SUBJECT: Consider Support for Assembly Bill 423, Hazardous
Waste Enforcement
Background
Assembly Bill 423, Hazardous Waste Enforcement (Boland), is being
sporsored by the County of Ventura. Existing State Law provides
Cal -EPA with the authority to issue orders for assessment and
cleanup of hazardous waste sites where a release has occurred.
This bill would change State Law and allow this authority to be
given to Local Health Officers (the County's Environmental Health
Department) where a Memorandum of Understanding exists with Cal -
EPA. The Local Health Office would be given the same authority
Cal -EPA has to issue orders to assess a suspected or known release
of hazardous waste and issue orders to cleanup a release of
hazardous waste.
AB 423 would provide an option for local businesses to obtain
assessment and cleanup oversight services as well as site closure
from the Local Health Officer. This would create a local point of
contact for these services, provide more timely site closure for
smaller sites and save money.
The program proposed by the County would be funded by fees charged
to each business requesting the service. The County's
Environmental Health Department currently has the authority for
underground tank cleanup and the maximum fee - for - service, is
$5,000, which is substantially less than the state's filing fee
alone. The County of Ventura claims that AB 423 will save small
businesses time and money involved in local hazardous spill
cleanup. In addition, AB 423 will streamline the permit process
and encourage spill reporting and remediation.
Recommendation
Staff recommends that the Council direct the Mayor to send a letter
to the appropriate State Assembly Committee expressing the City's
support for AB 423.
