PD 1064 is located at the southwest corner of Los Angeles Avenue
and Spring Road. A location maf is att,iched for your reference.
On January 20, 1988, the City Council approved the above project
for construction of a commerci,:l building. As a condition of
approval, the applicant was required t:o construct a reinforced
concrete box (RCB) for storm drai , purposes along the east property
line of the project. The applicant was to be reimbursed for this
RCB construction from the Los Ancleles Avenue A.O.C. funds. A copy
of the City Engineer Original Cor '. i' on fro. 3C is enclosed for your
reference.
At the request of the applicant_, everal conditions ( including City
Engineer Condition No. 3C) were uroagh': back to the City Council
on November 3, 1988 for clarific:,•tion. Enclosed with this memo is
a clarification of City Enginee CcnAiI ion No. 3C as adopted in
Resolution 89 -535.

The applicant originally request .i a reimbursement amount for RCB
construction of $184,781.58. 1•ised on a letter from the City
Engineer requesting additional b:ckup information to substantiate
the reimbursement amounts, the i�vised reimbursement amount from
the applicant is $181,438.58. Ho.,ever, based on the review of this
material, the City Engineer reccnmends a reimbursement amount of
$132,494. This amount is derive as shown in the table below:

1. The hourly cost and amount . time for Civil Engineering and
Surveying of the RCB are rea, ) nable ind are substantiated with
invoices from the applican- enqi -eer.
2. Since the applicant chose c:ons,truct the RCB during the
rainy season, the City is no- r��,;por ;ible for reinspection and
overtime due to rainy weat!. .

3. The City Inspection fee is :tsed upon the difference in fees
required for construction -ost .ith the RCB versus the
construction cost without t. RCB.
4. Performance Bond cost is b<sed upon the actual cost of the
bond prorated for the story; train ,:ortion of this cost.
5. Under construction cost's, the ieveloper is requesting
reimbursement for on -site :irainage facilities. In staff's
opinion, the intent of the :eimoursement is only for the RCB
and not for on -site improve-ents necessitated by development
of this site. If further in! :rmation substantiating these on-
site costs is brought )rt^ :,y the developer, this
reimbursement request wil: orou(int back to City Council.
6. The developer is responsib. f)r -he City Engineer cost to
review this reimbursement (u?_;t.

By consensus, the Council ecognized Paul Gienger of Topa, who
responded to concerns exprr•;sed by Councilmember Brown, advising
the Council that Topa has prated $15,000 with the City to secure
performance regarding oh<, installation and /or replacement of
sidewal.ks at the northea,, corner of Spring Road and New Los
Angeles Avenue. Currently, Topa is negotiating with the property
owners across the stree% I rm The I'laza for the installation of
sidewalks rather than pur•, ing the option to replace their own
sidewalks in the Plaza. idkiscec this project is moving along
as quickly as possible.
