Richards, Director of Community Developmen 1 DATE: September 26, 1991 (CC meeting of 10/2/91) SUBJECT: DOWNTOWN STUDY AREA - LAND USE CONSISTENCY Background The City Council at their August 16, 1989 meeting considered agenda item 8P which approved the final text of the Downtown Study. With that action of approval the Counci also directed the Community Development Committee to work with staff to develop a program to implement the basic elements of the study. Since that time there have been several Committee meetings and joint meetings between the Council and Planning Commission regarding .implementation. To date no formal implementation measures are in place within the boundaries of the Downtown Study Area lsee attached map). Discussion The purpose of this report to Council is to seek direction regarding the appropriateness of an .interim use of a property within the Downtown Study Area that is inconsistent with the proposed future use of the area. Currently the Downtown Study Area illustrates (see attached map) that only Commercial /Office uses such as corporate offices, apartments, or offices occur along the east and west side of Moorpark Avenue from Los Angeles Avenue to First Street /Poindexter Avenue. Proposed is a coin operated caz wash at 347 Moorpark Avenue (formally a Texaco Gasoline Station). The property owner has suggested that the Council make a determination that such a use is a permitted interim use until the irea begins to support office uses. Page 42 of the Downtown Study refers to this area along Moorpark Avenue as the Moorpark Avenue District. The Study was attempting to bring about more of an identity to Moorpark Avenue. The only new construction on Moorpark Avenue is the 2 story office building on the east side just south of Third Street. There has been no other new construction along Moorpark .Avenue for the past four years. At the present time the area identified as the Moorpark Avenue District has two zoning designations. The east side of Moorpark Avenue is C -1 (Neighborhood Commercial). The west side of Moorpark Avenue is C -2 (General Commercial) zone. The Neighborhood Commercial zone is to provide for retail convenience shopping and personal service to meet the daily needs of the immediate neighborhood. The General Commercial zone is to provide a wide range of commercial retail and business uses, including stores, shops, offices supplying commodities, or performing services for the surrounding community. It is within this zone that automobile car washes (coin or attendant type) can be found. To establish a coin operated car wash at 347 Moorpark Avenue a Conditional Use Permit will be required because the property is a General Commercial (C -2) zone and not a. Commercial Plan Development (CPD) zone. If the property were zoned CPD then a Commercial Planed Development permit would be required. In realty there is no difference between the two with regards to processing time (other than a higher fee for a CUP permit), or the type of conditions imposed. Either process requires a public hearing and approval by the Planning Commission (which would only go before the City Council if the decision was appealed). The request by the property owners of 347 Moorpark Avenue to allow a coin operated car wash as an interim use generally would have some merit if it were the only property to consider along Moorpark Avenue. Currently, there are a number of properties For Sale along Moorpark Avenue. Should there be a continued retraction from the Downtown Study; some review c::f the 1 ,ralidity of the Downtown Study ideas would be in order. W..th the amount of capital costs involved in the establishment of ari ":interim" use; the amortization period required to create a returr, profit would be many years in the future.
