(DA- 91- 1) -ABE GUNY Background: Please refer to the attached memorandum dated July 291 1991 (see Exhibit 1) regarding the Residential Development Evaluation Board meeting (Planning Commission) and pudic hearing on August 5, 1991. The applicant is requesting 18 development allotments from the 1991 year. There is a related item on the 9 -18 -91 City Council agenda in which the applicant is requesti_r-1 surplus (1987 and 1988) development allotments. Discussion: The point rating recommended by the Residential Development Management Board is consistent with Resolutions 87 -421 (see Attachment 1) and 88 -522 (see Attachment 27. The application filed (DA -91 -1) is for 18 allotments to allow development of City Council approved ''Tact No. 4652 ( Guny) approved by the City Council on May 15, 1991 During the course of the public hearing on September 18, 1991, the City Council shall receive testimony concerning its tentative point rating for Tract 4652. At the publi hearing the applicant, Abe Guny, has the opportunity to request that the City Council re- evaluate the point assignment recommended by the Residential Development Evaluation Board (RDEB) . 'Phe City Council has the final authority to grant the development a locations to be awarded. Since no applications for developmen, allotments were received in 1989 and 1990, there is currently :, surplus of 540 allocations available for those years as well as 270 allocations available for the current ( 1991) year. Council may :grant the applicant 18 surplus development allotments and still. N abiding by the requirements specified in Measure F. E Y JR JOHN E RESOLUTION NO.9.- A RESOLUTION OF THE MOORPARK CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AWARDING DEVELOPMENT ALLOTMENTS FOR 1991 TO TRACT MAP NO. 4652, ABE GUNY (DA 91 -1) (API`''s 511. - 110 -35; 511 -020 -025; 511- 020 -035; 500 - 260 -05; 500 - 270 -06) WHEREAS, Measure F, an initiative ordinance establishing a residential development management system, was approved by the residents of the City of Mo(:rpark �',n November 4, 1986; and WHEREAS, on September 23, X987, uhe City Council adopted Resolution No. 87 -421, an implementation resolution setting forth the process and procedures for issuance of residential building permits under Measx..r-e F, and WHEREAS, on November 16, 1988, the City Council amended said Residential. Development Mana;,ement System ( Resolution No. 88- 522); and WHEREAS, pursuant to Measurt 1', after a duly noticed public hearing, the Residential Development Evaluation Board concluded its review of the c,'.ly project requesting allotments for the 199.1 cycle, at _Lt's meeting of August 5, 1991, and forwarded its recommendata,x to the City Council; and WHEREAS, on September 18, 1 9i the City Council held a duly noticed public hearing at which time it considered the recommendations of the Boar:i and heard testimony from the applicant for development: 1,c,t.ment.s and other interested persons; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE, DECLARE DETERMINE AND ORDER AS FOLLOWS: SECTION 1. (RDEB Me(�ting of 8 -5 -91) SUBJECT: RESIDENTIAL DEVELOPMEm,MAHAGEMENT SYSTEM 1991 (DA -91 -1) Background On July 15, 1991, the Residential Development Evaluation Board reviewed Application No. DA -91 1 filed by Abe Guny for 18 allotments to allow development. of Tract No. 4652. At that meeting, the Board made a determin it.ion regarding recommended point assignment for DA -91 -1 and directei staff to post the Board's point assignment listing consistent wi.h Resolution No. 87 -421 (which sets forth the procesFy and procei ures 1,:)r- the City's Residential Development Management System).. Resolution No. 87 -421 requires t %at the Residential Development Evaluation Board shall hold a public hearing on development allotments requests at least 15 da•vs following the required posting of the Board's recommended point assignment and ranking. The Board's recommended point assignm4,,jt [Cr ")A -91 -1 was posted on July 18, 1991 (see attached copy). Discussion The August 5 public hearing for DA -91 -1 has been scheduled to comply with Resolution No. 87 -421. The purpose of the public hearing is to receive testimony concerning the Board's tentative point rating. As discussed at the Board's July 15 meeting, a total of 810 allocations are available and only 18 have been requested.
