SUBJECT: CONSIDER REQUEST FOR AMICUS SUPPORT - CITY OF ORLAND
BACKGROUND
The City of Orland is seeking support bar other cities, at no cost
to them, in an amicus brief being prepared in its support regarding
the use of the Landscaping and I_ ghting Act.
The League of California Cit-tes LegaL Advocacy Committee has
reviewed this case and has decoded to urge cities to join in the
amicus brief. This appeal invol,wes the ability of cities to fund
improvements and maintenance t.hrcugh the Landscaping and Lighting
Act of 1972 and through other special a:asessment acts.
RECOMMENDATION
Authorize support of the amicus brief En Knox v. City of Orland
regarding the Landscaping and Ii,htinq Act of 1972.

Re: Amicus Brief in Knox -'ity of Orland
Dear Steve:
The above- referenced -ease involves the use of the
Landscaping and Lighting Act k_f, the City of Orland for park
maintenance. Orland is seekir14 joinder by other cities, at
no cost to them, in an amicus ->rief being prepared in its
support. The Court of Appeal., in an unpublished opinion,
upheld the City of Orland's , .0 ^) per dwelling unit
Landscaping and Lighting Act Er_ ;sessment for park
maintenance. The Pacific Legal. Foundation, on behalf of the
plaintiffs, sought review in t -ie 'al_ifornia Supreme Court.

the Landscaping and Lighting Act authorizes maintenance of
preexisting improvments and that the flat $24.00 assessment
was reasonable based on studies performed by the City and
was therefore not a special ta)<.
The League of California Cities Legal Advocacy
Committee has reviewed this case and has decided to urge
cities to join in the amicus brief. This appeal involves
the ability of cities to fund improvements and maintenance
through the Landscaping and Lighting Act of 1912 and through
other special assessment acts
The amicus brief will be filed on November 15,
1991. If Moorpark wishes to �::)in in the amicus brief, City
Council authorization will be seeded at its first meeting in
November.
