Riley, Assistant City Manager DATE: March 25, 2013 (CC Meeting of (4/3/13) SUBJECT: Consider Resolution Establishing Budget for the Expenditure of Art in Public Places Funds for Projects at the Arroyo Vista Recreation Center and Along High Street including the Metro Link Rail Station BACKGROUND & DISCUSSION In May 2005 the City Council adopted City Ordinance 321 to require certain development projects to provide public art. Ordinance 321 also created an Art in Public Places Fund where fees are deposited, maintained, and used solely for the City's Art in Public Places Program. In 2011 the City of Moorpark, Mission Statement, Priorities, Goals and Objectives included two objectives relating to art in public places: 1) Development of a policy that new facilities and buildings which are City funded shall include public art in the same manner as private projects; and 2) Consider items of public art for the Police Services Center, Arroyo Vista Recreation Center, High Street Post Office and Train Station. On February 5, 2013, during a special meeting, the Moorpark Arts Commission discussed these and other objectives relating to public art and directed staff to begin the process for the selection of artists to develop artworks at the Arroyo Vista Recreation Center and along High Street with possible emphasis on the Metrolink Rail Station. Based on the experience gained from the public art project at the Ruben Castro Human Services Center, staff recommends that the City Council authorize a Not-to-Exceed Budget for each of these projects of $150,000. Staff will include the appropriation in the 2013-2014 F.Y. Proposed Budget. FISCAL IMPACT The attached resolution appropriates $10,000 to Special Professional Services and $10,000 for legal service; for a total of $20,000 for this current fiscal year. The art projects will be funded from the City's Art in Public Places Fund with a current balance of approximately $1.7 million. 4 Honorable City Council Regular Meeting of April 3, 2013 Page 2 STAFF RECOMMENDATION ROLL CALL VOTE 1) Adopt Resolution No. 2013-_ amending the Fiscal Year 2012-2013 Budget to allocate $20,000 from Art in Public Places to the Parks Administration Division; and 2) Authorize a Not-to-Exceed $150,000 Budget for Art in Public Places Projects at Arroyo Vista Recreation Center and High Street to be included in the 2013-2014 Budget. 5 Honorable City Council Regular Meeting of April 3, 2013 Page 3 RESOLUTION NO. 2013- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING THE FISCAL YEAR 2012/13 BUDGET TO ALLOCATE $20,000 FROM THE ART IN PUBLIC PLACES FUND (2151) TO THE PARKS ADMINISTRATION DIVISION (7100) FOR THE ART PROJECTS AT THE ARROYO VISTA RECREATON CENTER AND ALONG HIGH STREET WHEREAS, on June 20, 2012, the City Council adopted the Operating and Capital Improvement Budget for Fiscal Year 2012/13; and WHEREAS, a staff report has been presented to City Council discussing the need for Art in Public Places located at the Arroyo Vista Recreation Center and along High Street; and WHEREAS, an additional appropriation of $20,000 is requested from the Art in Public Places Fund (2151) to the Parks Administration Division (7100) to fund these twos projects, and WHEREAS, Exhibit "A" hereof describes said budget amendment and its resultant impact to the budget line items. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. A budget amendment allocating $20,000 from the Art in Public Places Fund (2151) for the art projects at Arroyo Vista Recreation Center and along High Street, more particularly described in Exhibit "A" attached hereto is hereby approved. SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
