SUBJECT: REQUIRED SETBACKS IN RESIDENTIAL ZONES
Back round
On November 1, 1989 the City Counl: i considered a report from staff regarding
the City's Patio Cover Policy (see attachment). Although a majority of the
discussion regarding this matter : Nlri ed to patio covers; there was some
concern voiced regarding setbacks. 'he C'ouncil's action was to refer this item
to the Community Development Commit ( P. To {are, the Committee has not met to
discuss this subject.
Discuss ion
The reason for setback standards wi .iin zoning codes stems a long way back in
history. The first setback occur' •d aithici the older eastern cities where
multi-story residential buildings I?• gan to (>e created in high concentrations
around industrial centers. Setback -tandard:; were imposed as part of a City's
Police powers to protect an adequn .. gnu ui,t ,f light and air to all residents.
Setback standards were then expandei to provide greater safety associated with
fire firghting requirements. In t Fest., at least for the past 50 years,

Second Story Decks (All Zones)
Two story homes proposing a i. :ond fl_.or deck or balcony are subject
to the same requirements as teir applicable zone. In addition, the
following requirements apply. A form provined by the Community
Development Department shall circulated to all adjacent property
owners. The respective owner• signatures shall be secured stating
that these owners have been r of the proposed construction.

Accessory Structures (All Zones)
1. An accessory structure, ttached of detached greater than sixty
four (64) square feet re..uires a Zoning Clearance.
2. An accessory structure, t:tached or detached greater than one

and a Building Permit .
3. May occupy no more than ,r-}• (40) percent of the required
rear yard.

Recommendation
Direct staff to revise the attached existing pool/spa and patio cover
requirements to add a policy for e.lclosed patio covers which establishes a
minimum distance of twenty (20) feet from the rear property line or
establish a setback distance that e City (:ouncil deems appropriate.

Background
Currently only two sections of th City Code address the subject of Patio
Covers, Section 8160-9. 1 and Sect .-n 8160-9.3. Section 8160-9. 1 refers to
detached patio covers and Section 160-9. 3 sets patio cover setbacks in the
rear yard at ten feet to the prop, Ly Line. In 1985 the Planning Commission
adopted a series of policies to cr 'r patio cover development. The policies
at that time had a number of _ncorisir:tencies and were difficult to
comprehend. On October 5, 1988, tl - City Council adopted a set of policies
concerning patio requirements. B. adopting as a policy rather than by
ordinance or resolution, a greats amount of flexibility is kept, should
the Council decide to make any sport ;ee
Discussion
In the past several months, appl - .ants have applied for patio enclosures
such as shown in the attached e>: iibits which are not considered a room
addition according to the Uniform Building Code, but are attached to the
main building and can be complet• :y enclosed. Although the UBC does not
consider these enclosures as rc• iti additions, staff has recently been
requiring setbacks for them tn::t .Jou1d he consistent with the setbacks
required for the main dwelling.
The purpose of the required rear r. d side setbacks is to provide light and
air (and which also mitigates cc •.ain fire problems) and to preserve an
open recreational area in the r( . vmrri .pile providing a buffer to the
adjacent property owner.
It is staff's opinion that the rent patio policy should he modified to
address these type of enclosures. Stag' i:: concerned that if this type of
patio encroaches to closely to pr, erty lines, they would infringe on the

In response to Councilmember F. rez, Mr Richards said that the
Community Development Directs had •.he authority to defer
decisions on applications to the City Council even if the
application met current standar
The Council discussed that a suostantial number of houses in the
City have a minimum yard and wp,uld be prevented from building a
patio cover if a 20 foot settack policy was adopted and that
applications made within curr•en gu delines should be granted.
Councilmember Harper suggested the Community Development
Committee review the matter and •eoort hack to the Council .
vtO MOTION: Councilmember Montgome y roved and Councilmember Harper
seconded a motion to refer this item to the Community
Development Committee for revir , and to allow permits which meet
all requirements of the existin ; ordinance to be processed. The
