Gilbert, Director of Public Wo DATE: March 14, 1990 (Council Meeting 3- 21 -90) SUBJECT: Speed Limit on High Street OVERVIEW This presents for consideration a resolution changing the s;)ee!L limit on High Street bet weent Moorpark Avenue and Spring Road. DISCUSSION A. Background The current speed limit on High Street is 35 MPH. This limit was established in 1985 (Resolution No. 85 -258). It was based upon the recommended speed limit set forth in a speed study. Said recommendation, and the accompanying action setting said limit,, allows for the use of radar in the enforcement of the spea -j limit. B. It fines a "Business District" as (and the property contiguous i 3istance of at least six 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 RESOLUTION NO, 90 A RESOLUTION OF THE C1TY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, :REVISING THE SPEED LIMIT FOR HIGH STREET WHEREAS, Section 240 of the California Vehicle Code defines a "Business District" as that portion of a highway (and property contiguous thereto) which has, for a distance of at least six hundred feet (6001) on at l..ea:.t one side, buildings fronting thereon which are at least fi'-ty pet cent (50 %) occupied by business tenants; and, WHEREAS, High Street, between Moorpark Avenue and Spring Road is a local highway within such a "Business District" as defined in the aforesaid Section; and, WHEREAS, Section 22352 (b) 1) of said code provides for the establishment of a Prima Facie Speed Limit of twenty -five miles per hour (25 M.P.H.) upon any Local street or highway in any "Business District ". NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That Resolution No. 85 -258 is hereby amended by deleting therefrom reference to Location No. 9: High Street -- between Moorpark Avenue and Moorpark Road. SECTION 2. That, pursuant to Section 22352 (b) (1) of the California Vehicle Code, the Speed Limit: for High Street, between Moorpark Avenue and Spring Road, i.s hereby declared to be twenty - five miles per hour (25 MPH). SECTION 3. That the City Manager is hereby directed to remove any existing speed limit signs within said roadway segment, and provide for the posting (or non- c ,)ost.ing) of speed limit signs as may be required by law. High Street, between Moorpark Road and Spring Ro,id, satisfy the requirements of this definition. D. Radar Enforcement Although the Code allows for* the setting of a 25 MPH speed limit on High Street as described above, the City could not use radar in the enforcement of this designation without a speed study containing findings and recommendations in support of this speed lim_i' . E. Speed Study The City proceeding with the efforts necessary to have a speed study prepared for certain streets throughout the City. High Street will be one of the street segments to be studied. CONCLUSIONS PRO: It is possible that lowering the speed limit on High Street to 25 MPH could have a positive impact in lowering vehicular speeds in the downtown area. CON: Radar enforcement w.i1a_ not be possible unless and until this limit is supported by a speed study. RECOMMENDED ACTION Lower the speed limit on High Itreet by adopting the attached Resolution NO. 90-
