LVE AS FOLLOWS: SECTION l: The report of the Engineer, as filed on May 15, 1991 is hereby apl)r -oved and adopted, and the improvements, changes to, and extension of the annual assessments in the Assessment ,District, in accordance with said report and in accordanc+ wi-th Resolution No. 91 -759 approving the Engineer's Re}_c::)rt, and an assessment, in accordance with said report i hereb,r levied for the fiscal year 1991 -92.. assessments in the Assessment District, in accordance with said report and in accordance with Resolution No. 91 -757 approving the Engineer's Report, and an assessment, in accordance with said report, is hereby levied for the fiscal year 1991/92. SECTION 2: The City C erk shall cause the diagram and assessment, or a certified t espy thereof, to be filed with the County Auditor. SECTION 3: The City adoption of this resolution.
