SUBJECT: Consider Request From Urban West Communities
(UWC) to Defer Area of Contribution (AOC)
Payments to Account for Reimbursements Owed to
UWC
The attached request from UWC requests deferral of their
Tierra Rejada /Spring Road AOC obligation since the City owes
them more than the AOC fees due for their current permit
request. At the current time, the City owes UWC an estimated
$660,000 in AOC reimbursements as follows:
1. Bridge $ 90,000
2. Tierra Rejada Median 170,000
within PC -3
3. Tierra Rejada Road 400,000
traffic signals
City staff erroneously issued 16 permits in the South Village
and 15 permits in the West Village model complexes without
collecting the required AOC fee payments. In addition, UWC
is applying for an additional 21 permits. City staff is
completing an in -house review of the Tierra Rejada /Spring
Road AOC and expects that report to be presented to the
Council on July 25, 1990.
In addition to the previously mentioned reimbursements, the
Tierra Rejada /Spring Road AOC is required to reimburse the
following items when funds become available.

1. Warmington median construction
2. Warmington median landscaping (due to City's Gann
Fund)
3. Peach Hill at Spring Road traffic signal (due to
City's Gann Fund)
4. Additional traffic signal work on Tierra Rejada
Road by UWC
5. South of centerline portion of realignment of
Tierra Rejada Road east of Spring Road
As you are aware, these reimbursements are funded by future
payments of AOC fees by UWC and the planned Carlsberg
project. In light of this, the staff error and the
anticipated July 25, 1990 AOC report, I recommend the
deferral of up to 75 AOC payments by UWC pending Council
receipt of the previously mentioned AOC report.
STAFF RECOMMENDATION
Approve deferral of 75 Tierra Rejada /Spring Road AOC payments
by UWC pending the staff report to Council on this AOC.

Re: Tierra Rejada Area of Contribution Fees
Dear Steve:
Urban West Communities is currently in the process of applying for 21
building permits and is conditioned to pay Area of Contribution fees prior
to issuance of the permits.
It is my understanding that the City of Moorpark is finalizing a
reconciliation of Tierra Rejada Area of Contribution fees.
We request that the City Council defer our conditioned obligation to pay
these fees predicated upon the fact that the reimbursement owed to Urban
West Communities will significantly exceed the amount of these fees.
