FROM: Kenneth C_ Gilbert, Director of Public Works I (C DATE: November 11, 1991 (Counci) Meeting 11- 20 -91) SUBJECT: A Resolution 1) Establ.i.shing NO STOPPING ANYTIME Zones on Both Sides of Los Angeles Avenue and New Los Angeles Avenue from the Route 23 Freeway Westerly to a Point One Hundred Feet West of Butter Creek Road; 2) Repealing Resolution Numbers 86 -339, 87 -410, 89- 583, 89 -584, 89 -625 and 91 -795 which Set Forth Conflicting Provisions; and, 3) Reenacting Those Repealed Provissions Which Are Not Applicable to 1,tate Highways OVERVIEW This presents a Resolution chanq,.ng the parking restriction on Los Angeles Avenue and New Los e- ngeles Avenue from NO PARKING ANYTIME to NO STOPPING ANYTIME DISCUSSION A. Background Over the years the City has adopted a series of resolutions establishing "NO PARKING ANYTIME" zones on certain segments of Los Angeles Avenue and New Los Angeles Avenue. The areas affected by those actions are :3escribed on a map attached as Exhibit 1. B. Proposed Change The present NO PARKING restriction prohibits vehicles from stopping at the curb side for any purpose, including the loading and unloading of passengers. Unfortunately, this is not clear to the general pub',ic. For that reason, traffic officers have reluctant to is:: _ie citations to vehicles parked at the curb side which are rot. unattended. Proposed Change (cont) In order to better provide for traffic safety, it is recommended that the NO PAF ,KING ANYTIME restriction be upgraded to NO STOPPING ANYTI11E C. Added Areas There are segments of the subject: streets which are not now covered by the NO PARKING rest:.ric:tion. It is proposed that the new NO STOPPING restriction cover areas not previously addressed. The areas proposed to be subject to the NO STOPPING restriction are des(ribed. )n the map attached as Exhibit 2. D. Resolutions Repealed A resolution has been prepared (Exhibit 3) to enact the proposed NO STOPPING restricI...ions. That resolution also repeals all of the resolutions set forth on Exhibit 1. Those elements of the resolutions t,; be repealed which pertain to streets other than Los Ange1E s, Avenue and New Los Angeles Avenue, are reenacted. RECOMMENDED ACTION Adopt the attached resolution (Exhibit 3) 1) establishing a NO STOPPING ANYTIME zone on both sides of Los Angeles Avenue and New Los Angeles Avenue from the Poute 23 Freeway Westerly to a Point One Hundred Feet West of Bt:tter Creek Road; 2) Repealing Certain Resolutions Setting Forty Conflicting Provisions; and, 3) reenacting those provisions rci appli-able to State Highways RESOLUTION NO. 41 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, 1) ESTABLISHING "NO STOPPING ANYTIME" ZONES ON BOTH SIDES OF LOS ANGELES AVENUE AND NEW LOS ANGELES AVENUE FROM THE ROUTE 23 FREEWAY WESTERLY TO A POINT ONE HUNDRED FEET WEST OF BUTTER CREEK ROAD; 2) REPEALING RESOLUTION NUMBERS 86 -339, 87 -410, 89 -583, 89 -584, 89 -625 AND 91 -795 WHICH SET FORTH CONFLICTING PROVISIONS; AND, 3) REENACTING THOSE REPEALED PROVISIONS WHICH ARE NOT APPLICABLE TO STATE HIGHWAYS WHEREAS, Section 22506 of the California Vehicle Code provides for the restriction and /or prohik >iti.on of parking and /or stopping on a state highway with the appr(val of Caltrans; and, WHEREAS, Section 22507 of the California Vehicle Code provides for the restriction and /or prohi'.ition of parking and /or stopping on local streets; and, WHEREAS, the City Council has adopted a number of Resolutions which included the establishment. of "NO PARKING ANYTIME" zones on portions of Los Angeles Avenue ar:d New .os Angeles Avenue between the Route 23 Freeway a point jLrs' wE!st of Butter Creek Road; and, WHEREAS, the City Council has det:.erm:Lned that the expansion of those zones to include additi.onil areas, and the upgrading the parking restriction in said zone;; to "NO STOPPING ANYTIME," will improve the traffic safety on sa :i tre "its; and, WHEREAS, in order to avoid the creatlon of conflicting parking restrictions, it is necessary to repeal those resolutions setting forth the aforesaid "NO PARKING NYTIME " zones; and, WHEREAS, Exhibit "B " (atta::he. hereto and made a part hereof) sets forth those resolutions t.c q r.epe�iled; and, WHEREAS, some of the provis on:; o, said resolutions to be repealed, pertain to parking rests ict:.ion:> on streets other than the State Highways, and should, ther"forE�, 1,e reenacted; and, WHEREAS, Column 5 of Exhi.bi, " 1f311, clearly identifies those provisions pertaining to the f i gh4iays ; and, WHEREAS, Column 6 of Exhitai° '11311, clearly identifies those provisions applicable to City Et:; Resolution No. 91 - Page 2 NOW, THEREFORE, THE CITY COUNCIL (:)F THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That a "NO STOPF?LNG ANYTIME" zone (as described in Exhibit "A" attached hereto ana made a part hereof) is hereby established on both sides of Los .r \ngeles Avenue and New Los Angeles Avenue from the Route 23 Freeway westerly to a point one hundred feet west of Butter Creek Road, excepting therefrom those areas listed in Section 2.. That, pursuant tc Section 22506 of the California Vehicle Code, a copy of this resolution shall be forwarded to Caltrans for approval. SECTION 5. That, upon receipt. of said approval, the following actions- shall become effective a ,d sha.l L be implemented: a. all of the provisions 1. i s' eo in .olumn 115" of Exhibit "B" shall be repealed. b. the City Manager shall prc✓ide for the installation of and maintenance of the appropriate s,.gns and markings for the area described in SECTION above SECTION 6.
