SUBJECT: PD-1066 LISTON - REQUEST FOR TIME EXTENSION
Background
Planned Development Permit 1066 was approved by the City Council
by the adoption of Resolution No. 88-444 on February 3, 1988. As
a provision of approval certain conditions were imposed on the PD
permit. Condition 1C of the above resolution required the
applicant to use inaugurate the project within two years of
approval. There was an opportunity for the Director of Community
Development to grant a one year extension if the applicant had
delinquently worked towards inaugurating of the use and there had
been no changes in the adjacent areas .
On March 1, 1990 a meeting was held with the applicant at which
time it was disclosed that his request for an extension was not
received by the City in a timely manner.
On March 7, 1990 the applicant appeared before the City Council
under public comments requesting further consideration of this
matter. The Council referred the applicant's request to their
Community Development Committee so as to meet with the applicant
and staff.
Discussion
On March 12, 1990 the Community Development Committee, staff and
applicant met to discuss the extension request.

After discussing the background on what the applicant has been
accomplishing over the past two years; the Committee was in
agreement that there was no need to refile the PD application. The
Committee however was concerned that all outstanding road right-
of-way issues be resolved prior to granting any extension. The
Committee requested staff to prepare a list of tasks that would
need to be assigned a specific time frame. In this way there would
be clear identification of what was expected of the applicant.
There was an interest to accomplish as many public improvements as
possible prior to the issuance of a grading permit.
This additional work accomplished by staff, including a needed
Condition Amendment Resolution, will be paid for by Mr. Liston as
authorized by him at the Committee meeting.
Recommendation
Accept the recommendation of the Community Development Committee
to grant a one year extension subject to the applicant reimbursing
the City for extra work including the processing of a Resolution
of Condition Amendment and the applicants agreement to condition
changes and specific schedule of accomplishment as specified to in
a written agreement with the City.

PD-1066
1. Obtain Park Lane right-of-way, dedicated to City, before
issuance of Grading Permit or Encroachment Permit.
2. Obtain new Grading Permit (old permit expired 12/23/89)
and pay all current fees.
3. Obtain Encroachment Permit.
4. Complete all public street, storm drain utility and
undergrounding (to Los Angeles Avenue) improvements C.M �S
prior to issuance of Building Permit.

5. That applicant shall pay for all past due and
outstanding staff time spent regarding PD-1066 and
applicant shall pay for all current staff processing of
an extension request included but not limited to a
condition of amendment. All fees to be paid prior to
issuance of a grading permit.
