Senate Bill 1764 1 ansportation Corridor Conservancy
Senator Leonard has introduced a iiiil that would provide for the
acquisition and preservation of ;nd for transportation purposes. This
would be accomplished through the Mate Transportation Corridor
Conservancy that would be :onposed Of California Transportation
Commission members. The conse+'vincy would be authorized to use funds
appropriated for its use and he proceeds form the sale of land,
through eminent domain, to set Adp land for future roads, highways,
and mass transit.
The Bill would provide more f'le> b lity n transportation planning and
management. The Ventura Count I ran sportation Commission staff are
supportive of the Fill and anti,; 3t(- f7mmn is—,ion support.

Senate Bill 2011 General Plan Housing Element –
Discretion Over Approval of Low and Moderate Income
Housing Projects
( Senator Greene has introduced a Bill that would remove the discretion
to determine conditions for tae levelopment of affordable housing
projects. These projects wou'c es,,entially be mandated unless a) an
adequate housing element has beF,n adopted, b) a project is not needed
to meet the regional housing pare, and c) a project would have an
adverse effect on the public: t -a'th o, safety that is not feasibly
mitigable. It would be nearly to meet these findings.
While affordable housing is a r tical problem throughout the State, SB
2011 would attempt to solve ,.t p,oL.lem by removing the ability to
plan. The loss of discretionq t de,.er•mine the sighting and density of
a development project is the Ic, ,, —rt'rl over local planning.
Staff Recommendation,
It is recommended City Counc l t' r r zf the Mayor to send a letter in
opposition to SB 2011.

Representative McClintock has irrt.rocfuced a Bill that would change the
definition of "dangerous condit, n ". The new definition would exclude
any risk of injury caused by j: o public or adjacent property in a
manner which is unlawful, carp es�, c• not reasonably foreseeable.
This change would help reduce ?i, gat',�n end the associated costs.

Last year the State Bar adopter a -ule that required the payment of
plaintiffs' attorneys fees but: th -, `sate Supreme Court rejected it. AB
3458, introduced by Representat yr, Friedman, is another attempt to
obtain the payment of these fees -he dill would prohibit settlements
unless these fees are paid. C+:r- seauently, litigation costs would be
anticipated to increase along wit the nun)ber of cases filed.
Staff Recommendation
