Richards, Director of Community Development DATE: September 13, 1991 (CC Meeting of 9- 18 -91) SUBJECT: APPROVAL OF AFFORDABLE HOUSING AND RESALE RESTRICTION AGREEMENTS FOR WESTLAND RESIDENTIAL PROJECT (GPA -90 -1; Z-90-2; TR -4726; TR -4738; RPD'S 90 -2, 90 -3, AND 90 -4) Background At the City Council's meeting of September 41 1991, staff was directed to schedule approval of the Westland Residential Project's Affordable Housing and Resale Restriction Agreements for the Council's September 18, 1991, meeting. Discussion A meeting was held between the applicant and staff on September 11, 1991, to reach concurrence on the final minor changes required to the Affordable Housing and Resale Restriction Agreements. Copies of each of the final corrected Agreements were received from the applicant's attorney this afternoon. Section 6 of the Resale Restriction Agreements still requires a minor modification to clarify that an appraisal report used in determining the City's shared appreciation cannot be morF,, than 6 months old. Staff intends to have the corrected language available at the meeting of September 18. The Affordable Housing Agreement will be signed by the City and a representative of the Westland Company. The Resale Restriction Agreements will be signed by the City and each of the buyers of the affordable units. There are two separate Resale Restriction Agreements - -one for the affordable detached units and one for the affordable condominium units. WOZNIAK Mayor Mayor Pro Tem Councilmemt Councilmember Councilmember The Honorable City Council September 13, 1991 Page 2 The second reading of the zone change ordinance for the Westland Project should not occur until the Affordable Housing Agreement is approved, since the general plan amendment for the Project will be effective the day following the second reading of the zone change ordinance. Recommendation Approve the revised language in Section 6 of the Resale Restriction Agreements clarifying the time limit for appraisal reports and then adopt resolutions approving these Agreements.
