Subject: RPD 89-4 Minor Modification No. 1
Background
On May 16, 1990 the City Council approved Resolution 90-673 approving
Residential Planned Development Permit 89-4 allowing construction of
257 townhouses and three recreation areas on a 22.05 acre parcel.
Discussion
The requested Minor Modification to RPD 89-4 is to change the wording of
Condition 99.c of Resolution 90-673. Condition 99.c currently reads as
follows:
"The entire attic area for the multifamily residential
units shall be convened to a storage area by
installing 1/2 inch thick plywood flooring and full
sheetrock walls. The sheetrock shall be a minimum of
5/8 inch thick. An electrical light and folding ladder
shall also be installed. A smoke alarm shall be
provided if preferred by the Fire Department."
When this permit was approved by the City Council on May 16, 1990, the
submitted elevations depicted each unit as having an attic located above
799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864
the top floor hallway. This attic was to have had a maximum height of
approximately ten feet. At the time of approval the submitted sectional
elevation (attached) did not take into account the structural designs
necessary to support the roof. After taking into account the truss beams
necessary for the roof support, the height of the attic ranges from a
minimum of 2'4" to a maximum of 6'6" in height (compared to a minimum
of 4'10" before the truss beams were considered). It is the contention of
the applicant that due to the drastic height reduction of the attic
(precluding use as a storage area or a bonus room), the wording of
Condition 99.c should be revised. The proposed wording being requested
in this application is as follows:
"That the attic area above the dwelling space must be
accessible for light storage by a ceiling opening with
a drywall cover, an electrical light with a switch
must be installed, and four (4) sheets of 4'x8'x1/2
inch plywood be installed across the ceiling joints at
the access opening."
Staff can support the applicant's request with a condition that a folding
ladder (or some other type of ladder which shall be approved by the
Director of Community Development) be installed in each unit to provide
access to the attic. It is staff's position that a folding ladder attached to
the attic space is necessary for both access and safety reasons. The
Director of Community Development will condition that the revised text of
condition 99.c. read as follows: "That the attic area above the dwelling
space must be accessible for light storage by a ceiling opening with a
drywall cover, an electrical light with a switch must be installed, and
four(4) sheets of 4'x8'x1/2 inch plywood be installed across the ceiling
joints at the access opening. A folding ladder or other means as approved
by the Director of Community Development shall be installed to provide
access to the attic."
The Director of Community Development has reviewed the proposed
modification and intends to approve it with the condition noted above.
Pursuant to resolution No. 88-523 the Director has the authority to
approve Minor Modifications. this matter is being presented to the council
as a courtesy. In the event the Council wishes to appeal the Director's
decision, it may do so. Should the Council desire to appeal, it should set a
public hearing date. The next available meeting date would be the
Council's regular meeting of September 5, 1990. If the Council takes no
action then the Director's decision stands.
