Richards, Director of Community Development DATE: January 3, 1.990 (CC meeting of 1-17-90) SUBJECT: DP-348 MAJOR MODIFICATION NO. 1 (A TO Z SELF-STORAGE) Aac_k raund The applicant, A to Z Self-Storage, requests approval to modify the Development Permit Plan No. 348 currently a 47,400 sq.ft. self-storage facility in. order to allow for the outdoor storage of recreational vehicles, and for a rental business of U-Haul trucks and trailers to be stored within the existing parking ste1:Ls on the subject property. The applicant also proposes to conduct complementary service and sale activities related to self-storage an:1 the proposed outdoor parking of trucks an recreational. vehicles. In addition, the applicant requests to extend both the hours of operation and the workdays to include Sundays. On December 4, 1989, the Planning Commission held a public hearing for the proposed Major Modification No. 1 pertaining to the applicant's request, as mentioned above. On a vote of. 5-0, the Planning Commission recommended to the City Council that the applicant's proposals be denied. On December. 20, 1989, the Planning Commission adopted a resolution recommending denial of the project without prejudice. The attached staff report of December 4, 1989 discusses the project issues (Attachment 1) . Discussion The Planning Commission's primary reason for recommending denial without prejudice was the concern. that the proposed modifications would be significantly detrimental to the peace, safety, health, welfare and quality of life of the people residing in the immediate vicinity of the project site. Land use, parking, on-site traffic circulation, noise, safety, and aesthetic and visual impacts on adjacent single family residences, and commercial properties were the issues discussed in reviewing the appropriateness of the proposals for the M-1 Zoning District. 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 i , Page TO: The Honorable City Council FROM: Patrick J. Richards, Director of Community Development DATE: January 3, 1990 (CC meeting of. 1-17-90) SUBJECT: DP-348 MAJOR MODIFICATION NO. 1 (A TO Z SELF-STORAGE) Page -2- The issue that was extensively discussed at the planning Commission public hearing was the parking/internal circulation pattern. The Commissioners were concerned that the outside storage of U-Haul trucks and trailers and recreational vehicles would completely encroach upon the existing parking spaces which are required for the self-storage facility. The inadequate parking spaces for such vehicles would encourage parking in areas which would exacerbate the on-site circulation patterns. Since the beginning of 1989, the Code Enforcement Officer and the Planning staff, have on numerous occasions, noticed the illegal parking of U-Haul trucks and trailers along the back and the west side of the northerly building, blocking the two-way traffic of the 25 foot driveway which is heavily used and shared by the adjacent commercial properties to the north and west of the project site. Despite numerous attempts by the City to rectify the situation, the applicant continued to violate conditions no. 30 and 31 of DP-348 which specifically prohibits parking of recreational vehicles and rental U-Haul trucks on the subject property. There was also concern that the parking of these vehicles would interfere with emergency access. Moreover, the parking of the 14 to 26 foot U-Haul trucks and recreational vehicles would generate traffic hazards, cause stacking of cars and maneuvering problems because of the length of the vehicles and the less than adequate size of some of the parking stalls. Another issue that was discussed at the hearing was noise. The movement of nine trucks and 35 recreational vehicles (though not necessarily all at the same time) would generate noise levels that would be disruptive to the noise-sensitive residential homes along the eastern property line of the project site, particularly during Sunday operations. Aesthetic impacts on adjacent properties was another source of concern expressed during the public hearing. The existing walls and landscaping do not represent an effective visual buffer for the adjoining single family residences, located 20 feet from the east property line and for those residences across Los Angeles Avenue to the south. Because of the nature of the wall construction (open wrought-iron fence with pilasters) along the street frontage, the storage of trucks and vehicles would be easily seen from Los Angeles Avenue. In addition, any outside storage along the west side of the building would be open to view from the major arterial street until the adjoining parcel to the south west of the site is developed. The existing plants are not dense enough to provide a visual enclosure and screen against the potential visual clutter and blight that would be generated if large trucks and vehicles are parked outside the buildings. In conclusion, because of the impacts previously discussed at the hearing and the failure to justify the required findings, staff recommends denial of Major Modification No. 1. However, staff would recommend approval of Minor Modification No. 3 to allow the installation of one public telephone, a vending machine and the sale of packaging materials, which are directly related to the self-storage operation. ADDITIONAL INFORMATION RECEIVED On December 26, 1989, the applicant, A to Z Self-Storage, wrote a letter to Mr. Paul Lawrason, the City Mayor requesting some changes to the original requests (Major Modification No. 1 to Development Plan Permit No. 348). The summary of his letter was to delete and modify some of the original proposals, as well as adding new ones. The Summary Sheet shown below illustrates the applicant's original and new proposals according to the above letter. Richards, Director of Community Development DATE: January 3, 1990 (CC meeting of 1-17-90) SUBJECT: DP-348 MAJOR MODIFICATION NO. 1 (A TO Z SELF-STORAGE) Page -4- In evaluating the new changes to the original major modifications, staff is concerned that the new proposals would still adversely affect the peace, safety, welfare, health, and quality of life of people residing and working in the immediate vicinity of the project site. While the applicant's withdrawal of the proposed outside storage of recreational vehicles and U-Haul trucks would lessen some adverse impacts on the adjacent properties, his new request to establish a broker-referral service onsite for U-Haul trucks may result in the same environmental and land use impacts that his original modifications would generate (although substantially less). Staff considers the broker-referral service for U-Haul trucks inappropriate for the M-1 zone because it is a commercial use not consistent with the intent and purpose of the industrial designated zone which does not allow it. It is neither a principally permitted use or accessory use. Moreover, this use is not considered auxiliary to the principal use of self-storage. As mentioned in the staff report (attachment 1, page 4), only those minor services which are related directly to the principally permitted use of self-storage, such as sale of packaging materials and the installation of vending machines and public telephones would be permitted. Staff believes that proposed broker-referral service for U-Haul trucks proposed by the applicant would only stimulate demand for the use of U-Haul trucks by the clientele of the A-Z Self Storage facility. Although there would not be a long term storage of U-Haul truck on the site, the increase use of these trucks by the clientele even, on a short-term basis, would generate heavy truck movements to and from the site therefore resulting in traffic congestion and hazards onsite. The size and nature of the site are just not suited to accommodate the expanded business ventures as proposed by the applicant. The heavy movement of trucks and the proposed extended hours of operation to include Sunday would aggravate the noise problem. The noise levels would be particularly disruptive to the nearby residents on Sundays. In relation to the applicant's proposal to rescind the Surety Performance Bond as part of the conditions of approval, staff strongly recommends that the City Council deny the request. Based on a long history of non-compliance by the applicant (refer to attachment 6) and the enforcement problems that the City had encountered, it is imperative that the City keep this condition to ensure compliance with all the conditions of approval if the modifications are approved.
