HARE City Treasurer MEMORANDUM 10: The Honorable City Council FROM Craig Phillips, Administrative Assistant GP DATE: May 21, 1.990 (for CC meeting of 6-6°-•90) SUBJECT: AD-84-2 (Public Hearing) The Lighting and Landscaping Maintenance Assessment District (AD-84•-2) was formed in May 1984. Assessment:., -in this district have been levied every year since FY84-85. At its meeting on May 16, 1990 the Council approved the Engineer' s Report (copy enclosed) . The report describes the improvements to be maintained in AD-84-2 as well as the method of assessment. The proposed assessments for lighting and landscaping for a single family level 1 home are $21.37 and $9.85 respectively for a total annual assessment of $31.22. This compares to $39.66 in FY88-89 with $24.56 for lighting and $15. 10 for landscaping. The total projected budget for street lighting in FY90-91 is $200,000. The primary benefits derived from street lighting are for safety and are determined from zones of benefit for use, security, and intensity of illumination. The City is currently responsible for approximately 1, 795 street lights, The total projected budget for citywide landscaping is $169,755. This total includes 13 median islands, pepper tree spraying, tree removal , trimming and replacement, weed abatement, and miscellaneous improvements. The purpose of the public hearing is to hear objections to the proposed work or extent of the assessment district. 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 The Honorable City Council June 1, 1990 Page 2 Staff Recommendation That the City Council : 1) Open the public hearing, take testimony, and continue the hearing to June 20, 1990. 2) Defer consideration of adoption of Resolution 90- confirming the assessments for lighting and landscaping until June 20, 1990. 3) Review the proposed budget for AD 84-2 in conjunction with the Council ' s review of the proposed FY 90-91 City Budget. DCM.89564 { ITEM �• �• RESOLUTION NO. 90- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, MAKING CERTAIN CHANGES TO THE "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD- 84 -2 "; AND CONFIRMING THE ASSESSMENT FOR SAID DISTRICT FOR THE FISCAL YEAR COMMENCING JULY 1, 1990 AND ENDING JUNE 30, 1991. WHEREAS, the City Council of the City of Moorpark, by Resolution No. 90 -668, adopted May 16, 1990, declared its intention to make certain changes to the "Moorpark Lighting and Landscaping Maintenance Assessment District No. AD- 84 -2 ", and to order the extension of the annual assessments for said district for the fiscal year commencing July 1, 1990 and ending June 30, 1991; and WHEREAS, said "Moorpark Lighting and Landscaping Maintenance Assessment District No. AD -84 -2" consists of a single city -wide zone to provide electric current or energy for public lighting within the City, to provide for installation or maintenance landscaping and the construction or maintenance of curb, gutter, or sidewalk structures and facilities, to install or construct facilities which are appurtenant to any of the foregoing, for the maintenance or servicing or both, of any of the foregoing and to provide incidental expenses in connection therewith; and WHEREAS, on June 6, 1990, the City Council held a public hearing to determine whether said changes to said district should be made, and whether the annual assessments should be ordered and confirmed for the fiscal year commencing July 1, 1990 and ending June '30, 1991; and WHEREAS, at said hearing no written protests to proposed changes to, and to the annual assessments proposed to be levied for, said Assessment District No. AD -84 -2 were received by thf� City Council; and WHEREAS, the City Council overruled any and all protests; and WHEREAS, the City Council determined that it had authority to proceed with the changes to and extension of annual assessments for the fiscal year commencing July 1, 1990 and ending June "10, 1991.. 0 NOW, THEREFORE, THE CITY COUNCII. OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The report of the Engineer, as filed on May 16, 1990 is hereby approved and adopted, and the improvements, changes to, and extension of the annual assessments in the Assessment Oistrict, in accordance with said report and in accordance with Resolution No. 90 -667 approving the Engineer's Report, and an assessment, in accordance with said report, is hereby levied for the fiscal year 1990/91. SECTION 2. The City Clerk shall cause the diagram and assessment, or a certified copy thereof, to be filed with the County Auditor. SECTION 3.
