SUBJECT: Tracts 3019 & 3525 (Warmington) Landscaping Bonds
BACKGROUND INFORMATION:
Tracts 3019 and 352.5 are located in the Peach Hill area of the City.
The areas of landscaping involved with this project is described as
follows and as outlined on attached Fxhibit "A."
Area A: Streetscape on west side of Peach Hill Road beginning
at Williams Ranch Road extending south to Tierra Rejada
Road.
Area B: Streetscape on north side of Tierra Rejada Road
beginning at Peach Hill Road extending west to Edison
right -of -way.
Area C: Streetscape /slope on south side of Tierra Rejada.
beginning at Peach Hill Road extending south to Edison
right -of -way and strF!etscape on east and west sides of
Pheasant Run and Brook.dale between Tierra Rejada Road
and Westport.
As part of their subdivision improvements, Warminciton Homes posted the
following bonds for landscaping:

Staff has inspected the landscaping improvements and have found all to
be in order except the parkway ground cover on the north side of Tierra
Rejada between Peach Hill Road and the Edison right -of -way.
The ground cover in this area is in a declining state and has been
reviewed by Fruit Growers Labs and Paul Rogers Landscape Architect.
The general opinion rendered after review of the area is that it has
been over watered and under fertilized. Analysis recommendations were
to reduce watering of the area and increase fertilizing, which
Warmington Homes has done and the area is improving.
Additionally, due to the recent drought conditions we are experiencing,
staff asked our landscape contractor, Turf Pro, to review the area and
recommend an alternate ground cover to replace the existing ground
cover (creeping red fescue), which is a high water usage ground cover.
Turf Pro is recommending Gazanias be planted. Their cost to remove the
existing ground cover and replant with Gazanias is $5,000.
Staff contacted Warmington Homes and presented the proposal to replace
the ground cover on a equally shared basis; $2,500 each and the City
would accept the area as completed. The offer was accepted by
Warmington Homes. In addition, Warmington has agreed to pay the cost
for the City to assume contract maintenance of these areas effective
April 19, 1990. A copy of Warmington's acceptance of these proposals
is attached.
STAFF RECOMMENDATION:
1. Accept the area landscaping as complete.
2. Accept Warmington Homes offer of $2,500 to share cost of replacing
the ground cover as outlined.
3. Authorize the City Clerk to exonerate bonds #945012 and 9450105.
4. Assume maintenance of subject area effective April 19, 1990,
provided Warmington Homes deposits $3,400.00 plus costs identified
on #5 below.
5. Warmington Homes to reimburse City for all costs relative to
landscape review of this area prior to acceptance of area by City.

Dear Mr. Gilbert:
I am in receipt of Mr. Newhouse's letter dated April 6, 1990
regarding the transferral of landscape areas within the subject
tracts.
Warmington agrees to share a 501 cost of replacement of ground
cover or a total of $2,500.00 (letter item #1), and a 501 cost for
maintenance for the remaining month of April 1990 or a total cost of
$900.00. Upon confirmation of City Council's acceptance on April 181,
1990, we will forward a check for $3,400.00.

As discussed, the following arrangements have been agreed upon by
Warmington Homes and the City for transference of the landscape areas
within the subject tracts to the City of Moorpark:
1. Warmington Homes pay the amount of $2,500 to the City which
represents one -half the costs to replace ground cover on the
north side of Tierra Rejada Road between Peach Hill Road and
Edison right -of -way.
2. City will assume maintenance of subject area effective April
19, 1990. Warmington Homes to pay the sum cost of $900 to
the City which represents one -half the monthly maintenance
costs of subject area.
These arrangements are contingent upon City Council's acceptance of the
areas which will be considered at the Ci-y Council's April Io, 1990,
meeting.
Additionally, as indicated, I will be out of town through the 17th of
April. Additional assistance or information may be directed to the
attention of Ken Gilbert, Director of Public Works.
