Richards, Director of Community Developmentf /a.L DATE: June 1, 1990 (CC meeting of 6/6/90) SUBJECT: Bollinger Development Corporation Proposal - General Plan Amendment/Commercial Use Consideration Background Since January of this year the Bollinger Development Corporation has been seeking the authorization from the city to create a golf course, with club house, possible tennis club and equestrian center, single family residential home sites and a future church site, on a 510 acre site located in the northwest area of the city. At the meeting of May 16, 1990 , the Council took action to allow the project to move forward inasmuch as it was found to be within the bounds of Resolution 86-318. This resolution allows clustering within the RE zone. Discussion Since the council's action of May 16, 1990 the following questions have arisen: 1. Inasmuch as the area where "clustering" will take place, is a higher density than that listed under the General Plan; should there be a General Plan Amendment/Rezoning processed with the other entitlement requests for this project? 2 . Inasmuch as the golf course club house, tennis club, and equestrian facilities are commercial enterprises; should the zoning be changed to reflect a commercial use? 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 t The Honorable City Council (CC meeting of 6/6/90) May 30, 1990 Page 2 Regarding the question related to General Plan Amendment/Zoning; there is the city's practice as it relates to the Mountain Meadows Project. In that project, as areas are developed, the density actually created is listed. Regarding the need for rezoning; the above uses are listed as permitted with approval of a conditional use permit. Section 8123-1 lists golf course club house, in connection with a regular golf course, a driving range; Section 8123-20 allows restaurants within golf course clubhouses. Section 8123-22 states that sport, athletic, recreational and amusement enterprises operated as a club or business or for commercial purposes is allowed with a CUP. It would appear the tennis club and equestrian center, would appear to fit into this section. Staff is seeking council's direction regarding whether or not a General Plan Amendment or rezoning is necessary for this project. Staff Recommendation Direct staff as deemed appropriate.
