Subject: PD 1066 Minor Modification No. 2 (Liston)
Background
On January 20, 1988 meeting the City Council approved Resolution No. 88-444, conditionally
approving Planned Development Permit No. 1066, for a car wash and auto repair center. On
December 12, 1990 the City approved Zoning Clearance 90-446 to allow construction to begin.
During construction a number of trees were cut down which were to have been retained. Minor
Modification No. 1 to PD 1066 was filed to modify the landscape plans to reflect the revised
landscape plan, and incorporate a number of City conditions. This Minor Modification was
approved by the City on June 25, 1991, with conditions relating to design and operation.
Discussion
This request is to construct a canopy above the gasoline pumps. This would allow the employees
who work outdoors cleaning and vacuuming the cars to be protected from the elements. The
canopy will have a wood mansard which matches the design of the building, and be supported by
eight wood sheathed steel columns. An added benefit of the canopy would be to reduce the
apparent size of the 68 feet of asphalt stretching from the building to the northern property
line. The design, materials and color of the canopy will match the existing building.
At present a number of outstanding violations for the car wash exist. They are as follows: 1) A
sign has been placed on the building without a permit 2) An off site advertising sign has been
placed on a truck at the corner of Los Angeles Ave. and Park Lane 3) A sign program has not
been approved for the center. The basis for these violations is Resolution No. 88-444 which
approved the car wash. Condition number 19 of this Resolution reads . . . ."Signs are subject to
the Moorpark Zoning Ordinance, Chapter 50 of Title 9. A sign permit is required for all on-site
signs where there are more than two signs on the building or within the complex, a sign
program shall be approved by the Director of Community Development. No off-site signs are
permitted." The submitted plans depict a proposed "Texaco" sign on 2 faces of the Canopy. On
November 12, 1991 Leonard Liston indicated to the City that the proposed Texaco signs on the
canopy are not a part of the application and will be requested on a later date when all sign
violations have been resolved.

The Director intends to approve this Minor Modification with the following conditions in place:
1 ) All colors and materials of the canopy shall match the existing building.
2) All lighting shall be flush mounted with the bottom of the canopy with a
fixture to be approved by the Director of Community Development.
)1 A sign program has been approved.
r) This Minor Modification will not become effective until such time as all
outstanding violations have been resolved to the satisfaction of the
Director of Community Development.
The Director of Community Development has reviewed the proposed Minor Modification and
intends to approve it with the above conditions in place. Pursuant to resolution No. 86-523,
the Director has the authority to approve Minor Modifications. This matter is being presented
to the Council as a courtesy. Should the Council desire to appeal the Director's decision, a public
hearing should be scheduled. The next available public hearing date is December 18, 1991. If
the Council takes no action, then the Director's decision stands.

SUBJECT: REQUEST FOR MINOR MODIFICATION, PROPOSED CANOPY, PD
1066, MOORPARK CAR CARE, INC. , 75 PARK LANE, MOORPARK,
CALIFORNIA.
REFERENCES: REVIEW LETTER PREPARED BY PAT RICHARDS AND CRAIG
MALIN
ARCHITECTURAL PLAN FOR PROPOSED MOORPARK CAR WASH
CANOPY, PREPARED BY L. LISTON AND ASSOCIATES, INC.
Gentlemen :
We are in receipt of your letter delivered to Mr. Thomas Cushman
at Moorpark Car Wash, 75 Park Lane, Moorpark, California. The
letter requests additional information and/or clarification to
eight items prior to proceeding with the minor modification
process . For convenience, I have indicated the City's request
below, with the corresponding response.
Item 1 . Will UBC or Fire Code allow the wood ceiling over the
gas pumps? If not , what goes up there?
Response: Section 702B in the 1988 edition of the UNIFORM
BUILDING CODE states as follows :
Special Provisions. 1 . Group B, Divisions 1 and 3. Marine or
motor vehicle service stations including canopies and supports
over pumps shall be of noncombustible, fire-retardant-treated
wood or of one-hour fire-resistive construction. EXCEPTIONS:
1 . Roofs of one-story service stations may be of heavy-timber
construction.
2. Canopies conforming to Section 5213 may be erected over
pumps.
In areas where motor vehicles, boats or aircraft are stored, and
in gasoline service stations , floor surfaces shall be of noncom-
bustible, nonabsorbent materials. Floors shall drain to an

approved oil separator or trap discharging to sewers in
accordance with the Plumbing Code. EXCEPTION: Floors may be
surfaced or waterproofed with asphaltic paving materials in areas
where motor vehicles or airplanes are stored or operated.
CANOPIES: Sec. 5213. Approved plastic panels may be installed
in canopies erected over mover vehicle service station pumps,
provided the panels are located at least 10 feet from any
building on the same property and face yards or streets not less
than 40 feet in width on the other sides. The aggregate area of
plastics shall not exceed 1000 square feet. The maximum area of
any individual panel shall not exceed 100 square feet.
Please note that the current proposed canopy plan calls for two-
inch T and G sheeting to be placed over the 6 x 8 roof beams.
This assembly qualifies as a one-hour rating.
Item 2. How is lighting under the canopy? We do not want to see
glare from the street. Suggest the use of down
lighting.
Response: The proposed canopy plans specify surface-mounted
light fixtures, which will be attached to the two by T
and G sheeting between the roof rafters. The roof
rafters extend down below the two by T and G sheeting
approximately 7 1/4 inches, which will eliminate any
glare to the city street, Park Lane.
Item 3. Are benches out in front new:
Response: The benches located in front of the car wash building,
facing Park Lane, are in strict compliance with the
approved site plan and architectural plans.
Item 4. Need more detail on column.
Response: The proposed canopy plans specify 6 x 6 steel tube
columns to support the canopy. These columns shall be
wrapped with two-inch cedar and painted to match the
exterior of the car wash building.
Item 5. Need more detail on flat roof area .
Response: The underside of the flat roof area will consist of
diagonally placed two inch tongue and groove sheeting,
placed over 6 x 8 roof rafters. This assembly will
match the detail of the exterior of the existing car
wash building.

Item 6. Is existing sign to remain?
Response: As of this date, the two permanent signs, which are in
compliance with our approved sign program, are the car
wash sign at the northeast corner of the car wash
building, and the sign located in the center of the
auto service bay building.
Item 7 . The 24" letters are much too large for this building.
Suggest 16" or 18" letters . Keep in scale with existing
lettering.
Response: The 24 inch letters, which are indicated on the
proposed canopy plans, are for schematic purposes
only. The actual signage for the canopy, as well as
additional site signage, will be submitted, processed
and approved under a separate application. The sub-
mitted request for minor modification is for the
canopy only and not for any additional signage.
Item 8 . (Note from Craig Malin) Please call me about the canopy.
The city cannot proceed with the minor modification
until all violations are settled. This includes the
sign on the corner, on the building, and initiating a
sign program (required by Resolution 88-444) .
Response: We currently have an approved sign program on file at
the City of Moorpark. We are in the process of
developing additional site signage, which would
include any additional signage to be located on the
canopy, and will be submitting to the City for
review and approval via a separate application as
recommended by Mr. Pat Richards. For the purposes of
the minor modification, the signage indicated on the
proposed canopy plans shall not be a part of the minor
modification application or permit.
