Richards, Director of Community Development J DATE: August 14, 1991 (CC meeting of 8/7/91) SUBJECT: ABATEMENT OF UNREINFORCED MASONRY BUILDINGS, STATUS REPORT Background Unreinforced masonry buildings have proved to be hazardous be- cause of the severe damage that they tend to sustain in earthquakes. California Senate Bill 547 required the City to adopt a program to mitigate this hazard. on August 1, 1990 the City Council adopted Ordinance Number 127 requiring structural upgrade of unreinforced masonry buildings . Council directed staff to report to Council periodically during the implementation of this ordinance. In accordance with ordinance 127, staff notified the owners of seven identified buildings to submit plans and engineering for the repair of their buildings within 270 days . Notices were sent on September 28, 1990 and the 270-day limit has now elapsed. The status of repair activity is as follows : 1 . One building owner has successfully obtained a building permit for the work of upgrading the building. Work has not yet begun. 2 . Two owners have submitted plans and engineering and completed the plan check process. Permits are ready for issuance. 3 . Two building owners have submitted to plan review and are in the process. Two owners have not applied for permits and are in violation of Ordinance 127 . These buildings include a store-front commercial building and a church. On July 31 , 1991 the owners of the commercial building indicated that they intend to submit plans by the date of this meeting. The owners of the church have indicated that their financial condition precludes making the required repairs and that they are considering closing. Alternatives 1 . If Council takes no action then Ordinance 127 requires that the Building Official order that the buildings which are in violation of the ordinance be vacated. If compliance with the ordinance is not achieved within ninety days after the order to vacate then the ordinance requires that the buildings be demolished in accordance with the Uniform Code for the Abatement of Dangerous Buildings and other applicable laws. 2 . Council may refer the matter to the Community Development Committee for further study. Council may direct the Committee to meet with the owners to better understand the problems associated with URM upgrades. Council may direct staff to provide the owners with the most current list of available sources of finan- cial assistance provided by The Seismic Safety Commission. Recommendation Direct staff as deemed appropriate.
