Community Development DATE: January 12, 1990 (CC meeting of 1-17-90) SUBJECT: CONSIDERATION TO PROCESSING A PROPOSAL FOR A HOTEL, RESTAURANT AND APARTMENT COMPLEX Back�.round Martin V. Smith & Associates of Oxnard -is requesting that the City Council determine the appropriate entitlement processing to develop a 7.5 acre site at the northeast corner of Spring Road and Flinn Avenue. The proposed. development includes €t hotel, restaurant and apartment complex. The Subject site is zoned M-1, Industrial Park District and is vacant. The surrounding land uses consists of railroad right-of-way w:itlh an existing track to the north., light- industrial to the south and east. Across from Spring Road to the west is a continuation of the railroad right-of-way (with track), light i.ndusl-.vial and single family residential uses. Discussion Staff's review of the City's current zoning code dial not list hotel, restaurant or apartments as a principally permitted use in the M-1 zone (Section 8141-1). Section. 8141-1.4 Conditionally Permitted Uses___( annin� - - ----- Commission) Subsection 1.0, lists "commercial and service type uses, which are intended primarily to serve the. needs of the M•-'I. District are compatible with the permitted type: of industrial uses or Will not interfere with the orderly development of the industrial area.". Richards, Director_ of Community Development DATE: January 12, 1990 (CC meeting of 1-17-90) SUBJECT: CONSIDERATION TO PROCESSING A PROPOSAL FOR A HOTEL, RESTAURANT AND APARTMENT COMPLEX Page -2- Inasmuch as hotel. is listed as a principally permitted use in the commercial zones, it appears technically appropriate to determine that the subject request requires a change in the General Plan Land Use Element Map and a rezoning of the property should the Council wish to allow this project to be processed as proposed by the applicant. The introduction of any type of residential component to the subject site will require a General Plan Amendment. Apartments are only permitted within the Multiple Family Residential (R-3) zone or Residential Planned Development (R-P-D) zone. As identified by staff in the past, processing a GPA outside of the current General Plan Update process undermines the intent of the current process and has the potential to foster other similar demands upon the City. Should this request be allowed to be processed outside the update process specific findings should be evidenced by the City. It appears that the following options are available to the Council: 1. Reject any request to process an entitlement application outside the City's standard processing until completion of the current General Plan Update; or 2. That the Council direct staff to process the hotel and restaurant portion of the proposal with a Conditional Use Permit (Section 8141-1.4.10) only if resolution of the balance of the property is made in conjunction with an indi.zstrial use; or 3. That the Council direct staff to process a General Plan. Amendment to commercial and related zone change (CPD) outside of the on -going GPA Update program. Staff Recommended Action Direct staff as deemed appropriate. As the council is aware there is a perceived need for a hotel in the city which would provide additional support to industry and commerce.The Channel Islands Hotel Group seems to be able to provide the quality facility we seek. While there may be some concerns in the design of the project,the committee feels the project offers a much needed facility that will be of great benefit to the community.
