Richards, Dirtsctar of Community Development DATE: July 10, 1991 (CC Meetintl of 7- 17 -91) SUBJECT: UNOCAL CERTIFICATE OF COMPLIANCE APPLICATION (SIMI ALAMOS CANYON PROPERTY) Background The County of Ventura has received an application from Unocal for a Certificate of Compliance (No. 91 04 -343) on a discrete parcel of land predominantly located in the unincorporated portion of the County, with a portion lying in both the City of Moorpark and in the City of Simi Valley. The requested Certificate, therefore, requires the approval signatures of all three local agencies. The County has forwarded the Unocal C`c-tificate of Compliance to the City of Moorpark and has requested , he signature of the Director of Community Development. Discussion A letter of explanation from the i:ounty regarding the requested Certificate of Compliance is attached. The County has determined that the subject lot was created legally by Parcel Map Waiver No. 92, recorded August 20, 1982. The t'ounty has also identified that Unocal is requesting a Certificate I Compliance because they want to sell the subject lot. Pursuant to Section 66499.35(a) of the Subdivision Map Act, any person owning real property meiy request a local agency determination whether the real property complies with the provisions of the Map Act or the local subdivision ordinance. Under Section 66499.35(a), it is mandatory that the local agency issue a certificate of compliance u)on making the determination. A copy of the County of Ventura Certificate of Compliance and a legal description of the Unocal property is attached. The Director Of Community Development has rev:iewt)d the County's Certificate of Compliance and intends to approvt it. This matter is being presented to the City Council as courtE>Sy. The next available meeting date would be the Council's regular meeting of August 7, 1991. if the Council takes no action, then the Director's decision stands Recommendation 1. Authorize Community Development Director to approve the requested Unocal Certificate of Compliance. 2. Direct the Community Development Department to collect a fee from Unocal to pay for all City processing costs related to the requested Certificate of Compliance prior to approval. The lot has eighteen separate assessor parcel numbers which are listed in the Certificate of Complianc(,- N but were established for tax assessment purposes only. It is our understanding that Uno� -ai wishes to sell the lot, and therefore submitted an application to the County for a Certificate of Compliance under Government ;ode Section 66499.35(a). The County has determined that the 1:)t is one of three lots legally created by Parcel Map Waiver No 92, recorded August 20, 1982, Document No. 077484. The original parcel (Strathearn Ranch) was legally created on or before Aptil 17, 1930. Subsequent legal divisions occurred by sale to 4overnment agencies and public utilities (such as water distrlr, -t, college district, Southern California Edison and Southern Pacific: Railroad), tract maps, division along Simi Freeway by condemnation to the State, and lastly, the Parcel Map Waiver. The County has prepared the Certi�icate, and our process requires a signature from each of the three affected jurisdictions. I mailed a transmittal letter to yot.. on May 24, 1991 requesting your signature on the Certificate of C {7mplianc.e.
