AGENDA REPORT TO: Honorable City Council FROM: Dave Klotzle, City Engineer/Public Works Director DATE: October 25, 2013 (CC Meeting of 11/06/13) SUBJECT: Consider Resolution Reestablishing Parking Restrictions and Exemptions for Street Sweeping and Rescinding Resolution No. 93- 985 and Resolution No. 95-1121 BACKGROUND On November 3, 1993, City Council adopted Resolution No. 93-985 which established parking restrictions for the purpose of facilitating street sweeping. At that time, City streets were being swept every other Tuesday or Thursday, with a portion of the downtown area swept every Thursday. The parking restrictions established by Resolution No. 93-985 were for four (4) hours per day, every week, coinciding with the Tuesday or Thursday sweeping day. On May 3, 1995, City Council adopted Resolution No. 95-1121 which amended Resolution No. 93-985 by adding a provision to allow a temporary exemption of street sweeping parking restrictions permit to be issued to residents according to procedures established by the City Manager. On March 2, 2005, City Council approved revisions to the street sweeping schedule and related parking restrictions to coincide with twice per month street sweeping. The parking restrictions remained at four (4) hours per day on each street sweeping day. Minor administrative changes to the procedures for issuing temporary exemption of street sweeping parking restrictions permits were approved at this time as well. On December 6, 2006, City Council approved revisions to the street sweeping schedule and related parking restrictions decreasing the duration of the restrictions from four (4) hours to three (3) hours per day on street sweeping days. This revision required the street sweeping schedule to be revised to sweep some residential areas on Monday or Friday. 236 Honorable City Council November 6, 2013 Page 2 of 3 DISCUSSION The attached resolution reestablishing parking restrictions and exemptions for street sweeping is intended to formalize the street sweeping schedule to be three (3) hours per day, twice a month, except where modified as deemed necessary in areas near schools and City parks as approved by the City Manager. Staff recommends one such modification to the street sweeping schedule on Monroe Avenue and Campus Canyon Drive in the vicinity of Campus Canyon College Preparatory Academy and Campus Canyon Park. The current schedule for street sweeping in this area is between 12:00 p.m. and 3:00 p.m. on the 2nd and 4th Tuesday of each month. During these hours, street parking is not available to school staff and visitors. Recent changes at the school have increased the number of students, staff and visitors, making available parking increasingly limited especially during street sweeping hours. Staff is proposing to change the street sweeping schedule on all of Monroe Avenue and on Campus Canyon Drive from Collins Drive to Stanley Court to 4:00 p.m. to 5:00 p.m. on the 1st and 3rd Thursday of each month. This is the same street sweeping schedule for the streets surrounding Flory Academy and the street sweeper will be able to sweep both areas within the scheduled time. This proposed schedule will have much less of an impact on available parking during regular school hours and is expected to have a minimal impact on parking available for visitors to Campus Canyon Park. Additionally, the City received a letter from Moorpark Unified School District dated October 8, 2013, containing a commitment to keeping the school parking lot along Campus Canyon Drive open and available to park users during the revised street sweeping hours. The proposed resolution would allow the City Manager to approve this change in the street sweeping schedule as well as other future changes deemed necessary in areas near schools and City parks. The proposed resolution also clarifies the procedures that apply to the issuance of permits to exempt residents from street sweeping restrictions under certain circumstances. The proposed resolution would allow a resident to obtain a permit to park on the street during the prohibited parking hours for street sweeping for occasions such as work being performed on their house, loading or unloading of a moving truck or other circumstances, as approved by the City Manager or his/her designee, that preclude the resident from parking in their driveway. A resident would be limited to four (4) permits per day for up to six (6) separate days per calendar year and limited to one day per month. The number of permits issued per day may be modified upon approval by the City Manager or his/her designee for unusual circumstances such as unanticipated medical or personal situations that result in numerous vehicles parking during street sweeping hours. 237 Honorable City Council November 6, 2013 Page 3 of 3 FISCAL IMPACT None. STAFF RECOMMENDATION Adopt Resolution No, 2013 - Reestablishing Parking Restrictions and Exemptions for Street Sweeping and Rescinding Resolution No. 93-985 and Resolution No. 95- 1121. Attachment: Resolution No. 2013 - 238 Attachment 1 RESOLUTION NO. 2013 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, REESTABLISHING PARKING RESTRICTIONS AND EXEMPTIONS FOR STREET SWEEPING AND RESCINDING RESOLUTION NO. 93-985 AND RESOLUTION NO. 95-1121 WHEREAS, On November 3, 1993, pursuant to the provisions of Section 22507.6 of the California Vehicle Code, the City Council adopted Resolution No. 93-985 establishing parking restrictions for the purpose of facilitating street sweeping; and WHEREAS, On May 3, 1995, pursuant to the provisions of Section 22507 of the California Vehicle Code, the City Council adopted Resolution No. 95-1121 amending Resolution No. 93-985 by adding a temporary waiver of street sweeping parking restriction permit; and WHEREAS, Section 22507.6 of the California Vehicle Code provides for the establishment of parking restrictions on local streets for the purpose of facilitating street sweeping; and WHEREAS, Section 22651(n) of the California Vehicle Code provides for the removal of vehicles from locations where parking is prohibited; and WHEREAS, Section 22507 of the California Vehicle Code provides for the issuance of permits exempting certain vehicles from specified parking restrictions; and WHEREAS, the City Council desires to reestablish parking restrictions and exemptions for street sweeping. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That Resolution No. 93-985 and Resolution No. 95-1121 are hereby rescinded. SECTION 2. That the parking of vehicles shall be prohibited during the times and days specified on signs posted for this purpose, on any street within any area where signs have been posted giving notice of the specified parking prohibition. SECTION 3. That the times and days of the specified parking prohibition be limited to a maximum of three (3) hours on any one day and a maximum of two (2) days per month, spaced a minimum of two weeks apart. 239 Resolution No. 2013 — Page 2 SECTION 4. That, except as provided for herein, any vehicle parked on any street in any area so designated by signs posted in accordance with the requirements of this Resolution, shall be subject to being cited and towed. SECTION 5. That any signs posted for the purpose of effectuating this Resolution, shall be placed in a conspicuous location at each entrance to any area subject to the parking restriction. SECTION 6. That any such sign shall clearly state the period of time and the day of the parking prohibition, and that vehicles are subject to being towed. SECTION 7. That any such sign shall be in conformance with the design criteria set forth in, and shall be posted in accordance with the requirements of, Section 2507.6 of the California Vehicle Code. SECTION 8. That the City Manager is hereby authorized and directed to have placed and maintained any such signs as may be required to improve the efficiency and effectiveness of the City's street sweeping program, including changes to the times and days of the specified parking prohibitions as determined by the City Manager. SECTION 9. That it is the City Council's policy that vehicles displaying special identification license plates or distinguished placards for disabled persons, as defined in the California Vehicle Code, shall be exempt from the City's street sweeping parking restrictions. SECTION 10. That it is the City Council's policy that posted City street sweeping parking restrictions will not be enforced on City holidays designated by resolution of the City Council for the closure of City offices. SECTION 11. That the specified parking prohibition shall not apply to any vehicle which displays a Temporary Exemption of Street Sweeping Parking Restriction Permit issued by the City. SECTION 12. The City Manager shall establish procedures for the issuance of Temporary Exemption of Street Sweeping Parking Restriction Permits. SECTION 13. The City Manager or his designee is hereby directed to issue Temporary Exemption of Street Sweeping Parking Restriction Permits as deemed necessary. SECTION 14. Residents may obtain up to four (4), no-cost, Temporary Exemption of Street Sweeping Parking Restriction Permits on six (6) separate days per calendar year, limited to one day per month. 240 Resolution No. 2013 — Page 3 SECTION 15. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
