All interested parties are invited to attend and be heard at a public hearing to
be held by the City of Moorpark City Council meeting on Wednesday, August 1, 1990
at 7:00 P.M. located in the City Hall building at 799 Moorpark Avenue, Moorpark,
CA 93021.
Consideration will be given to the formulation of the Tierra Rejada Road
Reconstruction Project Area of Benefit. The proposed Area of Benefit will be set
up for the reconstruction of Tierra Rejada Road between Spring Road and State
Route 23 (see attached Area of Benefit Map, Exhibit "C ").
The proposed method of fee apportionment within the Area of Benefit is for the
property owner to pay for the cost of construction of the road along their
frontage of land. The cost estimates for roadway construction through the
respective properties involved is available for public review at City Hall in a
report entitled "Engineering Report for Tierra Rejada Road Reconstruction Project
Area of Benefit ". It should be noted that the final cost to the respective
property owners will be based upon actual costs incurred.

The enclosed Engineer's Report provides for the creation of an Area of Benefit
to finance the reconstruction and widening of Tierra Rejada Road from Spring Road
to State Route 23. The formation of an Area of Benefit, as described in the
California Subdivision Map Act, Government Code Section 66484, and Ordinance No.
70 of the City of Moorpark, authorizes the City to assess fees for bridge and /or
major thoroughfare construction.
This report provides the estimated costs of the proposed improvements, the area
of benefit, the method of cost allocation and the apportionment of the fee.
Public Notice requirements were also followed per Government Code Section 65091.
Newspaper publications for this Public Hearing and notification to the property
owners within the Area of Benefit were mailed at least ten days prior to the
hearing date. Notices were also mailed to local agencies providing water,
sewage, streets, schools and other essential facilities to the project.
The total cost for the Tierra Road Reconstruction project is presently estimated
at $2,731,000. This cost includes the construction, as well as utility costs for
this project (refer to Table 1). The estimated assessment for Carlsberg for the
north side of Tierra Rejada Road between Spring Road and State Route 23 is
$1,376,900. The breakdown of this assessment is reflected in Tables 1, 2 and 3
in the attached report.

RECOMMENDED ACTION
It is recommended that the Area of Benefit for the Tierra Rejada Road
Reconstruction Project (East of Spring Road to State Route 23) be adopted by the
City Council unless written protest by the owners of more than one -half of the
area of the property being benefitted by the proposed improvement is received.

AREA OF BENEFIT
I. SUMMARY AND RECOMMENDATIONS
This Engineering Report provides the documentation supporting the creation
of an Area of Benefit for the financing of improvements involved in the
reconstruction and widening of Tierra Rejada Road from the intersection
with Spring Road to State Route 23. The formation of Areas of Benefit, as
described in The California Subdivision Map Act, Government Code Section
66484, and Ordinance No. 70 of the City of Moorpark authorizes the City to
assess fees for bridge and /or major thoroughfare construction. This
report provides the estimated cost of the improvements, the area of
benefit, the method of cost allocation and the apportionment of the fees.
In summary, this project fronts two properties and it has been determined
that one property benefits and the other does not. This determination of
benefits is further discussed in Section III. Based on the calculations
presented in this report, the fee recommended for Conejo Freeway
Properties Limited, a limited partnership (Carlsberg), is $1,376,900 for
the construction of Tierra Rejada Road (north side only).
II. BACKGROUND

Per the City of Moorpark's Circulation Element, Tierra Rejada Road is
shown to carry through traffic and extend from Los Angeles Avenue
southeasterly and eventually connect with the Moorpark Freeway (State
Route 23). Tierra Rejada Road serves as a major arterial to the entire
portion of the City south of the Arroyo Simi.
Per the City's existing Circulation Element, Tierra Rejada Road should
provide four travel lanes in a 68 to 94 foot right -of -way width. The
fully improved portions of this roadway have a 94 foot right -of -way and
provide four travel lanes, a raised median, emergency parking /bike lanes
and sidewalks. This roadway is per Plate B2 -B of the City's Road
Standards.
Currently, Tierra Rejada Road is fully improved from its intersection with
Los Angeles Avenue to the eastern boundary of Tract No. 2865. The span of
Tierra Rejada Road between the eastern boundary of Tract No. 2865 and
Spring Road is currently only one travel lane in each direction without
curb, gutter and sidewalk. This area is to be fully improved by LDM -11
(Embassy Group) in the near future
The roadway section between Spring Road and State Route 23 is considered
the final critical link. Currently, this roadway section carries 18,000
ADT and is projected to ultimately handle 24,000 ADT based upon the
Carlsberg Specific Plan Traffic Study dated April 25, 1990 and prepared by
Austin Foust Associates.
This remaining span of Tierra Rejada Road between Spring Road and State
Route 23 currently does not meet adopted City Road Standards and is

approximately twenty -six (26) feet in width, and provides only one travel
lane in each direction. Both the horizontal and vertical curves of the
existing roadway are not per Plate B2 -B of the City's Road Standards. Due
to these factors, the roadway widening will require a complete realignment
and reconstruction to comply with City road standards. With other
portions of Tierra Rejada Road already fully improved or soon to be
improved by others, this span is the last critical link to be fully
improved between Los Angeles Avenue and State Route 23 (refer to Exhibit
"All) .
Presently, Urban West Communities (UWC) is required to design and
construct a modified or interim street section through this area (refer to
Exhibit "B ") pursuant to Settlement Agreement between UWC and City dated
July 14, 1988. These improvements will provide four travel lanes, paved
bike lanes and earthen shoulders. Bike lanes will be paid for directly by
the City. The center median area will be a graded Swale for drainage
purposes and does not include a raised median curb. All associated storm
drainage and grading to construct this road section will be included in
this project. These improvements will also include a traffic signal at
the intersection of Spring and Tierra Rejada Roads.
Ultimate paveout, raised median, curb and gutter, and sidewalk will be
completed at a later date by adjacent development. These improvements
will require additional grading and the extension of storm drain
facilities provided by this project. Upon their completion, this portion
of Tierra Rejada Road would then comply with Plate B2 -B of the City's Road
Standards. The Spring Road /Tierra Rejada Road Area of,Contribution will
only fund the raised median and the southerly two travel lanes not
ultimate paveout, curb and gutter and sidewalk.
Carlsberg, the current owner of the property on the north side of Tierra
Rejada Road, has dedicated the necessary right -of -way and construction
easements to reconstruct Tierra Rejada Road between Spring Road and State
Route 23. Although they have dedicated the right -of -way, there are no
entitlements requiring Carlsberg to construct this portion of Tierra
Rejada Road.
METHOD OF COST APPORTIONMENT AND RECOMMENDED FEE
The area of benefit only includes the undeveloped property located north
of Tierra Rejada Road as shown on the enclosed map entitled "Tierra Rejada
Road Reconstruction Project - Area of Benefit, Exhibit 'C"'. The area of
benefit does not assess street improvements costs along the Pacifica
parcel or south of proposed centerline including all related grading,
drainage and utility relocation costs.
The Pacifica parcel is only 3900 square feet in total area and is
presently being acquired by the City. It appears that, due to its total
area and the amount being taken for right -of -way that there is no benefit
to the remainder of parcel.
The street improvements along the south side can be considered an integral
part of the area of benefit, but the City has provided that funding of
this work will be from the Spring Road /Tierra Rejada Road Area of
Contribution. Because of this alternative funding mechanism, costs

associated with construction of the south side have not been included in
the area of benefit and, therefore, improvements associated with the south
side will not be apportioned to property owners.
The California Subdivision Map Act and the City Ordinance Code require
that the method of cost apportionment must be based upon benefit that the
properties receive from the improvements. The property identified on the
map (Exhibit "C ") is presently undeveloped and will directly benefit from
the improvements to Tierra Rejada Road once they develop.
Road Improvement Cost Allocation
Table 2 lists a construction cost breakdown of all interim improvements
per Exhibit "B" to reconstruct Tierra Rejada Road between Spring Road and
State Route 23. The overall length of project is approximately 6,200
feet. As indicated in this Table, the total construction cost has been
allocated to the north and south sides of roadway centerline.
To determine this north side cost allocation, the project design plans
were reviewed. Based on this review, quantities and resulting costs were
allocated accordingly. Most cost items such as asphalt pavement and
street fine grading were divided equally since two lanes are to be
constructed on each side of centerline.
Construction items not equally allocated were items where the work occurs
predominantly on one side and the resulting cost is allocated to that
side. An example is earthwork excavation. The majority of excavation
occurs on the north where the road alignment cuts through the existing
hillside and such work is not required to that extent on the south.
Concurrent with this hillside grading is the need for bench drains and the
cost is, therefore, allocated to the north side of roadway. Similarly,
roadway over - excavation and recompaction is totally allocated to the south
side since that work is located on the south and does not occur on the
north.
The same approach was also taken with the proposed storm drain facilities.
If an item is needed solely to develop the north side such as extending a
30 -inch RCP storm drain northerly, this cost was then allocated to the
north barrel. Similarly, the cost to extend the existing 42 -inch storm
drain southerly was allocated to the south side of the roadway.
Upon completing this item -by -item breakdown of cost allocation, the
overall result is an almost equal cost allocation; the north side is
assessed 52% and the south barrel the remaining 48 %. In reviewing Table
2, the main reason for this difference is in earthwork related items on
the north side. These costs are primarily in the earthwork excavation,
the associated bench drains and erosion control for this hillside.
Utility Relocation Cost Allocation
Table 3 provides a total cost for each of the five utilities involved in
this project. Each cost estimate was supplied by the respective utility.
With the exception of Southern California Edison Company, each utility
must construct completely new facilities in an alignment consistent with

the new roadway design. Presently, each of these underground facilities
has an alignment which serpentines throughout the existing and proposed
roadways. In addition, with the vertical realignment of the roadway, each
utility would have been left either too deep or too shallow. To rectify
these poor horizontal and vertical alignments, it was necessary for each
utility to relocate and reconstruct their facilities. Based upon utility
company input and the roadway realignment, new locations within the
proposed roadway were assigned to each utility. These new locations have
Camarosa Water District and Edison Company located in the southern portion
of the roadway. Shell Oil, Southern California Gas and Pacific Bell
Telephone Companies located in the northern half of the roadway.
The Edison Company work requires relocating several existing power poles.
These power poles remain south of the existing and proposed roadways and,
therefore, only need to be relocated due to the construction of the
southern portion of the roadway. For this reason, as indicated in Table
3, this entire cost is allocated to the southern side of the roadway.
In summary, the remaining utility costs were allocated 50% to the
nouthside and 50% to the southside of the roadway centerline for the
following reasons:
1. Each existing utility line presently serpentines throughout
the roadway. Except for the Edison facilities, each utility
could have been relocated to the north or south of the
centerline;
2. pith the new vertical alignment, each utility would be either
to deep or to shallow; and
3. The new location of each utility was based on utility company
input and construction phasing.
Assessment Summary
Table 1 is then a cost summary for Tables 2 and 3. In addition, it also
reflects the general administrative, design, inspection and right -of -way
costs not addressed in the previous tables
In overview, the total project cost is $2,731,400 with the north side
allocated approximately 50.4% of this total and the south side the
remaining 49.6 %.
That the south side will be allocated to the Spring Road /Tierra Rejada AOC
is based upon the fact that the property located along the south side is
outside the City limits and the City has no jurisdiction or entitlement
authority over this property. Therefore, this roadway segment is best
funded by an AOC funding mechanism.
As reflected in Table 1, the estimated assessment for Carlsberg for the
north side of the roadway is $1,376,900. The improvements costs and
resulting assessments are based upon the best estimates available at this
time. An assessment for a property within the Area of Benefit is based
upon the engineer's estimate cost of the road improvements if the fees are
collected prior to construction, or they are based upon the actual cost of

It should be noted that right -of -way acquisition costs are only expected
from the acquisition of the Pacifica and this cost is an estimate only at
this time. Interest costs will not exceed 8 %. These actual costs for
right -of -way and interest are unknown at this time but will be estimated
and imposed upon the property owner's assessment as a part of the
apportioned fees, if applicable.
Government Code Section 66484 as a part of the Subdivision Map Act and
City Ordinance No. 70, provide for the collection of a fee as a condition
of approval of a final map or as a condition of issuing a building permit
or at such a date as may be required by applicable law. It will be at
City's discretion as to which one of these will be imposed upon the
developers of the land within the area of benefit.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF MOORPARK ESTABLISHING COMMUNITY
FACILITIES DISTRICT NO. 1 OF THE CITY OF
MOORPARK (MOORPARK PARAMEDIC AND
AMBULANCE DISTRICT), PROPOSING THE LEVY
OF A SPECIAL TAX WITHIN COMMUNITY
FACILITIES DISTRICT NO. 1 OF THE CITY OF

AMBULANCE DISTRICT) AND CALLING AN
ELECTION
WHEREAS, the City Council ("City Council ") of the
City of Moorpark ( "City ") has previously adopted Resolution
No. 90 -690 stating its intention to form Community
Facilities District No. 1 of the City of Moorpark (Moorpark
Paramedic and Ambulance District) ( "District ") pursuant to
the Mello -Roos Community Facilities Act of 1982, as amended
("Act"); and
WHEREAS, a copy of Resolution No. 90 -690, setting
forth a legal description of the proposed boundaries of the
District and the services proposed to be provided therein,
and the rate and method of apportionment of the special tax
proposed to be levied within the District is on file with
the City Clerk and incorporated herein by reference; and
WHEREAS, on July 19, 1_990, notice was published in
the Moorpark News- Mirror as required by Government Code
Section 53322 relative to the intention of the City Council
to form the District and to levy a special tax within the
boundaries of the District; and
WHEREAS, on August 1, 1990, the City Council
conducted a noticed public hearing as required by the Act
relative to the proposed formation of the District and the
levy of a special tax therein, at the conclusion of which
the City Council determined to proceed with forming the
District through the adoption of this Resolution; and
WHEREAS, prior to commencement of the public
hearing on August 1, 1990, there was filed with the City
Council a report ( "Report ") containing a description of the
services necessary and adequate to meet the needs of the
District, and an estimate of the cost of such facilities and
incidental expenses to be financed by the District a:
required by Government Code Section 53321.5; and

WHEREAS, at the public hearing all persons desiring
to be heard on all matters pertaining to formation of the
District and the levy of the special tax were heard and a
full and fair hearing was held; and
WHEREAS, at the public hearing evidence was
presented to the City Council on the matters before it, and
the City Council at the conclusion of the hearing is fully
advised as to all matters relating to formation of the
District and the levy of the special tax; and
WHEREAS, a negative declaration ( "Negative
Declaration ") regarding formation of the District has been
prepared in compliance with the California Environmental
Quality Act ( "CEQA11) and the Cityls CEQA guidelines;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
MOORPARK DOES HEREBY RESOLVE AS FOLLOWS:

Section 3. A community facilities district to be
designated "Community Facilities District No. 1 of the City
Of Moorpark (Moorpark Paramedic and Ambulance District)" is
hereby established pursuant to the Act. The City Council, is
hereby appointed to act as the legislative body of the
District pursuant to the Act.
Section 4. The legal description of the boundaries
of the District, as described in Resolution No. 90 -690, are
incorporated herein by reference, and shall be the
boundaries of the District. The map of the District is
recorded in l'Q office of the Ventura County Recorder in
Book 4, Page ' of the Book of Maps of Assessments and
Community Facilities Districts, as required by Streets and
Highways Code Section 3111.
Section 5. The facilities and services
( +services ") authorized to be provided within the District
and funded with a special tax in accordance with section 7
of this Resolution are further described in Resolution No.
90-PlOand the Report. The District is authorized to provide
the Services in accordance with the Act. The District has
incurred and intends to incur further "incidental expense %,,
(as defined in Government Code Section 53317(e)) related to
the formation of the District and planning the Services.

Section 6. The City Council has considered the
Negative Declaration prepared with respect to the formation
of the District and the financing of the Services which is
on file with the City Clerk and finds, on the basis of the
initial study attached thereto, that there is no substantial
evidence that the formation of the District will have a
significant effect on the environment and the City Council
approves the Negative Declaration. The City Clerk is hereby
authorized and directed to file a Notice of Determination
and a copy of the Negative Declaration with the County
Clerk.
Section 7. Except where funds are otherwise
available, it is the intention of the City Council to levy
annually in accordance with the procedures contained in the
Act a special tax sufficient to pay for the Services and the
costs of forming the District and administering the levy and
collection of the special tax and all other costs related to
the special tax levy and District operations. The rate and
method of apportionment of the special tax are described in
detail in Exhibit S, which is attached hereto and
incorporated herein by reference. Exhibit B allows each
property owner within the District to estimate the maximum
amount that may be levied against each parcel. The City
Council hereby determines the rate and method of
apportionment of the special tax set forth in Exhibit B to
be reasonable. The special tax is apportioned to each
parcel pursuant to Section 53325.3 of the Act and such
special tax is not on or based upon the ownership of real
property.
Upon recordation of a notice of special tax lien
pursuant to Streets and Highways Code Section 3114.5, a
continuing lien to secure each levy of the special tax will
attach to all nonexempt real property in the District and
the lien shall continue in force and effect until the
special tax obligation is prepaid and permanently satisfied
and the lien cancelled in accordance with law or until
collection of the special tax by the City Council ceases.
The office of the City Clerk of the City of
Moorpark, located at 799 Moorpark Avenue, Moorpark,
California 92031, the telephone number of which is (805)
529 -6864, is hereby designated as the office responsible for
preparing annually a current roll of special tax levy
obligations by assessor's parcel number and for estimating
future special tax levies pursuant to Government Code
Section 53340.1.

Section 8. The City Council finds that the
proposed services are necessary to Zest the present demand
as well as any increased demand that will result from new
development within the District.
Section 9. Written protests against formation of
the District, the specified types of Services and the
levying of the special tax are not on file from more than
50% of the registered voters nor by property owners of one -
half (1/2) or more of the area of land within the District.
Section 10. An election is hereby called for the
District on the proposition of levying the special tax and
establishing an appropriation limit for the District
pursuant to Government Code Section 53325.7 and shall be
consolidated with the county general election ballot of
November 6, 1990. The proposed measure shall be
substantially in the form attached as Exhibit C.
Section 11. The preparation of the Report is
hereby ratified. The Report, as submitted, is hereby
approved and is made a part of the record of the public
hearing regarding formation of the District, and is ordered
to be kept on file with the transcript of these proceedings
and open for public inspection.
Section 12. Not later than fifteen (15) days
following the adoption of this Resolution, the City Clerk
shall cause a Notice of Special Tax, in the form required by
Streets and Highways Code section 3114.5, to be recorded
with the Ventura County Recorder.
Section 13. The City Council finds and determines
that all proceedings herein are valid and in conformity with
the Act. The City further finds and determines that such
finding shall be final and conclusive.

the City Council shall be final and conclusive upon all
persons entitled to appeal to the City Council, as to all
errors, informalities, and irregularities which the City

County of Ventura in accordance with the provisions of
Section 3111 of the California Streets and Highways Code

later than 15 days prior to the date of the public hearing
as set forth in Exhibit C hereto.
Section 4. The communities facilities district
proposed to be established shall be known and designated as
"Moorpark Community Facilities District No. 1 (Moorpark
Paramedic and Ambulance District)" ( "Community Facilities
District ").
Section 5. It is the intention of the City
Council to provide certain services and to order the
funding, financing, construction, installation and
acquisition of certain public facilities with an estimated
useful life of five (5) years or longer related to those
certain services within the Community Facilities District
( "Services "), which are public facilities and services that
the City or a public agency is authorized by law to
contribute revenue to or to construct, own or operate. A
non - exclusive list of the proposed Services is attached as
Exhibit "A" and incorporated herein by reference. The cost
of providing, constructing, installing and acquiring the
Services includes incidental expenses consisting of the
costs of planning and designing the Services, including the
costs of environmental evaluations thereof, the cost of
providing administrative and consultant services, all costs
associated with the establishment of the Community
Facilities District, the determination of the amount of any
special taxes to be levied, the cost of collecting any
special taxes, and costs otherwise incurred in order to
carry out the authorized purposes of the Community
Facilities District, together with any other expenses
incidental to the funding, financing, construction,

Section 6. It is the intention of the City
Council that, except where funds are otherwise available, a
special tax sufficient to pay for the Services, including
the repayment of funds advanced to the Community Facilities
District and the annual administration expenses of the City
of Moorpark and the Community Facilities District in
determining, apportioning, levying and collecting such
special taxes, secured by recordation of a continuing lien
against all non - exempt real property in the Community
Facilities District, will be levied annually on land within
the -boundaries of the Community Facilities District. The
rate and method of apportionment of such proposed special
tax is set forth in Exhibit B, attached hereto and
incorporated herein. Exhibit B provides sufficient detail
to allow each landowner or resident within the Community
Facilities District to estimate the maximum amount that such
person will have to pay for the Services.
In the event that property within the Community
Facilities District is acquired or dedicated to a public
agency subsequent to the date of formation of the Community
C Facilities District, the special tax on such tax will be
released pursuant to Section 53317.3, and such parcel will
become exempt property under the provisions of the rate and
method of apportionment for the Community Facilities
District as to all future obligations to pay the special tax
imposed by the Community Facilities District.
There is no prior indebtedness and no changes are
needed in property taxation to pay for prior debt pursuant
to Government Code Sections 5331.3.6 and 53313.7.
Section 7. On August u., 1990, at 7:00 p.m., in
the City Council chambers, City of Moorpark, a public
hearing will be held at which the City Council shall
consider the establishment of the Community Facilities
District. The public hearing is more particularly described
in the Notice of Public Hearing set forth in Exhibit C,
attached hereto and incorporated herein. If, following the
public hearing, the City Council determines to establish the
Community Facilities District, proposes to levy a special
tax within the Community Facilities District, proposes to
establish an appropriations limi.t for the Community
Facilities District, and the City Council shall then submit
the levy of the special tax and the establishment of the

following manner: A Notice of Public Hearing required by
Section 53322 of the Act in substantially the form of
Exhibit C, shall be published in a newspaper of general
circulation published in the area of the proposed Community
Facilities District, such publication to be made pursuant to
Section 6061 of the Government Code, which publication shall
be completed at least seven (7) days prior to the date set
for such public hearing.

RATE, METHOD OF
APPORTIONMENT OF SPECIAL TAX AND
MANNER OF COLLECTION
The tax rate shall increase by the greater of two
percent or 3/4 of the increase in the annual Consumer Price
Index for the Los Angeles - Metropolitan Area, unless the City
Council establishes a lesser increase, for each year after
the formation of the District.
The method of apportionment is 75 percent of the
expenses to residential parcels and 25 percent to commercial
and industrial parcels.
The tax rate and apportionment are based on a
first -year budget of $869,520 for staff, equipment,
materials, supplies, training and facilities.
The special tax shall be collected in the same
[ manner as ordinary ad valorem property taxes are collected
and shall be subject to the same penalties and the same
procedure, sale, and lien priority in case of delinquency as
is provided for ad valorem taxes.

Section 9. Notice of the time and place of such
public hearing shall be given by the City Clerk in the
following manner: A Notice of Public Hearing required by
Section 53322 of the Act in substantially the form of
Exhibit C, shall be published in a newspaper of general
circulation published in the area of the proposed Community
Facilities District, such publication to be made pursuant to
Section 6061 of the Government 'ode, which publication shall

be completed at least seven (7) days prior to the date set
for such public hearing.

the hour of 7:60 p.m., in the City Council chambers, City of
Moorpark, a public hearing will be held at which the City
Council shall consider the establishment of the Community
Facilities District, the scope of the Services to be
provided, the proposed rate and method of apportionment of
the special tax, the proposed appropriations limit for the
Community Facilities District and all other matters as set
forth in the Resolution of Intention. At the above -
mentioned time and place for such public hearing, any
persons interested, including all interested taxpayers,
property owners and registered voters within the Community
Facilities District, may appear and testify for or against
the establishment of the Community Facilities District, the
extent of the Community Facilities District, or the funding,
financing, construction, installation and acquisition of
Facilities or the establishment :)f an appropriations limit.
C. Any protests may be made orally or in writing, except
that any protests pertaining to the regularity or
sufficiency of such proceedings shall be in writing and
shall clearly set forth the irregularities and defects to
which the objection is made. All written protests shall be
filed with the City Clerk of the City of Moorpark on or
before the time fixed for such public hearing, and any
written protest may be withdrawn in writing at any time
before the conclusion of such public hearing. If written
protests against the establishment. of the Community
Facilities District are filed by fifty percent (50 %) or more
of the registered voters, or six (6) registered voters,
whichever if greater, residinc w'�:hin the Community

Facilities District, or the owners of one -half (1/2) or more
of the area of the land proposed to be included within the
Community Facilities District, and protests are not
withdrawn so as to reduce the value of the protests to less
than a majority, the proceedings shall be abandoned. If
said majority protest is limited to certain types of
facilities or services or certain provisions of the special
tax, those facilities or those provisions of the tax shall
be eliminated from the resolution of formation.
