Newhouse, Director of Community ServicesPT\ DATE : June 11, 1991 SUBJECT : Consider Termination of Arroyo Vista Community Park Lease Agreement with the Fedelety Corporation BACKGROUND At your March 6, 1991 meeting, Council approved partial termination of the Arroyo Vista Community Park Lease Agreement with the Fedelety Corporation to retake possession of approximately ten (10) acres running along the western boundary of the future site of Arroyo Vista Community Park. AGREEMENT The original term of the Lease Agreement is for two years commencing January 1, 1990 and ending December 30, 1991 . Provided the lease has not been terminated, and provided further that Tenant shall not be in default of any provisions of this lease, the lease shall automatically renew, not more than three (3) times, for three (3) successive terms of one (1) year each. RIGHT TO TERMINATE Paragraph 39 of the current Lease Agreement, "Right to Terminate in Whole or Part, " grants to the City the right to terminate the current lease agreement and retake possession of the entire premises or any portion thereof, at any time after the original term of this lease . City shall exercise this right by providing tenant with notice of such termination at least six months prior to the date of any such retaking. PAUL W. LAWRASON JR. BERNARDO M. WOZNIAK Mayor Mayor Pro Tern Councilmember Councilmember Councilmember DISCUSSION By retaking possession of ten (10) acres of the future park site, the City has positioned themselves to be able to receive approximately 60, 000 cubic yards of dirt being excavated from the development of the access road to the park . The dirt will be used for a pad for the future Community Center building to be constructed at the park site . With construction of the Community Center building, additional open space (turf) is anticipated to be developed for such community uses as soccer, softball/baseball, and general community use. To accomplish the development of the park for community use, the City may want to consider termination of the Lease Agreement with the Fedelety Corporation. STAFF RECOMMENDATION Consider termination of the Arroyo Vista Community Park Lease Agreement with the Fedelety Corporation effective December 31, 1991 . PEN :db
