Appointment of Tenant Commissioner for
Housing Authority
Attached is a letter from the Area Housing Authority of the
County of Ventura concerning the subject matter. This item
will be placed on the agenda for Council consideration at the
April 4, 1990 meeting.

The 15- member Board of the Area Lous:rng Authority consists of two
Corrmissioners from each of the seven pai'tic.ipating jurisdictions and one
Corrmissioner who is a tenant of our ]housing programs. In accordance with
Section 34246 of the California Heald, and `safety Code, the governing
bodies which are party to an agreement to form an area housing authority
have the responsibility to jointly apl_oin7. the tenant commissioner. A
photocopy of the language contained it Section 34246.5 of the California
Health and Safety Code is enclosed for your review. While no specific
procedure for this appointment is set forth in the code, two years ago
the Area Housing Authority adopted a procedure for its own use. The
Authority, in response to its solici.t,:tic>n of public housing residents
and Section 8 program participants eceived three applications from
tenants interested in serving as a tenant cornnxissioner together with the
incumbent tenant commissioner who has dicated her willingness to serve
another term.
Th.e Area Housing Authority is subin,'ting, or your consideration, the
name of Virginia Hall incumbent tenant: con- missioner, for re- appointment.
The term for Mrs. Hall, a tenant of our Section 8 Existing Housing
Assistance Program, expires on Marc ;71., 1990. Therefore, it is
necessary that a tenant corrmissionc he appointed for the period
beginning April 1, 1990. If your coii:ci' desires to re- appoint Mrs.
Virginia Hall for the two -year period nding March 31, 1992, kindly have
a resolution adopted to make that appoirArneni. If your Council desires
to appoint another person as the ? nant commissioner, kindly adopt a
resolution naming that individual. File requirement is that the
appointment must be a tenant of a h(_sing program of the Area Housing
Authority. We would appreciate rece.iviig notirication of your action no
later than April 20, 1990 in preparai'on for our Board meeting on April
26. As soon as any four of the severe jurii.sdictions served by the Area
Housing Authority have appointed cn,, ndivi.dual, our legal counsel has

Section 34246.5 of the California NEalth anc Safety Code
34246.5 (a) The governing bodies party to an agreement entered pursuant
to Section 34246 ( Sectior governing the creation of an
area housing authority notation added) shall jointly appoint
a tenant of the area housing authority as commissioner
of such authority. I� the area housing authority does
not have tenants, the governing bodies shall appoint a
tenant of the area housi,ig authcrity to the commission
within one year after -h a,.ej housing authority first
does have tenants.
(b) The appointment of a tenar commissioner shall be in lieu
of the appointment of a :ommissioner at large pursuant
to Section 34246. If a corrunissioner at large is in office
on the effective date ,f this section, the tenant
commissioner initially appointed shall take office at such
time as the term of the commissioner at large shall expire.
(c) The tenant appointed as commissioner shall serve for
a term of two years, but on`�; so long as he remains a tenant
of the area housing author ty. W ::1 successors shall also
be tenants of the area ,.,using authority and shall be
appointed jointly by tie Iovern11nq bodies for terms of
two years, except that a cane hall be filled for the
unexpired term.
(d) A tenant appointed as i commissioner shall have all the
rights, powers, duties, pr ileges and immunities of any
other commissioner.
