DATE: August 16, 1991 C SUBJECT: CONSIDER ASSESSMENT OVERPAYMENT REFUND FOR WILLIAM & CHARLENE OWENS BACKGROUND 3ORPARK, CALIFORNIA City Councll Meeting Approximately 850 park and lighting assessment district refund checks were mailed late last summer to property owners who were overcharged on their FY 89/90 tax bills. Eight property owners were not located. Staff published notice in the Moorpark News - Mirror on Thursday, January 1, 1991, in an attempt to locate the property owners and provided 60 days for a response to the notice. Two property owners responded to the notice. Six refunds were not claimed for a total of $340.72. At the City Council meeting of July 17, 1991, staff was directed to retain the outstanding refunds in the appropriate assessment district. On August 6, 1991, Charlene Owens called the City in response to the notice and requested a refund of the overpayment paid by her and her husband. Her request was late therefore it was submitted to the Budget and Finance Committee for review. There was a $13.54 overpayment of the parks assessment and a $2.95 underpayment of the lighting assessment resulting in a net $10.59 refund owed to Mr. and Mrs. Owens. The Committee reviewed the request and concluded that the deadline should be waived in this case and that the refund of $10.59 should be paid. If this refund is paid, there world be five unclaimed refunds totalling $330.13 which have beer r(�tained in the appropriate assessment district.
