Richards, Director of Community Development DATE: February 27, 1990 (CC meeting of March 7, 1990) SUBJECT: AGREEMENT BETWEEN: THE CITY AND PROPERTY OWNER TO PROVIDE INSTALLATION, MAINTENANCE AND REPAIR OF ASSOCIATED LANDSCAPING ON CALTRANS RIGHT-OF-WAY FOR DEVELOPMENT PLAN NO. 302; AND CALTRANS AND THE CITY FOR SAME Background MEMORANDUM On March 15, 1989, the City Council adopted Resolution No. 89-542 declaring its intention to enhance the aesthetic quality of State Route 118 by imposing on all future development requests a requirement to install meandering sidewalk and associated landscaping on all properties having real property abutting State Route 118 within the City of Moorpark. It was also the City Council's intention to enter into an agreement with the California Department of Transportation (CALTRANS), to accept responsibility for maintenance and liability of such meandering sidewalks and associated landscaping. A separate agreement between the City and the property owners has been prepared requiring property owners to accept responsibility for maintenance and liability within the CALTRANS right-of-way, for the meandering sidewalks and associated landscaping. The City Attorney has prepared the attached two separate agreements. The first agreement is between the City and CALTRANS and is designed to give the City permission to require developers to install and maintain meandering sidewalks and landscaping on CALTRANS rights -of -way fronting Highway 118. The second has been drafted in such a way that it can serve as a standard agreement between the City and property owners being required to install and maintain meandering sidewalks and landscaping. The agreement with CALTRANS was put into a format used by the State in hopes that CALTRANS will expedite approval of it. 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 Discussion On February 15, staff received the attached signed agreement and Certificate of Insurance for installation, maintenance, and repair of landscaping on CALTRANS right-of-way for Development Plan No. 302 (American Products). Please note that normally the City requires a meandering sidewalk on development projects. However, DP-302 was approved without a requirement for a sidewalk. It is necessary for the Mayor to sign this agreement as well as the attached agreement between CALTRANS and the City.
