SUBJECT: Consider Resolution Directing the Planning Commission to Study,
Hold a Public Hearing, and Provide a Recommendation to the City
Council on Amendments to Chapter 17.08 (Definitions), of the Zoning
Ordinance to Update Definitions of Supportive Housing, Target
Population, and Transitional Housing
BACKGROUND/DISCUSSION
Under state law, the City is required to prepare a Housing Element update for the 2014-
2021 planning period. The Draft 2014-2021 Housing Element was prepared and reviewed
by the City Council on October 2, 2013. Following review by the City Council, the Draft
Housing Element was submitted to the California Department of Housing and Community
Development (HCD) for review. On October 21, 2013, a letter was received from HCD
stating that the draft element addresses statutory requirements. The only change to City
land use policy or regulations proposed in the new draft Housing Element is the proposed
program 7, as follows:
Proposed Program 7: includes a commitment to process a Zoning Ordinance
Amendment to revise the City's definitions of "supportive housing", "target
population" and "transitional housing" consistent with recently adopted
state law(SB 745 of 2013) as part of this Housing Element update process.
The SB 745, which amended housing element law, also includes a definition of target
population, and our municipal code does not have a definition for this. In discussions
with HCD, they have indicated that we should provide that definition in or municipal
code, therefore, the attached resolution also addresses this.
The Municipal Code calls for a resolution of City Council to initiate an amendment to the
Zoning Ordinance. The attached draft resolution, if adopted by City Council, would direct
staff and the Planning Commission to study and provide a recommendation to the City
Council on a Zoning Ordinance Amendment to address these issues.

RESOLUTION NO. 2013-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, DIRECTING THE PLANNING
COMMISSION TO STUDY, HOLD A PUBLIC HEARING,
AND PROVIDE A RECOMMENDATION TO THE CITY
COUNCIL ON AMENDMENTS TO CHAPTER 17.08
(DEFINITIONS) OF THE ZONING ORDINANCE TO
UPDATE DEFINITIONS OF SUPPORTIVE HOUSING,
TARGET POPULATION, AND TRANSITIONAL HOUSING
WHEREAS, Section 17.44.050 of the Municipal Code provides that the City
Council may initiate proceedings to consider amendments to the Zoning Ordinance by
the adoption of a resolution of intent; and
WHEREAS, the City Council wishes to initiate proceedings to consider a Zoning
Ordinance Amendment that would amend Chapter 17.08 (Definitions), to update
definitions of supportive housing, target population, and transitional housing to be
consistent with recent amendments to State law.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. INITIATION OF PROCEEDINGS: The City Council hereby
authorizes the initiation of proceedings to consider a Zoning Ordinance Amendment that
would amend Chapter 17.08 (Definitions), to update definitions of supportive housing,
target population, and transitional housing, consistent with recent amendments to State
law, the City's General Plan and other provisions of the City's Zoning Ordinance.
SECTION 2. DIRECTION TO PLANNING COMMISSION: The Planning
Commission is hereby directed to study, hold a public hearing, and provide a
recommendation to the City Council on this matter.
SECTION 3. CITY CLERK CERTIFICATION AND FILING: The City Clerk shall
certify to the adoption of this resolution and shall cause a certified resolution to be filed
in the book of original resolutions.
