SUBJECT: REVIEW OF FINAL DRAFT OF AFFORDABLE HOUSING AGREEMENT FOR
WESTLAND RESIDENTIAL PROJECT (GPA -90 -1; Z -90 -2; TR -4726;
TR -4738; RPD'S 90 -2„ 90-3, AND 90 -4)
Discussion
On August 28, 1991, staff transmitted comments to the Westland
Company on the latest draft of the Affordable Housing Agreement for
the above referenced project. Glenn Hartman of the Westland
Company has indicated that a final draft of the Affordable Housing
Agreement will be provided for City Council review prior to your
September 4 meeting. A copy of the final draft will either be
provided with your packet, or we gill make a special delivery prior
to September 4.
If the Council determines that the final draft of the Agreement is
acceptable, one option would be to direct the Mayor to sign the
agreement prior to the September 18 meeting. Another option would
be to delay the signing of the Affordable Housing Agreement until
after the Council has had more time to review the final draft of
that Agreement as well as review the final draft of the Resale
Restriction Agreement. We expect to be able to transmit a copy of
the Resale Restriction Agreement. for the affordable units in the
Westland project to the Council prior to September 18. The Resale
Restriction Agreement will be signed by the buyers of the
affordable units and the City,. Final approval of the Resale
Restriction Agreement is not required prior to approval of the
Affordable Housing Agreement, nc)r is it: required prior to taking
final action on the Zone Ordinan ,,e for the Westland project.
Regardless of whether or not th, -? Council decides to approve the
Affordable Housing Agreement c)n September 4 or delays approval
until after the Resale Restricti >n Agreement is completed, second
reading of the Zone Ordinance fo:: the Westland project should not
occur until after the Affordab].� Housing Agreement is actually

Recommendation
1. Review Final Draft of Affordable Housing Agreement for
Westland Residential Project and direct Mayor to sign the
Final Agreement prior to ,September 18, 1991.
2. Direct staff to transmit a copy of the final draft of the
Resale Restriction Agreement to the City Council prior to the
September 18 Council meetinq.
3. Direct staff to schedule she second reading of the Zone
Ordinance for the Westland Fesident.,ial Project for September
18, 1991.
