Dear Colleague:
on November 30, 1559, the California Supreme Court
accepted for review the above- f�ntitled action in order to resolve
the issue of whether insurers are responsible for the costs of
environmental cleanup and prevention_ The appellate court ruled
that the term "damages on acc,.unt of property damage," found in
virtually all comprehensive general liability policies, does not
cover statutorily imposed costs of cleanup of damage to third -
parties. In so ruling, the appellate court explicitly rejected
the opinion of the 1st district this year in Aerojet- General
Corp. v. Superior Court (1989; 209 C13p.App.3d 973, 257 Cal.Rptr.
621, reh'g denied and opin on moc_`fiod, 211 Cal.App.3d 216, 257
Cal.Rptr. 621.
I am preparing an am.cus brief urging the Supreme Court
to reverse the appellate court' decision in AIU V. Superior Court.
The League of California Cities has recommended that its members
support this amicus brief. Th.s case affects cities and counties
in two ways. First, in their proprietary capacity cities and
counties have paid large premiums over the years to insure that any
cleanup costs imposed upon them due to contamination for which they
are responsible will be bornE by their insurer and not by the
general fund. Second, more and more o f ten cities and counties find
themselves as third - parties da ~.aged by hazardous wastes. In many
cases, cleanup costs are so c-:t-2nsive that they are beyond the
financial ability of respon� in o F l-irt es.

The Cities of San �)iego, San Jose, Bakersfield, and
Burlingame have already joined in our amicus brief. The Attorney
General's office has also decided to file an amicus brief seeking
to have this decision reversed

file the amicus brief on about January 2, 1990, so I would
appreciate a response at your arliest convenience.
