SUBJECT: REQUEST FOR GENERAL PLAN LAND USE ELEMENT AMENDMENT AND
REZONING (GISLER)
Background
When the City considered updat_ rig the Land Use and Circulation
Elements of it's General Plan, it. received a number of requests for
land use amendments. One of thos requests is the subject of this
memorandum.
On March 8, 1990 the City received a letter from Mr. Brian Kelly,
an attorney representing Mrs. Charles J. Gisler regarding a request
to amend the General Plan and r +zoning of the property at 635 N.
Los Angeles Avenue (see attached map and letter).
The subject parcel is four acres located on the north side of Los
Angeles Avenue approximately 150 feet: east of Shasta Avenue. The
property is zoned R -1 -8 (Single f.timily Residential minimum lot size
of 8,000 sq.ft.). The General •la.r. designation for the property
is Medium Density (3,1 - 5 du /a :: 4 dr. /itc average) .
As noted above the subject property had at one time been one of
several requests for land use amendments to be considered as part
of the City's General Plan Update process. This specific amendment
request was withdrawn once the #sir share cost of processing the
request was known to the propert... c,wner
Discussion
At this time it is unclear whether Mr. Kelly is requesting
inclusion into the current updat( process or desires approval for
a separate General Plan Amendmer application process. Inasmuch

as the update process is well underway any such inclusion of
another General Plan Amendment request would require a revision of
the City's current contract with PBR. the consultant contractor.
Should this application be processed separately outside of the
current General Plan Update it would undermine the intent of the
current process and has the potential_ to foster other similar
demands upon the City. If this request is allowed to proceed;
specific findings should be evidenced by the City.
Staff Recommendation
That the City Council deny the request of Mr. Kelly on behalf of
Mrs. Gisler to process a General Plan Amendment for the four acre
parcel known as 635 N. Los Angeles Avenue.

Dear Honorable City Council Menlfirs:
I am writing on behai:. of my Grandmother, Mrs. Charles
J. Gisler, to request that you consider allowing her to renew her
application for entitlement to Gt!neral Plan Amendment and Zone
Change. My grandmother has livc =l in Moorpark at her current
residence since 1929. Obviously, significant changes have
occurred in the development patrcirns in Moorpark over this time.
In fact, the 1972 -1974 Moorpar)-. general Plan designated her
property as Commercial.
On March 28, 1989, my grandparents submitted, through
Mr. John Newton, their application and fee for General Plan
Amendment and Zone Change to the City Council. Shortly
thereafter, on May 31, 1989, my grandparents requested that their
application be withdrawn. Theik application withdrawal was
motivated, in part, by the increased costs associated with their
application and representation ly Mr. Newton. My grandfather has
since passed -away and my grandmut.her is interested in the
possibility of relocating to b(i ;:loser to the family. However,
the current zoning of her prope:i:tty at 635 N. Los Angeles Avenue
is for medium density residentio.,. which appears to be
inconsistent with the development: along this busy highway (the
property adjoining my grandmoth(t's is to be developed into a new
shopping center). As a result t:he value of her property is
substantially reduced.
Because of this perceived inequity in value under the
present zoning for her property she if; again interested in
renewing her application. I w-� ; call each of you in the near
