AD- 85 -1", AND ORDERING PREPARATION OF THE ENGINEER'S REPORI Annual assessments for the Park Maintenance Assessment District (AD -85 -1) are determined through ,.,he preparation of the Engineer's Report. This report (which is rry(,uired by State law) evaluates the benefits received by various c:la,:,e,, of properties and spreads the costs according to an approved method of distribution. The estimated annual maintenance costs and requ site maintenance program are also part of the report. A copy of th- Frgineer's Report for the current year has been previously provided the Council.. As the Council may recall, Dwight French and Associates submitted a two -year proposal in 1989 for the pr- eparation of the Engineer's Report for AD -85 -1. The cost for the FYP9 -90 report was $3,700 plus direct expenses. The cost for the FY9' 9' report is $2,900 plus direct expenses. SECTION 2 DESCRIPTION OF THL- 1f"UQYEMENTS TO BE MAINTAINED The following City Parks are to k)e iint:ained under this District effective July 1, 1990: CAMPUS PARK PAUL GRIFFIN SR. PARK COMMUNITY CENTER MONTE VISTA NATURE PARK GLENWOOD PARK PEACH HILL PARK NORTH VILLAGE PARK LA COLONIA In addition, the City also owns additional unimproved acreage for park purposes designated on the attached boundary map as locations 2 and 6. SECTION I ASSESSMENT ROLL All parcels of real property affected are lasted on the "Assessment Roll ", Exhibit A, which will be on file in City Hall with the City Clerk, and is made a part hereof by reference. These parcels are more particularly described in maps prepared in accordance with Section 327 of the Revenue and Taxation Code which are on file in the office of the Ventura County Asfiessor in the County Government Center Administration Building, BOC S. Victoria Avenue, Ventura, California and which are also ma,�le i p.tri. �iereof by reference. MAO XUDKONKNO-10 The estimated costs of operating ttie prop(::)sed District are shown in Appendix "B" of this Report. The Landscaping and Lighting Act of 1972, in Section 22573, states that "The net amount to be assesaed upon the lands within an assessment district may be apport3laned by any formula or method which fairly distributes the new amount among all assessable lots or parcels in proportion to the c t;t imat.ed benefits to be received by each such lot or parcel from th( impt :ovementn." The method and formula of benefit spread recognizes that every property within the City of Moorpark benefits from public parks and recreation facilities. The method of spreading maintenance osts is based upon the "people use attributed to each land use within the City. This method was chosen because the benefit received by having park facilities is directly proportionate to the number of people generated by each land use. Recognizing that residential land uses within the City derive a higher degree of benefit: than non- residential land uses, the formula was subdivided into t:wo main groups, with residential land uses contributing in 75% of the assessment and non - residential uses being assessed for the remainin_1 25% of the maintenance costs. The benefits to residential land uses are clear. The residents of the City utilize the parks during their leisure hours. Benefits to non - residential property include such items as offering employees the opportunity to utilik;e the parks during lunch time and after hours, as well as provi(ling an aesthetic environment which attracts potential employees .ntD the area. The "people use" factors utilized it the assessment district spread formula are shown in Appendix "A" In conclusion, it is our opinion th,it the<-issessments within Parks Maintenance Assessment District No AD -85-1 are apportioned by a formula that fairly distributes t.hc net cost to each lot or parcel in accordance with the benefits thant are received.
