Traffic Study Scope of Work - McDonald's General Plan
Amendment Proposal
Background
Since July 1989, the McDonald's Corporation has been seeking the
opportunity to propose a General Plan Amendment outside the General
Plan update process for a property located at the northeast corner
of Spring Road and Los Angeles Avenue. On October 4, 1989 the
Council advised the McDonald's Corporation that some consideration
would be made towards a separate General Plan Amendment if a
Traffic Study were to be provided meeting specific City criteria.
The scope of this required Traffic Study has been the subject of
subsequent council discussions and several meetings with
representative from McDonald's.
Discussion
On April 16, 1990 staff received a letter (see attached) from
Patricia Howard, McDonald's representative requesting
reconsideration regarding the scope of the traffic study required
to proceed. Ms. Howard is requesting that McDonald's pay up to
$ 5,000.00 to have a traffic engineer work with the City's Traffic
Consultant, Austin -Faust Associates, to add to the work currently
being done by the city. The timing related to Ms. Howard's
proposal is unknown. It is not clear whether or not McDonald's is
still seeking a separate processing or will remain within the
General Plan update. It is assumed that they are requesting
separate processing. The current General Plan update schedule

will be changed because of the addition of the Sphere of Influence
Study.
Staff's position regarding separate GPA processing has not changed
from that previously stated. The General Plan update is well
underway and should reach it's conclusion nearly on schedule.

McDonald's has for sometime been involved in the above referenced
property. We have had several conversations with you regarding
the developing of a small retail center and a McDonald's at this
location. The total GLA is 38,620 square feet which translates to
a 23% coverage, low by any standard.
We feel confident that can we design this shopping center property
and lay out the McDonald"s property so that this development will
compliment this intersection and bring some well needed retail
service to Moorpark. Be that as it may we have had problems
moving forward on this project for the following reasons:
We were required to do a ten intersection comprehensive traffic
study which would be prohibitive in cost and duplicative in
efforts and probably not credible as the one the City has
contracted Austin Faust Associates to conduct.
We have been working with Pat Richards to come up with a
compromise position that will protect the interest of Moorpark and
at the same time provide an equitable treatment for us regarding
this project. However, Mr. Richards cannot mandate anything
different that what was agreed to at the October 4, 1989 hearing
without your written approval. Therefore, we are respectfully
requesting that you approve the following change in the above
referenced scope of work.
McDonald's would pay the City $5,000 to request a proposal (RFP)
from several traffic engineers to conduct a study of the subject
intersection and this engineer will work in cooperation with
Austin Faust Associates such that his or her efforts will be
additive rather than duplicative.
Mr. Richards informs me that in order to make this change, the
City Council must revote.

schedule a hearing date for us, at which time I will make a formal
request.

Mayor Brown stated her concerns regarding the traffic and
impacts of the 118/23 connection and indicated that the traffic
analysis was to determine whether there would be an improvement
in traffic. She said that improvement should be clearly
demonstrated.
Councilmember Montgomery said it should only be necessary to
analysis the intersection of Spring Road and Los Angeles Avenue
and not the others proposed in the scope of work.
After further discussion by the Council on what the scope of
work would include, the following motion was heard:
MOTION: Councilmember Montgomery moved and Councilmember
Lawrason seconded a motion to assign review of the scope of work
to the Community Development Committee who would meet with staff
and a representative of McDonald's Corp. and report back to the
Council. The motion failed on a voice vote of 2 - 3,
Councilmembers Harper, Perez and Mayor Brown dissenting.
MOTION: Councilmember Perez moved and Councilmember Montgomery
seconded a motion to strike No. 8 (provide an analysis of the
effects of the extension of New Los Angeles Avenue to Collins
Drive as it would relate to the subject site) and No. 9 (provide
an analysis of project impacts on at least two other sites in
the City, one of which must be a mid -block site); No. 5 was
amended to identify project impacts to the following
intersection estimated and existing project level of service for
each of the following scenarios: a) existing, b) cumulative,
including Carlsberg Specific Plan and all filed projects but not
the components of the General Plan update, and C) ultimate
cumulative including the cumulative project list and Carlsberg
Specific Plan and the components of the General Plan update.
'The voice vote was unanimous.
CONSENSUS: By consensus the Council determined to go with scope
of work as amended.
E. Consider Minor Modification No. 1 Residential Planned
Development No 1071 (Tract 4341) and 1072 (Tract 4342) and
Minor Modification No 2 to Residential Planned Development
No 1070 (Tract 4340) - Urban West Communities; a report
regarding modification to floor plans, elevations and
common landscaped areas for the West Village. Staff
Recommendation: Direct staff as deemed appropriate.
Councilmember Lawrason suggested a contribution on the part of
Urban West to be used in the first phase of the Arroyo Vista
Community Park of $100,000.
Tom Zanic, of Urban West, in response to Councilmember Lawrason
said that in consideration of their request they would agree to
the park contribution.

C. Consider Request from Plannin Commission seeking direction
from the City Council concerning Draft Hillside Performance
Standards. Staff Recommendation: Create a technical
committee to make recommendations regarding this matter.
Councilmember Harper stated that without protection there would
not continue to be open space on the hillsides. He further
indicated that he would like to take out the language which
exempted specific plans.
Councilmember Montgomery said he would like an analysis of the
compatibility of the proposed ordinance with the General Plan.
Mayor Brown indicated that she was concerned with the valley
floor.
Mr. Kueny suggested that the Community Development Committee
meet with two Planning Commissioners and staff and report back
to the Council.
MOTION: Mayor Brown moved and Councilmember Montgomery seconded
a motion to move the joint meeting with the Planning Commission
to October 30, 1989. The voice vote was unanimous.
' After discussion by the Council of the composition of the group,
the following motion was heard:
MOTION: Councilmember Montgomery moved and Councilmember Harper
seconded a motion to have the Community Development Committee
meet with Planning Commissioners Wozniak and Scullin and staff
on the Draft Hillside Performance Standards; a report to be
compiled for discussion at the October 18, 1989 Council
meeting. The voice vote was unanimous.
D. Consider Proposed Traffic Study Scope of Work for N.E.
Corner o?—'New Los Angeles Avenue and _Spring Road
(McDonald's). Staff Recommendation: Direct staff as deemed
appropriate.
Councilmember Lawrason indicated that he had concerns about the
extensiveness of the scope of work.
Councilmember Harper said the City would very much like to have
a McDonald's in the City but that the site selected was
inappropriate because of the existing traffic and the potential
impacts of the 118/23 freeway connection. He indicated that
other possible sites should be considered.

all costs associated with the analysis, including staff time
and, in addition, to pay their share of the General Plan Update
costs during the intervening time; and no promises for approval
of the project to be implied. Motion carried with Councilmember
Harper dissenting.
11. F. Consider funding intracity bus service for Moorpark Country
Days Event. Staff Recommendation: Approve transfer of
reserve funds for Moorpark Country Days event.
MOTION: Councilmember Harper moved and Councilmember Montgomery
seconded the motion to approve staff recommendation to
appropriate $345 (including 10% contingency) from the general
fund reserve for intra -city bus service during Country Days; and
approve the routing of the bus and the absence of a fare during
Country Days. Motion carried unanimously by roll call vote.
11. H. Consider adopting Resolution No. 89 -611 to restrict parking
on south side of Hearon street between Monroe Avenue and
Collins Avenue. Staff Recommendation: Approve Resolution
No.89 -611.
MOTION: Councilmember Montgomery moved and Councilmember Perez
seconded a motion to approve Resolution No. 89 -611. The voice
vote was unanimous.
11. J. Consider Resolution 89 -612 accepting membership in the
Southern California Joint Powers Insurance Authority_
Staff Recommendation: Approve Resolution 89 -612.
MOTION: Councilmember Harper moved and Councilmember Perez
seconded a motion to adopt Resolution No. 89-612, executing the
agreement between the 'Authority and the City, and to authorize
staff to convert liability coverages from the previous carrier
to the Authority; to authorize obtaining tail coverage with a
$25,000 S.I.R. back to 1986; and establish a reserve for claims
of $45,000 ($25,000 for tail coverage and $20,000 for the
Authority S.I.R.) by designating an additional $35,000 of
General Fund Reserve for this purpose. The voice vote was
unanimous.
11. L. Consider Awarding Contract for Annual Overlay Project.
Staff Recommendation: Award contract to S.P. Milling
Company.
John Knipe indicated that the budget for this project is
$210,000. However, the City will be receiving
approximately $238,000 in FAU funding for a total of
$448,000. The FAU funds can be used for other projects,
Ebut is recommended for use at this time since this project
F� has already been bid and is ready now for construction.

Mayor Brown indicated she would like to see the plans for
the balance of the site.
Armend Collen stated he would like to present the plans for
the entire parcel, but the current zoning is inconsistent
with a commercial application. He is requesting that they
be pulled from the General Plan Update process. They have
already waited two years and another two years is not
financially possible. He stated that they are successful
because they find appropriate locations. Mr. Collen also
stated that they have located McDonald's at busier
intersections. He indicated he only wants an opportunity
to bring -the project before the Council.
Mr. Manual Asadurian, part owner of the property, stated
McDonald's is the best restaurant for the property and that
a quality project will be built.
MOTION: Councilmember Harper moved that the applicant work with
staff to develop the scope of the traffic study conducted by a
designated traffic engineer, paid for by the applicant; that the
traffic analysis will determine what is the present level of
service of that interseciton and what is the likely level of
service in that intersection after the proposed McDonald's goes
in that location; and after the results of the traffic analysis
are completed and brought back to the Council, determination
will be made whether to pull the project from the General Plan
Amendment. Motion failed due to lack of a second.
MOTION: Councilmember Montgomery moved and Councilmember
Lawrason seconded a motion to allow the applicant to separate
from the General Plan Update and to direct the staff to prepare
a scope of work which would include a traffic analysis to be
brought back to the Council for review at the earliest possible
date; the traffic analyst to be selected by the City and the
traffic analysis to be of the entire site; the applicant to pay

MOTION: Councilmember Harper moved and Councilmember Montgomery
seconded the motion to authorize Mayor Brown and Councilmember
Lawrason to attend the League Convention and designate Mayor
Brown as voting delegate for 1989 League of California Cities
Annual Conference and Councilmember Lawrason as voting
alternate. The voice vote was unanimous.
Mayor Brown requested that Lt. Rodriguez return with information
from the Van Nuys station of the Los Angeles Police Department
regarding their program for citizens allowing police to stop
citizens at any time between 1:00 to 5:00 a.m.
11. I. Consider restructuring of Youth Dance Program. Staff
Recommendation: Direct staff as deemed appropriate.
Phil Newhouse, Community Services Director, presented a
modified recommendation that the dance include 7th to 9th
graders and eliminate Identification Cards and use computer
printout of enrollment. This would include 12 to 15 year
old students. After discussion, staff suggested changing
the grade levels at the dance to include 7th to 10th grades.
MOTION: Councilmember Harper moved and Councilmember Montgomery
seconded the motion to approve amended staff recommendation with
a change to the grades for the dance attendance to 7th to 10th
grades. Motion carried unanimously by voice vote.

Councilmember Montgomery stated that McDonald's should be
allowed to present their project. He stated he opposed
zoning this site for multi - family residential use and that
the corner should be a commercial land use. He also
recommended that McDonald's use their own money to produce
a proposal to be evaluated by the Council.
Councilmember Harper stated that the McDonald's project and
the balance of the property will be addressed during the
General Plan Update. He stated that a fast food restaurant
with traffic impact has no obvious benefit to the community
for fast tracking. He stated there are other sites in the
community which would be appropriate locations for. a
McDonald's.
Councilmember Perez stated that a well- designed
self- contained multi - family project could work. He
requested more information regarding the remainder of the

Dear Councilmembers:
For your review, the following is a brief summary highlighting the significant
issues which I have addressed in tonight's presentations.
1. What are McDonald's weak hours? McDonald's experiences different weak
hour characteristics than does the adjacent intersection.
The peaking characteristics of a McDonald's restaurant occurs during the
weekday noon hours and Saturday. Peak commuter demand at the adjacent
intersection occurs during the morning and evening hours from 7:00 a.m. to
8:00 a.m. and 5:00 p.m. to 6:00 p.m. This is consistent with our national
studies.

2. How does the drive -thru impact traffic?
The drive -thru window does not appreciably increase traffic entering the site
during week�ay peak hours at the adjacent intersection.
About 45% of our customers use the drive -thru causing a sales increase of
12%. This increase sales is spread over 365 days, 17 hours a day with most
occurring from 6;00 p.m. to 7:00 p.m.

CONCLUSION:
We are respectfully requesting that the scope of the traffic study required by
the City of Moorpark relating to the subject location be initially confined to
the subject intersection for the following reasons:
1. McDonald's is primarily an impulse business, a traffic diverters
contributing only 1.3% new traffic to the intersection:
2. McDonald's is not a traffic generator.
-3. McDonald's peak hours (noon weekday hours, and Saturdays) are not the
peak hours of the adjacent intersection.
4. The addition of the drive -thru causes the movement of customers through
the site to be-more efficient and faster when operated properly and
when provided with adequate stacking.
5. McDonald's has the ability to create and maintain a "show case"
restaurant which will enhance this very visible intersection.
All information provided to you today can be thoroughly documented from
independent studies conducted by Barton - Aschman Associates, Inc. and Thomas S.
Montgomery & Associates.
