Riley, Assistant City=7sos:itant BY: Patty Anderson, Assistant to City nager DATE: April 26, 2013 (CC Special Meeting of 5/15/2013) SUBJECT: Consider Amendment No. 5 to the Agreement with Steelcon, Inc. for Structural Steel and Miscellaneous Metals at the Ruben Castro Human Services Center; and Consider the Resolution Amending the Fiscal Year 2012/13 Budget to Appropriate $13,100 from the RDA-SA 2006 TAB Proceeds Fund 9104 to Cover the Cost of Amendment No. 5 to the Steelcon, Inc. Agreement BACKGROUND & DISCUSSION The Ruben Castro Human Services Center (RCHSC) is being constructed as a multiple- prime contract project with construction management provided by Barnhart Balfour Beatty Construction (Balfour-Beatty). Bids were solicited from trades in September, 2010, opened on October 21, 2010, and bids were awarded by the Moorpark City Council on January 19, 2011. Steelcon, Inc., (Steelcon) was selected as the lowest responsive and responsible bidder for the Structural Steel and Miscellaneous Metals bid package, and a construction agreement was executed on March 25, 2011. There have been four (4) amendments issued for changes, modifications, and construction alterations requested or required during the course of construction. A recap of the original contract and amendments issued to date is provided on the following page. Changes to the work, which have already been completed by the contractor, include modifications to the courtyard fencing and gates, and modifications to the structural, bent angles at the extension of Building B. 21 Honorable City Council May 15, 2013 Page 2 Original Contract $1,101,575.00 Amendment No. 1 $ 34,024.40 Amendment No. 2 $ 41,051.61 Amendment No. 3 $ 54,749.42 Amendment No. 4 $ 2,490.78 Current Agreement Amount $1,233,891.21 Amendment No. 5 Modifications to courtyard fencing and gates $ 8,373.18 Modifications to structural bent angle at ext. of Bldg B $ 4,671.47 Total Amendment No. 5 Amount $ 13,044.65 Revised Agreement Amount $1,246,935.86 Currently there is no contingency remaining within Steelcon's contract. The cost for the additions, revisions, and associated labor and materials is $13,044.55, which exceeds the available contingency; therefore staff is seeking the approval of this additional amount. FISCAL IMPACT The construction of the Ruben Castro Human Services Center (CIP 5020) and the Steelcon, Inc. contracts are included in the approved Recognized Obligation Payment Schedule III (ROPS III) for the period January 1, 2013, to June 30, 2013. However, there are no available appropriations to cover the cost of Amendment No. 5. A budget amendment of $13,100 is required from the RDA-SA 2006 TAB Proceeds Fund (Fund 9104). This fund is estimated to have $2,999,443 fund balance at year-end with the proceeds from the sale of Building A to the County of Ventura. STAFF RECOMMENDATION Adopt Resolution No. 2013- amending the FY 2012/13 Budget to appropriate $13,100 from the RDA-SA 2006 Tab Proceeds Fund (9104) to cover the cost of Amendment No. 5 to the Steelcon, Inc. Resolution No. 2013 - 22 ATTACHMENT 1 FIFTH AMENDMENT TO AGREEMENT 2011-073 FOR BID PACKAGE #6 — STEEL AND MISCELLANEOUS METALS AT THE RUBEN CASTRO HUMAN SERVICES CENTER THIS FIFTH AMENDMENT TO THE AGREEMENT FOR BID PACKAGE #6 — STRUCTURAL STEEL AND MISCELLANEOUS METALS ("Fifth Amendment"), is made and entered into this day of , 2013, ("the Effective Date") between the City of Moorpark, a municipal corporation, hereinafter referred to as "CITY", and Steelcon, Inc., a California corporation, hereinafter referred to as "CONTRACTOR". WITNESSETH:, WHEREAS, on March 25, 2011, the CITY and the CONTRACTOR entered into an Agreement for structural steel and miscellaneous metals work for the Ruben Castro Human Services Center; and WHEREAS, on November 8, 2011, the CITY and the CONTRACTOR entered into a First Amendment in an amount not-to-exceed thirty—four thousand twenty-four dollars and forty cents ($34,024.40) for structural steel and miscellaneous metals work for the Ruben Castro Human Services Center increasing the total not-to-exceed amount to one million one hundred thirty—five thousand five hundred ninety-nine dollars and forty cents ($1,135,599.40); and WHEREAS, on May 22, 2012, the CITY and the CONTRACTOR entered into a Second Amendment in an amount not-to-exceed forty-one thousand fifty-one dollars and sixty-one cents ($41,051.61) for structural steel and miscellaneous metals work for the Ruben Castro Human Services Center increasing the total not-to-exceed amount to one million one hundred seventy-six thousand six hundred fifty-one dollars and one cent ($1,176,651.01); and WHEREAS, on July 2, 2012, the CITY and the CONTRACTOR entered into a Third Amendment in an amount not-to-exceed fifty-four thousand seven hundred forty-nine dollars and forty-two cents ($54,749.42) for structural steel and miscellaneous metals work for the Ruben Castro Human Services Center increasing the total not-to-exceed amount one million two hundred thirty-one thousand four hundred dollars and forty-three cents ($1,231,400.43); and WHEREAS, on January 24, 2013, the CITY and the CONTRACTOR entered into a Fourth Amendment in an amount not-to-exceed two thousand four hundred ninety dollars and seventy-eight cents ($2,490.78) for structural steel and miscellaneous metals work for Ruben Castro Human Services Center increasing the total not-to-exceed amount one million two hundred thirty-three thousand eight hundred ninety-one dollars and twenty-one cents ($1,233,891.21); and Construction Agreement Page 1 of 3 Fifth Amendment Between City of Moorpark and Steelcon, Inc. 23 WHEREAS, the CITY wishes to further amend the Agreement to provide shop and field modifications to the Courtyard area fencing and gates per revisions issued by the Architect of Record at a cost not to exceed eight thousand, three hundred, seventy-three dollars and eighteen cents ($8,373.18) as described in the CONTRACTOR'S Change Order Request #13, 13rev and 13add#1 (BBC Recommendation # 6.23) dated April 12, 2013, and incorporated herein as Exhibit Z to the Agreement by this Fifth Amendment; and WHEREAS, the CITY wishes to further amend the Agreement to provide field modifications to installed structural metal bent angle along the exterior of Building B per revisions issued by the Architect of Record at a cost not to exceed four thousand, six hundred seventy-one dollars and forty seven cents ($4,671.47) as described in the CONTRACTOR'S Change Order Request# 15 (BBC Recommendation # 6.24) dated April 12, 2013, and incorporated herein as Exhibit AA to the Agreement by the is Fifth Amendment; and WHEREAS, the total dollar amount of $13,044.65 exceeds the ten percent (10%) contingency amount approved with the original Agreement; and WHEREAS, on May 15, 2013, the City Council of the City of Moorpark approved additional funding for these structural and miscellaneous metal additions, revisions, and changes. NOW, THEREFORE, in consideration of the mutual covenants, benefits, and premises herein stated, the parties hereto AMEND the aforesaid Agreement follows: I. Section 2 of the Agreement is amended to include; Contractor's Scope of Services is amended to include the materials and labor needed to: • Construct field and shop modifications to the Courtyard area fencing and gates per Instruction Bulletins 13 and 13R issued by the architect of record and per Change Orders # 13, 13rev and 13add#1 (6.23); and • Construct field modifications to installed structural metal bent angle along the exterior of Building B per RFI # 99R2 issued by the architect of record, and per Change Order# 15 (6.24). The Scope of Services for the additional structural steel work is described in the Change Orders dated April 12, 2013, attached hereto and incorporated herein as Exhibits Z and AA to the Agreement by this Fifth Amendment. II. Section 7 of the Agreement is amended to include: CITY hereby increases the not-to-exceed amount of $1,233,891.21 under this Agreement by $13,044.65 to $1,246,935.86. Instruction Bulletin (IB) # 13 was issued to provide modifications to the fencing and gates which enclose the courtyard between Buildings A and B. IB# 13R was subsequently issued for further modification clarifications. Modifications include revised fence and gate post footings attachments, additional backing on all gates for revised panic hardware, perforated mesh at gates to prevent unauthorized entry. Fence and gate powder coating was deleted as well. Impact to Bid Package#6 is for the material and labor to modified fence and gate posts, footing attachments, additional hardware backing and perforated mesh and deletion of powder coating. Pricing was received and subsequently reviewed and found acceptable by the CM. Finish hardware for doors as specified and as listed in"Hardware Groups"and required by actual conditions. 1. Include screws, special screws, bolts, special bolts, expansion shields, and other devices for proper application of hardware. B. Related Sections: 1. Section 06101 (061010): Carpentry 2. Section 08110(08 11 00), Section 08120(08 12 00), and Section 08211 (08 21 00)-Certain hardware items installed with doors. 3. Division 16: Electrical. 1.02 GENERAL REQUIREMENTS A. Provide items,articles, materials, operations and methods listed, mentioned or scheduled herein or on drawings, in quantities as required to complete project. Provide hardware that functions properly. Prior to furnishing hardware, advise Architect of items that will not operate properly,are improper for conditions, or will not remain permanently anchored. 1.03 SUBMITTALS A. Hardware Schedule:Submit 5 copies of hardware schedule in vertical format as illustrated by the Sequence of Format for the Hardware Schedule as published by the Door and Hardware Institute. Schedules which do not comply will be returned for correction before checking. B. Hardware schedule shall clearly indicate architect's hardware group and manufacturer of each item proposed. C. The schedule shall be reviewed prior to submission by a certified Architectural Hardware Consultant(AHC), who shall attest to the completeness and correctness of the schedule. 1. Provide 2 copies of illustrations from manufacturer0s catalogs and data in brochure form. 2. Check specified hardware for suitability and adaptability to details and surrounding conditions. Indicate unsuitable or incompatible items and proposed substitutions in hardware schedule. 3. Provide listing of manufacturer's template numbers for each item of hardware in hardware schedule. 4. Furnish other Contractors and Subcontractors concerned with copies of final approved hardware schedule. Submit necessary templates and schedules as soon as possible to hollow metal,wood door, and aluminum door fabricators in accordance with schedule they require for fabrication. 5. Samples: Lever design or finish sample: Provide 3 samples if requested by architect. D. Wiring Diagrams: Provide complete and detailed system operation and elevation diagrams specially developed for each opening requiring electrified hardware, except openings where only magnetic hold-opens or door position switches are specified. Provide these diagrams with hardware schedule submittal for approval. Provide detailed wiring diagrams with hardware delivery to jobsite. E. Installation Instructions: Provide manufacturer's written installation and adjustment instructions for finish hardware. Send installation instructions to site with hardware. F. Templates: Submit templates and"reviewed Hardware Schedule"to door and frame supplier and others as applicable to enable proper and accurate sizing and locations of cutouts and reinforcing. G. Contract Closeout Submittals: Comply with Section 01700 including specific requirements indicated below. 1. One complete set of special tools required for maintenance and adjustment of hardware, including changing of cylinders. 1.04 QUALITY ASSURANCE A. Manufacturer:Obtain each type of hardware(ie. latch and locksets, hinges, closers)from single manufacturer, although several may be indicated as offering products complying with requirements. B. Supplier: Recognized architectural finish hardware supplier,with warehousing facilities, who has been providing hardware for period of not less than 3 years. The supplier shall be, or employ, a certified Architectural Hardware Consultant(AHC),who is registered in the continuing education program as administered by the Door and Hardware Institute. The hardware schedule shall be prepared and signed by a certified AHC. C. Installer: Firm with 3 years experience in installation of similar hardware to that required for this project, including specific requirements indicated. D. Regulatory Label Requirements: Provide nationally recognized testing agency label or stamp on hardware for labeled openings.Where UL requirements conflict with drawings or specifications, hardware conforming to UL requirements shall be provided. Conflicts and proposed substitutions shall be clearly indicated in hardware schedule. E. Pre-Installation Conference: Prior to the installation of hardware, manufacturer's representatives for locksets, closers, and exit devices shall arrange and hold a jobsite meeting to instruct the installing contractor's personnel on the proper installation of their respective products.A letter of compliance, indicating when this meeting is held and who is in attendance, shall be sent to the Architect and Owner. 1.05 DELIVERY, STORAGE AND HANDLING A. Deliver hardware to jobsite in manufacturer's original packaging, marked to correspond with approved hardware schedule. Do not deliver hardware until suitable locked storage space is available. Check hardware against reviewed hardware schedule. Store hardware to protect against loss,theft or damage. B. Deliver hardware required to be installed during fabrication of hollow metal, aluminum, wood, or stainless steel doors prepaid to manufacturer. 1.06 WARRANTY A. Guarantee workmanship and material provided against defective manufacture. Repair or replace defective workmanship and material appearing within period of one year after Substantial Completion. B. Provide ten year factory warranty on door closer body against defects in material and workmanship from date of occupancy of Project. C. Replace shortages and incorrect items with correct material at no additional cost to Owner. D.
