Richards, Director of Community Development J` DATE: July 30, 1991 (CC Meeting of 8- ,F -91) SUBJECT: PRELIMINARY COMMENTS ON COUNTY OF VENTURA CONDITIONAL USE PERMIT APPLICATION NO. 4708 TO ALLOW BORROW SITE FOR CALTRANS HIGHWAY 23 & HIGHWAY 118 FREEWAY GAP CLOSURE PROJECT Background The City of Moorpark h Ventura for project Application No. 4708. excavation and export o to be transported by Highway 23 /Highway 118 borrow site location is review comments are du 9, 1991. Discussion as received a request from the County of review of Conditional Use Permit (CUP) The project proposal is a borrow site for I approximately 200,000 cubic yards of earth a new haul :road and used for the Caltrans direct connector project. Our preliminary e to the Courty Planning Division by August Staff has several concerns related to the proposed borrow site project and does intend to submit comments to the County. The Proposed borrow site was not considered in the Environmental Impact Statement (EIS) prepared for the Highway 23 and Highway 118 Freeway Gap Closure Project. In fact, that EIS identifies that the highway project would result in surplus excavation of 25,000 cubic yards. Following are staff's preliminary comments on the borrow site proposal: If the borrow site is required for the Highway 23 /Highway 118 connector project, then a Reevaluation of the EIS should be required. If significant impacts will_ result from the borrow site, then a Supplement EIS should be prepared. As defined by Section 15378 of CEQA, "Project, means the whole of an action, which has a potential for resLlting .in a physical change in the environment, directly or iltimately...° If the borrow site is required to allow construction of the Highway 23 /Highway 118 direct connector project, then the impacts from the borrow site should be analyzed in relation t:o the overall cumulative impacts of the higlhiay construction project. A tree report, a biological study, a cultural resources survey /report, a paleontology study, a drainage study, and a visual impact analysis study should be completed prior to determining the CUP application complete, or the applicant should be required to provide this information in a Supplemental EIS. The visual study should analyze impacts to viewers traveling on major transportation corridors such as Los Angeles Avenue and future Highway 118 as well as impacts to residential areas in the City of Moorpark that will view the borrow site. The applicant should be requited to clarify the future plans for the eight -acre, level site after borrow operations are completed. Does the borrow site need to be graded level? A draft reclamation plan should I)e required prior to determining the application complete. The applicant should be required to obtain a right of entry across the private property located west of the proposed borrow site. The applicant should be required to clarify the proposed hours of operation for the borrow activities. The applicant should be required to estimate the time of year when the grading activities at the borrow site are expected to occur (we note that an attachment to the application identifies that the work is expected to last four to five weeks and that 8,000 to 10,000 cubic yards would be moved per day). If work is proposed during the rainy season, then an erosion control plan should bF required.. The applicant should be required to clarify where trucks and grading equipment will be stored and serviced. We recommend that storage and servicing of vehicles not occur onsite. Staff is requesting that the L:ity Council review staff's preliminary comments and determine whether the Council has any additional concerns or whether any of staff's comments should be modified. Staff's intention is to incorporate all of the City. Council's concerns into a letter which will be sent to the County by August 9, 1991. The Honorable City Council July 30, 1991 Page 3 Recommendation Direct staff to prepare a comment letter to the County which incorporates staff's preliminary comments and any recommended revisions or additional comments proposed by the City Council.
